00:18Now on Tribunal Justice.
00:43Today's case was filed in Lodi, California.
00:48This is case number 3101 on the calendar in the matter of Dunn versus Frazier and Frazier.

00:54You're welcome, Judge.
00:55Parties have been sworn in.
00:56You may be seated.
00:57Ms. Dunn, you're suing the Fraziers for our court maximum of $10,000 for damages that you say you incurred
01:04as a result of being attacked by their pit bull.
01:07Mr. and Ms. Frazier, you two maintain that you don't owe the plaintiff any money.
01:11You say that she has inflated her medical bills and that she's also responsible for the death of your dog.
01:18Got your defense right?
01:19Yes.
01:19Ms. Dunn, let's just start with you.
01:21Take it from the top.
01:22How did you get bit?
01:23I was having dinner with my sister, my mom, and my husband.
01:26We left the restaurant.
01:28I proceeded to go back to my mom's house.
01:30They went to the grocery store, and then we're going to be coming back to the house.
01:34I pulled up to the front of the house.
01:36I saw two small white dogs.
01:39I did not see the pit bull, but I saw those two dogs.
01:42So I proceeded to get out of my car.
01:44They were two Yorkies, yes?
01:45You had two Yorkies?
01:46Two Yorkies.
01:47Yes.
01:47When I got out of my car, the pit bull had come around the other side of my car and
01:51proceeded
01:52to start to attack me.
01:54He bit me on my right arm.
01:57He sunk his tooth into my left arm here and then bit me again here.
02:02Let me stop you right there because we actually have a video of the attack.
02:05And before we watch the video, tell me why your dogs got out.
02:08So the fence, we rent our home, and the landlord never fixed the fence.
02:14So at the bottom part, there is like a little space.
02:17I think they finally just took off, and I believe that king was chasing the two small dogs.
02:21You were aware of the hole in the fence?
02:23Yes.
02:23Yes, sir.
02:24So I had already boarded the fence, but it was still loose for them to be able to get out.
02:29Okay.
02:29And before we watch this, a little disclaimer for all.
02:33These images and the ones that you will see later are indeed very, very graphic.

