00:29and his wife carrie arrived at the delta park lowe's in portland oregon what may have started as an
00:35explosive argument rapidly escalated turning deadly in the blink of an eye
00:43the security guard just shot my husband about seven months before this appalling incident took
00:49place in september 2020 49 year old freddie nelson a home renovator and woodworker was stopped by two
00:56security guards after he'd loaded up his truck with wooden pallets taken from behind lowe's
01:01the guards worked for the cornerstone security group which provided armed security and was hired
01:06only to patrol the parking lots of delta park while it's unclear what happened prior to the security
01:12guards body cam footage being turned on freddie can be seen trying to leave you're sitting here shaking

02:13vehicle you can see in the footage and it blocked freddie's ability to leave you want to keep going

02:30go through that the guard eventually moved his vehicle so freddie could leave but this was just
02:38the beginning of the volatile incidents between freddie and the cornerstone security guards
02:43in january 2021 freddie was once again approached by two guards they saw that he had collected more
02:50pallets and had left his red and black truck out front while he went inside the storm
02:55all right we can wait here on this yeah okay because i i know we've had this problem with
03:01him before doing this so it's time to boot him off because we keep telling him are you saying you're
03:10excluding him yeah okay because i know that in the past we've told him not to do that we keep
03:17telling
03:17people not to do that so other guys have been excluded now yeah he's excluded yep man you're not
03:26supposed to take pallets i know while the guards waited for freddie to come to his vehicle they took
03:32a look at how many pallets he'd taken while they seem to be under the impression that freddie didn't
03:37have permission to take the pallets this wasn't the case we're gonna tell him take those pallets take
03:43them off site and don't come back until january what's today 15th yep january 15th 2013. that's right
03:53freddie had been collecting pallets from lowe's for a few months at that point
03:57i know you've kind of had trouble with him in the past haven't you a little bit he doesn't yeah
04:04we've spoken at kirby avenue a couple times he really doesn't like us well he's not gonna like
04:10it's right now nope but yeah no i'd rather do a show of force on this guy than not it

04:19moment that freddie exited the storm so um we see that you're taking pallets yeah just didn't talk to
04:26manager okay so here's the problem it's a property rule violation so this has nothing to do with lowe's
04:34uh we are gonna ask you to go ahead take these pallets off for now but the problem is because

04:40multiple property rule violations in the past with other people doing it we're having to enforce
04:45it to the point that we're not going to let you back onto delta park center property for the next
04:49year okay well i'm not allowed right now um yeah we're gonna ask you to leave like i said you

04:56take these pallets but uh yeah we can't have you back on delta park center property for the next year

05:03take it up with lowe's what was that take it up with lowe's no sir you can take it up

05:09uh the property owner of delta park center right know him by name okay while this incident ended
05:17without issue things would only escalate from here what no one could have predicted was just how
05:23explosive things would become on april 19th freddie was once again stopped by a security guard while he
05:29was behind lowe's about to collect more pallets no you leave this property now you leave the property now
05:35no okay whatever okay turn around i'm gonna put you under arrest no you're not you want to bet no
05:42you are under arrest now no i'm not
05:46i just came out of the office nope yeah you are trespassed from the delta park property
05:54you are not to be here i just came out of you i don't care well go deal with them

06:42reveals that a security guard spoke to the lowe's manager and confirmed that the company freddie
06:46worked for was actually contracted to pick up the pallets freddie even showed the business card to
06:52the guard and the manager the report claimed that the pallets were supposed to be picked up in a
06:56truck with the company logo which freddie's truck didn't have regardless it seemed like the guards
07:02knew he had permission from lowe's to be there and yet we're still telling him to leave okay whatever
07:08you need to leave now i got work to do leave as soon as i'm done no
07:16you don't even know the rules i do yeah you are trespassed from this property yeah
07:26okay going to room stay on mate if you're not arresting me you want to bet back off
07:34go ahead i got the same thing you do yeah well then back off no not going to according to

