The trial of a man accused of murdering his mother in their Adelaide Hills home in 2022 has started in South Australia’s Supreme Court. The son has admitted to accidentally killing his mother but denies it was an act of murder. On day one, the court has heard of years of festering bitterness between the two.

00:15in the woodshed behind her house after her son repeatedly hit her over the head with a wooden
00:20axe handle. The court heard police attended the Cravers West house after Ms Simon's friend
00:26reported not hearing from her for more than a week. Prosecutor Coslessis said Mr DeSimone was
00:32getting up from bed when he told police that his mother was in the woodshed. When police asked why
00:38Mr DeSimone responded because she's a piece of s**t. The prosecutor added that after he was arrested
00:45Mr DeSimone told his mother's friend that Linda was a terrible person you don't know her how I did.
00:52The court heard the two would argue over money and Ms Simon was worried about her son's use of
00:57methamphetamine, cocaine and heroin. It also heard that police were called to the property several
01:03times between April 2020 and February 2022. The prosecutor said it will be their case that the
01:10alleged murder did not happen out of the blue and that in hindsight it didn't happen entirely as a
01:16surprise. The 40 year old today pleaded guilty to manslaughter but the prosecution didn't accept
01:22that and claimed the nature of the attack proved Mr DeSimone had the intention to kill his mother
01:29and therefore should stand trial for murder. The trial by judge alone continues.
