Il commissario Giuttari, che si è documentato su tutta la vicenda, ipotizza che Pacciani è colpevole degli assassini per cui è stato condannato e che inoltre ha avuto dei complici che spiegano tutte le incongruenze evidenziate dall'avvocato Fioravanti. Continuando, il commissario Giuttari rammenta che dopo il delitto del 19 giugno 1982 due testimoni videro due automobili che procedevano a forte andatura, la già citata Fiat 128 Coupé rossa che seguiva a forte andatura la Fiat 126, guidata senza dubbio da Pietro Pacciani; anche altri due testimoni, quella sera stessa, videro la medesima Fiat 126 bianca allontanarsi velocemente in senso opposto al luogo del delitto e disegnarono il profilo del viso del conducente, che corrispondeva al viso di Pacciani; di conseguenza, chi era alla guida della Fiat 128 Coupé rossa era il complice di Pacciani.