07:40report later filed after this dispute the guard claimed that freddie had a small can of pepper
07:45spray in his left hand however the footage shows that the can appears to be in his right hand
07:50the guard stated that he then pulled out his own pepper spray for self-defense you're not arresting me
07:55you want to bet no no i'm not going to it's time for you to leave freddie then began walking

08:05towards lowe's it's time for you to leave you are trespassing this property
08:12no i actually i'm not i need you out here now please i i can't deal with it i can't

08:25freddie here yep i need i need pd out here now i'm behind those yeah while freddie headed into
08:35lowe's to get management the security guard aired his grievances to a bystander he's he's trespassing
08:41the property and he knows it so anybody knows the rules it's you he's not going to come back here
08:49without people please so he's got to come back here sometimes i'll tow it watch me
09:09oh no this is what he does
09:13the incident report from that day states that the lowe's management did ultimately ask freddie
09:19to leave but said that they would figure everything out so he could get pallets later
09:23it appears that despite the security guards trespassing freddie the lowe's management still
09:28expected him to come and pick up pallets this would become very important later the report also claimed
09:35that freddie was trespassed on april 12th for allegedly stealing pallets while other footage
09:40showed him being told he was initially trespassed in january more discrepancies would come up soon
09:45while the continued clashes between freddie and the security guards were certainly distressing
09:50things would only intensify from here once again freddie was approached by two guards
09:55this time while he was in the front parking lot at lowe's go get off the property
10:04you need to get off the property go don't play that game okay you could be here you did nothing

10:21trespassing sitting on the property you are not supposed to be on delta park property

11:26the security guards did in fact have a bee on the lookout for freddie
11:31the bolo shared with the cornerstone security guards stated he has attempted to state he is an
11:36approved vendor for lowe's regardless if he is or isn't he is not allowed in delta park center
11:42notably while the bolo says that freddie can be hostile it clearly states that he's not known to be
11:48combative the bolo also directs the guards to place him in custody if he does not comply with
11:53orders to leave the property everything came to a head on may 29 2021 when freddie parked in the lowe's
12:01lot with plans to look at flowers with his wife within 30 seconds of parking and before the couple
12:07had time to walk away from their truck they were approached by a cornerstone vehicle the security
12:12guard stopped partially in front of freddie's truck and an altercation immediately began one so dramatic
12:18that witnesses nearby started filming 28 year old logan gimble the cornerstone security guard confronted
12:26freddie and carrie telling freddie that he was under arrest for trespassing freddie apparently
12:31argued that logan had no authority to arrest him while this part of the argument wasn't filmed logan
12:37turned on his body cam soon after capturing the rest of the harrowing incident off my property
12:43you know you've been trespassed you know you're not supposed to be here
13:01you're refusing to leave my property
13:16i told you to leave property i told you to leave property you've been trespassed and warned
13:21multiple times i've called the police
13:29get the out the vehicle now
13:33you already tried to hit me once you move this vehicle again i will fire
13:40logan immediately shot four times into the windshield of the truck fatally wounding freddie
13:49i told you to stop and do not angle the vehicle at me
14:16you already tried to hit me in the vehicle once and that is assault you all to use pepper spray
14:33all of this occurred in less than a minute after logan turned on his body cam
14:38in the immediate aftermath a witness to the horrific event called 9-1-1
14:43i think i just witnessed a killing at lowe's
14:50the security guard just shot my husband
15:11i told you he tried to hit me i just shot him because he tried to hit me with a
15:16vehicle
15:17that is assault with a deadly weapon
15:29are you on the authorities with them right now i'm online with one right now told them that he's
15:34been trespassed multiple times i watched you i watched okay we all watched you yes he's shot yes
15:39yes we definitely i see blood yes he's he's bleeding out
15:44okay do i do they want me to render aid i don't know what to do at this point

15:52i'm i'm right here standing by my camera camera's on everything's been recorded
15:56yes he just shot my husband she's hysterical and rightfully so
16:08he's he i shot him four times because he tried to hit me with the vehicle
16:14they're they're on the they're on their authorities with them right now he locked his door
16:17he tried to hit me and pin me between the vehicle ma'am do you have a key a key
16:21to get in the car

