00:19It's a late August afternoon in 2022, and a Lincoln County, Nevada deputy has been dispatched to a restricted location
00:27surrounding Area 51
00:28in reference to a trespassing incident.
00:32Okay, crossing the boundary at this site, it's marked no trespassing, no drone zone, warning, air force installations.
00:41It's clearly marked.
00:43Driving past a clear, obvious place to turn around.
00:48We're at eight-tenths of a mile in.
00:54We're at one mile inside the boundary.
00:591.5 miles inside the boundary.
01:04Clearly, it's not a short trek, and the terrain is rough.
01:09So 1.6 miles inside the boundary.
01:12After several minutes of driving, the deputy has made it to the isolated location.
01:17He's briefed on the situation by a camo dude.
01:20Camo dudes are Area 51 security guards and not military.
01:25So, just so you know, the male, he's in handcuffs right now.

01:30The reason he's in handcuffs is because of the weapon and he's 6'2".
01:33The female, she was cooperative to let her out.

01:55Prior to the deputy's arrival, base security handcuffed the male subject due to his size and possession of a weapon.
02:02However, it appears that he's been cooperative and there was no legitimate officer safety basis to do this.

02:58And then, honestly, we got to that water area where it looks like there should be cows there.

03:04We were like, okay, the car, we should not be taking a car here.
03:07And at that point, we were looking for a place to turn around and they were on us.

03:12Trespass is generally a specific intent crime, meaning the intent element of the crime requires
03:18either knowing you don't have permission to be there or being told afterwards that you
03:22don't have permission but still refusing to leave.
03:26Generally speaking, accidentally wandering onto someone's land is not sufficient for the intent
03:31element of criminal trespass.
03:33After the long-winded explanation, the deputy lets them in on an interesting fact.

05:27They said they had directions to the Rachel gate, the bar.
05:31Like, yeah, you know, you, you drive on a grout road, you'll hit a paved road, you know, you'll get
05:35to the gate.
05:36And then this kind of dead ends of the gate.
05:38Well, I'm like, how did you get on this road?
05:40And they said, we never made it to the pavement.
05:42I'm like, at least you shouldn't have turned.
05:45Yeah, I'll tell you, I was, I was pretty shocked when I got up here.
05:48I was like, when I saw the car, I was like, okay, how would have expected this if it was
05:52four wheel drive?
05:53But only this little ass car.

06:08The deputy asks if the security staff will issue a Bannon Barr letter of some sort.
06:13And he states it will come from the Judge Advocate General's office, JAG.
06:18The JAG is a military equivalent of the U.S. government's own law firm, for lack of a better comparison.
06:25The Barr letter would serve as notice that they are not allowed on the property.
06:30Interesting to note that the Bannon Barr letters are issued primarily to locals.
06:34It suggests they expect locals to be more problematic than random tourists.
06:39The worst one I was, was active duty air force trespass.

06:44He was at the Alamo gate, you know, years before they had the actual gate, you know.

09:19Despite the steep fines, they take the news quite well.
09:22So, it's obvious that they just want to put the whole thing behind them at this point.
09:27And, as it turns out, they fared much better than many who came before them.

10:34Eventually, they part ways and the deputy proceeds to follow the couple before they finally arrive at their destination.
10:41The deputy exits his vehicle and retrieves the belongings that were temporarily confiscated.