02:41Let's look at the video.
02:42And so, ma'am, you submitted this video because someone's ring camera actually caught the incident on camera.
02:50That is correct.
02:50It was my mother's ring camera.
02:52Okay, so what are we seeing now at the far end?
02:55I see two little dogs, the pit running wildly through the street.
03:00And is that you?
03:13That's you saying, help, help.
03:15Yes, because I heard someone next door.
03:18They opened up their door and told me to come inside.
03:20I didn't want to open my door because my dog was inside and I didn't want to open my door.
03:25And then your dog would come out and be a part of the pray.
03:29So I am going to make another disclaimer because the injuries are some of the worst I've ever seen since
03:36I've been doing this work.
03:37So can we put up the first picture of the plaintiff's bite?
03:40Again, it's very graphic.
03:42That was the one, the picture on the left is the one that happened on my right arm and the
03:46other one is what happened on my left arm.
03:48Each arm?
03:49Yes.
03:49May I see your arms now?
03:51Do you have any residual scarring?
03:53I do.
03:54That is the residual scar on my right arm.
03:57There is an indented scar right here, which is that one.
04:00And then there was a puncture wound here that happened as well.
04:04The police came to the scene, yes?
04:06Yes, they did.
04:07So at the time when the police arrived, I was already inside the neighbor's house.
04:10We were watching it from their window.
04:12The dog proceeded to notice the cops and then ran towards them.
04:17They were past the garage, so I wasn't able to see what happened after that.
04:21But they did shoot the dog.
04:22We were able to hear that.
04:23I'm actually going to read from portions of the police report because, Mr. and Ms. Frazier, you seem in your
04:30answer to be pointing the finger at the plaintiff for being responsible for the dog's death.
04:35But you know that it was the police officers who had to shoot the dog.
04:38Do you know why they had to shoot your dog?
04:40No, they would never.
04:41Okay, I'm going to read you the pertinent portion of the police report.
04:44Upon reaching my patrol vehicle, I attempted to unlock my driver's side door to enter it.
04:50However, I noticed in my peripheral vision that the dog was getting closer to me.
04:55The dog was chasing a bird and sprinting toward it.
04:58The dog then quickly changed its direction and locked its attention on me.
05:03The dog appeared to be snarling, barking, and growling at me, and I could see its fangs flexed and its
05:10eyes focused on me.
05:12Due to the rapidness of the call and the dog running at me, I was unable to yell or give
05:17commands to the dog to stop, and it did not appear to be changing its course.
05:22The dog closed distance toward me and was approximately three and a half feet from me before I pulled the
05:28trigger and shot the dog rapidly three times.
05:31I shot the dog because I reasonably feared that it was going to attack me and potentially cause me great
05:37bodily injury or even death.
05:39After the first shot, the dog was still moving toward me and appeared to lunge up at me.
05:46I continued to walk back and away from the dog, but it was still following me.
05:51After the additional two shots and moving back and away from the dog, the dog changed its course and sprinted
05:57forward and eventually ran to the nearby sidewalk and flopped on the ground.
06:02So that's the narrative of the police officer who was also almost attacked by your dog.
06:07They never even mentioned it to us.
06:09Like, they just said that all we heard when we pulled up was your dog was shot because the dog
06:13attacked me.
06:14They never went into detail with us or anything, Your Honor.
06:17Coming up on Tribunal Justice.
06:20And then you have the nerve to say, though, we'll pay a portion of your bill.
06:24Who says I'm going to pay a portion?
06:25Why, you're going to pick the bite on the left arm but not the one on the right arm?
06:33Christina Dunn is suing neighbors Ashani and Davian Frazier for $10,000 to cover medical bills after their pit bull
06:40brutally attacked her.
06:42Ashani and Davian say they owe nothing because Christina's bills are inflated and it's her fault their dog was shot
06:48and killed by the police.
06:50You don't dispute that it was your dog that caused those terrible injuries to the police.
06:55And I agree, that was terrible.
06:58I even apologize for everything.
07:00You also said that you were going to pay a part of the bills.
07:03Yes.
07:03Now, that's another part of your defense is you say, well, we told her we were going to pay some
07:07of the bills but not all of them.
07:08Why do you think that you have the right to pick and choose which parts of her injuries caused by
07:14your animal that you should be liable for?
07:15I believe that the medical expense of going to the hospital and that's okay.
07:21But there's also two medical bills that we have and I'm quite confused because they both come from San Joaquin
07:27General Hospital.
07:28One is straight up from San Joaquin General Hospital.
07:31The other one is from a, it says it's the hospital but it's another form.
07:36And then also on the San Joaquin Hospital General Bill it says payable to Pasadena, California.
07:41We're in San Joaquin County, that's Northern California.