16:31right away logan begins repeating his version of events but there are some key specifics in
16:36his story that will be challenged later he pulled the gun and he said stop or i'm going to shoot

16:42and the guy tried to run him over again he tried two separate times i know and he's got it
16:47all on
16:48his camera take care of your husband he also attempted to pepper spray me he was he also
16:52attempted to pepper spray pepper spray the cornerstone oh is that what that was he shut out the window
16:59yep notably logan doesn't mention that he first pushed a bottle of pepper spray into the partially
17:04open back window of the nelson's truck and attempted to spray the couple he's he's been
17:09trespassed by me every security member on my team he's been trespassed by the police and he's been
17:14trespassed by the owner of delta park so you hear all that and he continues to come on property
17:19while they wait for the police and ambulance to arrive logan makes a few questionable comments
17:24seemingly talking to himself i did not think i'd have to do that of course they're gonna
17:30they're gonna sympathize with the victim i think his wife is on the phone screaming
17:41i know i know you're i know you're trying to help i just want to make sure that there's anything
17:46they they they're apparently two paramedics it's this is out of my scope i'm just trying to try to
17:54try to pin me between the vehicle right here and then try to hit me right here again about five
17:58minutes
17:58after the shooting officers arrive on the scene i don't know what you need me to do this is the
18:03first time i've ever had to do this okay i had to had to discharge my firearm logan claimed he
18:14was
18:14the site supervisor responsible for all of delta park he then told officers that freddy had attempted
18:20to hit and pin him between his own security vehicle and his truck the officers instruct logan
18:25to call his supervisor and he once again relays the same story this time emphasizing a notable detail
18:32he angled the car for me and tried to floor the gas and that's when i fired in the middle
18:37of the
18:37officers checking freddy for signs of life logan makes this request uh is there a way i can get
18:44tomorrow so i can you know process what i just did okay i i know where i know we're tight
18:54but a few
18:55minutes later an ambulance also arrives eventually an officer guides logan to sit in the back of a
19:04police vehicle i did not think i'd have to do that today after leaving logan alone for five minutes
19:10the officers returned to collect his firearm hey bud how's it going uh go ahead and step out of the
19:16car is that cool enough back there for you it's a little warm but it's all right okay what we're
19:20gonna do uh i'm gonna i'm gonna take your firearm you don't have to touch it okay we're just gonna
19:25wait for detectives and stuff so it's just kind of protocol when somebody's in the back so it doesn't
19:30say you're in trouble or anything like that yeah i know i i'm okay where the process there's a weird
19:35thing with my dpst i got armed during the whole covid thing i mailed my stuff off and i have
19:40yet
19:40to get my actual card don't worry about it but i do have the the gold paper or the yellow
19:44paper that
19:45was issued today don't worry about it as it would turn out this was an issue that logan would need
19:50to worry about the day after the shooting he was brought in for a formal interview where he was
19:55read his miranda rights and agreed to speak with officers he tells them that he was in the air
20:00force for six years he was then asked to describe some of the things he dealt with working as a
20:05security guard so would you say that you've been able to resolve a lot of situations using uh just
20:12verbal you know verbally saying stuff to people or the escalation use it that's a lot of time it's
20:17you know just being calm rational but if you're talking about the individual i dealt with he was
20:22he's been a problem for us for a really long time i was going out driving around doing my patrols
20:28and this guy his name is freddie uh he's been trespassed from our property before he's been
20:33trespassed by me he's been trespassed i remember his security team he's been formally trespassed i
20:37think the police we had to get the police involved at one point they went over there and formally
20:40trespassed him and then he was trespassed again by the owner of delta park because how the whole
20:46incident started was like months back uh my guys were chasing a shoplifter out of these either marine
20:53fishermen or dicks i think it was marines actually the dude stole a bunch of like knives and other
20:57tools this guy freddie drove by opened up his car and let the dude hop in that we were chasing
21:02and
21:02then peel off with him and so that's why we you know that's where the trespass started along with
21:07the other security guards logan had several prior verbal disputes with freddie and had banned him from
21:12public areas about a month before the shooting he would go into the back of lowe's and he would steal
21:17a bunch of pallets from them because he has a little pallet company um but they had no formal agreement
21:22with him at all he had no okay from the manager like i wouldn't verify with him carrie nelson freddie's
21:29wife of 30 years was interviewed the same day she witnessed her husband being shot and she told a
21:35very different story than logan but security has a personal beef with us it says that we're stealing
21:41him but we have permission so they've been harassing us for like a month and a half now mark wilkins
21:49the
21:49property manager of tmt development which managed the delta park center stated in an email that freddie
21:55was not an approved vendor authorized to remove pallets he also said that he spoke to freddie and
22:00told him he was not approved but that he was only trespassed from private property owned by the landlord
22:06not from public areas in contrast logan claimed he'd banned freddie from public areas about a month
22:12before the shooting everybody most of the managers know us in there so you have a contract with lowe's
22:20to take the the pallets the spare pallets and use them for your own that we sell them you sell

22:25yeah okay where's the contract that do you have that with you or is it it's just a verbal verbal
22:31contract do you know who you have the verbal contract with at lowe's she puts in the bag i don't
22:35remember her name adding to the confusion police spoke with laurie sugarbeer the receiving manager
22:41at lowe's i was not here the day it happened i had no idea what happened but i dealt with
22:46this for like
22:46i want to say at least a month before the incident even happened and i was working with tmt or
22:52trying
22:52to i mean emailing tmt saying hey this is the person i want freddie nelson here to pick up our
22:57flag
22:58pallets they're trash to us we don't ever do a an official business um like contract okay but we do
23:05try
23:05to find someone who can come and pick them up out so that's not that that's that's the gist of
23:09what
23:09i was trying to get tmt to authorize because i know we've been around the security here saying
23:14we can't have anybody back here i'm like well you're impacting my business because i really need
23:18these picked up i had emailed tmt and a week later i emailed him saying look we're having issues with
23:23freddie and the security group because whatever you know i have no idea and every time i dealt with
23:30them they were seriously over aggressive with freddie because he was literally just standing there
23:35with me and i was having a business conversation with him uh-huh and they would they would just
23:40zoom up and be like you have to get off this property right now bye and i'm like you know
23:43hey we're just trying to get this resolved and every single time ryan i was like why are you guys
23:49just attacking this guy yeah i don't understand there was no formal agreement it was just sort of like
23:55you had identified freddie as a person that you were willing to let um take the pallets from the back

24:00the store okay and that's sort of your responsibility in some way is to manage the the pallets not being
24:08there anymore okay yeah exactly i manage all the trash here and how many times do you think that you
24:13are with freddie uh when cornerstone security had contacted him at least three times did you tell them
24:20that it was fine for him to be there yeah oh yeah yeah and i told him i said no
24:24you have to understand
24:25i'm working with freddie i have been working with freddie i've done you know before this all happened
24:30for the for even the first interaction with them in her interview lori also added this was there ever
24:37an issue with freddie stealing pallets from you guys that you know of no okay so you've never
24:42every time i authorized him to take the ones over because he was there and i'm like hey can you
24:47just take
24:47these 40. we started getting on to him about it like you know you're trespassed you're supposed to leave
24:52and so what he would do is he would just come to come on our property and sit in his
24:57car and just
24:58like just put around because he knows he's not supposed to be there but we can't do anything when
25:02he's in his car we've never had and not even a piece of paper saying we've been trespassed we've
25:08never had a date of when we've been trespassed we have no idea when we been trespassed it's unclear
25:15if freddie had actually been given a formal trespass order regardless logan explained his version of
25:21events for the day of the shooting i was driving by i saw his car pulled onto our property so

25:26over there like hey man you need to leave you know you're not supposed to be here like i don't

25:30how many times i have to tell you he gets out of his car i get out of my turn