07:44Why is the bill going to Pasadena?
07:46I'm just confused on why there's two bills and they both say the same date and two separate things.
07:51I don't understand.
07:52Well, I'm telling you right now, straight up, not making this up.
07:55I've never seen dog injuries like that.
07:57And if you were not in this forum and if she'd sued you somewhere else and she said,
08:01I want $10,000 for my injuries and $25,000 for pain and suffering, I promise you there's a judge.
08:07I promise you there's a jury who would have given her almost anything she's asking for because of the severity
08:12of those bites.
08:13So I'm just going to say right now, you caught a break by being here.
08:17Let's go through your bills.
08:18There is a $4,800 bill for an emergency department visit that's dated the day of the incident.
08:25You went to the emergency room, yes?
08:26I did go to the emergency room.
08:28It was San Joaquin General Hospital that they took me to in French camp.
08:31And then I see another bill from San Joaquin General Hospital for an emergency room pharmacy preventative care services.
08:38How do you explain those two bills?
08:40There was a bill for the hospital visit itself.
08:43There was a physician's bill, which is that other bill that you were talking about.
08:47And then there was the ambulance bill.
08:50And then I did get some prescriptions given to me at the hospital.
08:55So that's for their pharmacy there.
08:57Did you ever share your bills with the defendants?
08:59I did.
09:00I had no inclination at that moment that there wouldn't be any reason why we wouldn't be able to work
09:05this out.
09:06Because you actually told her that you wanted to make payment arrangements.
09:09So what happened?
09:10So we were constantly paying her.
09:12Right now my husband is on leave with disability.
09:13We have three kids.
09:14And we all know California is very expensive.
09:16And I was constantly paying her $100 a month.
09:19The last payment she received, I believe, was October of 2024.
09:23My husband was not working.
09:24It was just me.
09:25And she texted me in December.
09:27And she said, hey, I would like to meet up.
09:29So I said, okay.
09:31And I've never received that phone call.
09:32Because also I wanted to discuss with her, I don't believe that all these bills we should be paying.
09:38I don't know where the $16,000 came from.
09:40But your dog got out and caused very serious injuries.
09:46So just digest that.
09:49Judge Domingo?
09:50Well, I'm on board with a statement that Judge Aka made to you.
09:52Based on the scars on your arm, the pain and suffering that you went through,
09:57that you could have brought this case in a civil court or even a Supreme Court, a higher court,
10:02and probably recovered $100,000.
10:05Really?
10:06I mean, I saw the blood dripping off your arms onto the ground.
10:10I mean, it's just a total outrage.
10:12It's such an outrage that even if I looked at the medical records and wanted to accept what you were
10:16saying,
10:17that one of those bills wasn't good, still, any two of these bring her over $10,000.
10:22Any two of them.
10:23So it doesn't really matter what you're saying, but to her credibility, they are accurate.
10:29But I do want to say something that I found extremely troubling here.
10:32One, according to the police report you had, that the dog had bitten somebody back in 21.
10:39Your pit bull did bite somebody else.
10:41He didn't bite nobody, Your Honor.
10:42Yes.
10:42It's in the police reports, ma'am.
10:44Do you want me to read you the police report, or are you going to continue to tell me the
10:46dog never bit anybody?
10:47Your Honor, I know exactly what happened.
10:49He went to the lady's door, and he jumped up on her, and he didn't even bite her.
10:53He did like that.
10:53You don't think that's aggressive behavior?
10:55The whole point of all this is that your dog is an aggressive dog.
10:59And I'm going to read from the police report.
11:01Frazier advised her dog named King has gotten out from the backyard multiple times in the past and has been
11:09warned about it from animal control.
11:11Frazier advised that she had King since 2016, and he has not been aggressive in the past.
11:17That's not true, because on page 33, which is the next page, it says,
11:23Upon checking our databases, I discovered that King also had a previous bite on his record from November 5, 21.
11:32He was quarantined for 10 days at the Manteca Animal Services, and then was reclaimed on November 16, 2021.
11:39And, of course, you don't remember not having your dog for 10 days while he was quarantined for a bite.
11:44Oh, no, I remember that.
11:46Because I want to go on fire, though.
11:47It wasn't because of a bite.
11:48It was because he got out.
11:49It was not for a bite.
11:50But this is you here saying, my dog didn't do anything but just jump up and scratch somebody.
11:57No one said our dog didn't do anything.
11:57And I'm totally sorry for the dog bite, because if that had been me, I understand.
12:01But as far as him getting out in 2021, I'm sorry, Your Honor.
12:05There was no, like, what?
12:08Ma'am, you know what?
12:09If I have to believe you or an official police report where they looked into official documents, who do you
12:14think I'm going to believe?
12:15No police.
12:15Of course you wouldn't.
12:16Of course I am.