25:35and get on my passenger side or my driver's side door i was like you know turn around put your
25:38hands
25:38behind your back you know you're not you know you've been trespassed you know you're not supposed
25:41to be and he like looked at me and was pretty much like you he pulled in front of us
25:45and like blocked us he told us that we have to get off the property and who is he the
25:52security guy
25:53do you know his name no can you describe him for me he has dark hair he's an apple we've
26:00had quite a
26:00few runs with him and i call him and then i'm calling the cops because i'm sick of this with
26:08you
26:08guys guys are harassing us all the time and he said i'm gonna mace you freddy got out of the
26:15car
26:16and um he said put your hands behind your bag freddy said yeah right and got back in the car
26:22and um grabbed his mace if he would have just gotten into his car and just left i would have
26:28i would have left it at that investigators asked logan to clarify why the situation escalated so quickly
26:34he was reaching for something inside okay i didn't know what it was i know that he's made
26:39threats against us multiple times before and i didn't want him pulling a firearm when i was by
26:44the side of the vehicle so that's why i sprayed into it okay and what was your hope to do
26:49when
26:49you i mean what was your intent when you sprayed in there um what were you protect my safety okay
26:54i guess i didn't cars are dangerous did freddy have a weapon on him i'm just asking because i need
26:59to yeah he had his mace but i don't think he had a chance to even fire it so freddy
27:05had some pepper
27:05spray as well yeah did he have a knife or a gun or anything like no no the main points
27:11of contention
27:12were the brief moments before logan fired and this time when he tells the story he includes something
27:18new and i was gonna step like towards my car this way so he could i i thought he was
27:24just gonna drive
27:24yeah this way so i start walking this way he angles the hood of the car towards me trying to
27:30pin me in between his his truck and my patrol vehicle but i stepped to my right and he narrowly
27:39missed you said he angled his tires towards you he yeah he turned the whole car and went forward towards
27:45me and um you were able to step out of the way and avoid being hit or were you hit
27:51by the car i think
27:52i i don't know i think he might have like tagged my hip or like like i felt something push
27:57up against
27:57my hip but no damage was done to me i got out of the way quick enough yet at the
28:03scene logan clearly
28:05states something that contradicts his new story you already tried to hit me once did your vehicle
28:11strike the security guard at any point no i don't think i don't think so i know no
28:20while it's unclear if freddy's truck actually hit logan he can be seen in the footage briefly
28:25touching the vehicle with his hand when it nears him however the most important piece of logan's
28:30story was something he mentioned quickly in interrogation like i heard the engine start
28:35to rev and then that's when i fired okay four shots into the left side or right side despite his
28:41claim
28:41the engine revved the truck doesn't seem to move before logan fired at the very least logan's first
28:47shot was almost simultaneous with the truck beginning to move
28:50get the out the vehicle now you already tried to hit me once you move this vehicle again i will
29:00fire
29:03just walk me through what your concerns were because my personal safety yeah 100 okay it's this job is
29:09not worth my life at 18 an hour sure so i'm going to do everything i can to make sure
29:13i go home but at
29:14the end of the day i also don't want to have to send somebody else more or less in a
29:20home and a body
29:21back notably cornerstone's use of force policy states that quote nothing in this policy requires
29:27an officer to retreat or be exposed to possible physical injury before applying reasonable force
29:34the autopsy revealed that freddy was shot in the head the left of his chest his right shoulder and in
29:39his thoracic vertebrae he died at the scene were you scared were you um or were you i wouldn't really
29:49say i was scared but that's only simply because of my my military background and all my training and
29:56stuff like that while logan had completed his armed security training through dpsst oregon's department
30:02of public safety standards and training he didn't have formal certification as an armed security guard
30:08this meant that he was not licensed to carry a firearm at the time of the shooting the cornerstone
30:13security group later admitted that along with logan two more of their security guards weren't certified
30:19but were carrying firearms logan wasn't charged for freddy nelson's death until december 2021 more than
30:27six months after the shooting at trial logan claimed it was self-defense and that after the truck struck
30:33him he got tunnel vision and didn't have the ability to recognize an alternative action to deadly force
30:39logan was eventually found guilty of second-degree murder unlawful use of a weapon and two counts
30:46of second-degree unlawful use of mace he was sentenced to life in prison with the possibility of parole after
30:5225 years following this carrie nelson filed a 25 million dollar civil lawsuit for wrongful death and negligence
31:00against the owners of the property and cornerstone security group it appears the case is still ongoing