12:18And why wouldn't I?
12:19Because you two are in here defending a case that you have no defense for.
12:22So if you think you come in here credibly, I'm not understanding this.
12:25You're accusing this woman of doctoring up doctor's reports.
12:29And then you have the nerve to say to her, we'll pay a portion of your bill.
12:33Who says I'm going to pay a portion?
12:34Why, are you going to pick the bite on the left arm but not the one on the right arm?
12:38Who, who, girl, who could pay $16,000?
12:42Oh, well, she shouldn't have to pay $16,000 for something your dog did because of your negligence.

12:48I'm the sole provider and I have three children.
12:50What, he doesn't work?

12:52So he gets money for disability, doesn't he?
12:54So you're not the sole provider.
12:56You see how you like to play with the truth?

12:58And I bet you, even though you have a pit bull and two other dogs, that if somebody else's
13:02dog came up and jumped on you and scratched you, you would not be happy about that.
13:07No, I wouldn't, John.
13:07Okay, therefore.
13:08Also, my daughter had to hear the cops shoot our dog and my daughter is traumatized by that
13:13as well.
13:14Well, you should have taken better care of your dog.
13:16You should have taken better care of the place where your dog was being outside so that they
13:19wouldn't come through.
13:20You had three dogs roaming the street, not just one, three.
13:24I can't even imagine what it would feel like to have a dog, a pit bull attached to my arms,
13:28biting my arms like that.
13:30But the fact that you could be so defensive and not understand.
13:33Plus, you did say, I will pay you.
13:35One of the text messages that we have here, it's on page seven of ours.
13:40You say to her the next day, please send us any medical expenses for this.
13:45We will pay for it.
13:46Eight months later, you're apologizing for not sending her even a penny because you're...
13:51Your Honor, she didn't contact us back until August.
13:53I'm sorry, but didn't you know you had to pay?
13:55She said she was going to contact us as she was moving in the process of moving.
13:59I've never seen more excuses.
14:00I was also trying to work with the hospital to get the bills down.
14:04I got one question for you.

14:06You have a two-year statute of limitations.

15:23And I was trying to give them grace because I understood their situations and where they were coming from.
15:29But let me tell you one other thing.
15:30More than two bites in California, criminal charges.
15:33Criminal.
15:34So you could stand there and look at me like that all you want.
15:37But you should really be aware of what it is when you own pets, how you have to be responsible
15:41for them.

15:42Why don't you have renter's insurance?
15:44We do have renter's insurance.
15:46Now?
15:46No, we had it before.

15:49Did your renter's insurance include coverage for you owning a pit bull, a known dangerous breed?
15:54They did, actually.
15:55Because they asked us what comes up.
15:56No, they didn't.
15:57Because if you did, again, you can't lie.

16:03So you knew the extent of her injuries.

16:07Yeah, I went to her house.
16:08She wasn't there.
16:08Then she came and knocked on my door.
16:09You stayed in your neighbor's house for an hour with your arms.
16:12I want to see it again.
16:13If you don't want to see it, look away.

16:17That's what her arm looked like.
16:19You saw that on the day.
16:21We never saw her wounds, Your Honor.
16:23She was already bandaged.
16:24She was already.
16:24She came back now because we wanted to be stand up naked.
16:28She came to my house after.
16:29So here's what we're going to do.
16:30You hired a lawyer.
16:32I did.
16:32Where'd you get that lawyer from?
16:34I basically Googled.
16:35Yeah, mistake.
16:36Because the reason that we know that they didn't have insurance that covered this type of incident
16:42was because your lawyer obtained all the information that he could regarding coverage.
16:46That is correct.

16:48So State Farm is contacted and notified of this vicious attack by your lawyer.

16:55And they investigate, according to the letter from State Farm.
16:58Does anyone contact you regarding this?
17:00Somebody did call me like a couple weeks after the incident.
17:03I don't remember where it was from, though.
17:04And who was it?
17:05And then they said that they're going to get in contact with our landlord.
17:08And then next thing you know, our landlord called us.
17:09Yeah, that's because they didn't have insurance.
17:11Yes.
17:11Okay.
17:12And that's what I was told.
17:12Now, Mr. or Ms. Frazier, you said that your landlord knew that you had a pit bull when
17:17you moved in.
17:18Yes, he did.
17:19And you also said, Mr. Frazier, that the landlord did not fix your fence.
17:22No, so I tried to fix it myself.
17:23And the reason that you told your landlord to fix the fence was because your dogs had
17:27gotten out before.
17:28And you told the landlord that it was his responsibility to fix the fence because you guys are just
17:32renters.
17:33Correct.

17:34And he never fixed the fence.

17:36What year was it that you told your landlord that the fence was broken and that King had
17:42gotten out?
17:42What year was that?
17:43The year that we moved it because it was the first year.

17:46And so that fence was never fixed in 2018, 19, 20, 21, 22, and 23.

17:55I'm not saying that you, I'm saying your landlord.

17:58These are all things that the lawyer should have hired an investigator to interview.
18:02Because if he did that, you would have got their entire policy.

18:08But because you, you unfortunately got yourself a crappy lawyer.

18:12And the landlord, and they said that the landlord said that he did not know about the dogs.

18:19Didn't know about the fact that there was a broken fence.

18:22Yeah, that was pretty much it after that.
18:23You get an idea how pissed off I am when I hear stuff like that.

18:27No, nevertheless, we are deeply apologetic.
18:29It's not like we didn't care.
18:31Listen, I don't care if you're apologetic or not.
18:34The fact is, she wasn't even asking you for pain and suffering, which she was entitled to.
18:38She just wanted her medical bills paid.
18:39You have a known dangerous breed.
18:42You know that your dog has gotten out prior.

18:57We saw what happened through the window.

19:06But for the grace of God, there wasn't someone else, a child, in your area at this time where
19:12that pit bull of yours, King, would have ripped him apart.
19:15And you stayed in your neighbor's house with your arms dripping in blood, skin peeled back
19:21until you were put in the ambulance, right?
19:23That is correct.
19:24And to have been attacked because of negligence like that, it's disheartening.
19:30It wasn't just negligence.
19:31It was gross negligence.
19:33And I'm going to tell you something else.
19:34It was gross negligence on your lawyer's part.
19:37Bad lawyer.
19:38Yeah.
19:39Nothing further.
19:40I want to circle back to the question of rental insurance because you said you had rental
19:45insurance, so why not submit a claim?
19:48I think I know why, but tell me why.
19:50Honestly, I didn't even think about it, to be honest.
19:53I have never seen a homeowner's or rental policy that did not exclude, very specifically,
20:00two breeds.
20:01And the reason I know this is because one of them I really wanted once upon a time, which
20:04is a Rottweiler.
20:05They're beautiful dogs.
20:07They're smart dogs.
20:08You know what the other breed is?
20:09Pit bulls.
20:10Pit bulls.
20:10I've never seen a policy that said we are going to cover for pit bull injuries.
20:15Your Honor, I do remember when my husband did get the renter's insurance, he had to
20:19look, and that was the only one that would take a pit bull because a lot of them were
20:22saying no.
20:22It's very rare.
20:23So why didn't you submit a claim?
20:24I don't know.
20:25No.
20:26You just didn't think about submitting it through your renters?
20:28I just didn't think about it.
20:29But did your lawyer ever make any inquiry as to other insurance availability?
20:34They did.
20:35I don't believe they did, but they did inform me that they did not have renter's insurance
20:39and suing them would not be a good idea.
20:43That's what your lawyer said.
20:43That's what my lawyer told me.
20:44Yeah.
20:45I don't have anything else.
20:46I have a problem with your representation that you get homeowner's insurance.
20:50You know why you have homeowner's insurance.
20:53Insurance, yeah.
20:53You have a woman wanting to sue you or bring a claim, and you say, we didn't think about
20:59using our insurance.

21:05You can't afford to take care of your problem, then you shouldn't have a problem.

21:21I think there's a little more to it than that, and I'm wondering whether or not you didn't
21:25want to do that, because if you ever put in a claim before for the other person's bite,
21:30now it would be on record that your dog has bitten at least two other people, and that
21:35would be a reason for you not wanting anybody, other than who already knew, to find that
21:40your dog had bitten just one more person.
21:43That was the reason why you never even suggested it, and this has to be a reason.
21:47Why would two people who can't afford, based on what you said, who can't afford to make
21:50a payment, not want to go through their insurance to give this woman something?
21:53We paid her a total of $650.
21:55$600.
21:56And at the time it was hard, and then she messaged me because we had a correlation.
22:00You can't afford to take care of your problem, then you shouldn't have a problem.
22:03And the bottom line is, you're saying, oh, we made so many payments, you paid $600 to
22:09the $16,000 that she had to pay.
22:12And I know even when we're done with this, you're going to walk away and say, I don't
22:15understand it, we gave her $600, I mean, what do they want from us?
22:18We can't afford this.
22:20I don't have any other questions.
22:21We're going to retire to deliberate at this time.

22:33I honestly don't think there's a lot to talk about.
22:36The damages are obvious.
22:37The liability is clear.
22:39If she had one of these medical bills and then wanted the balance of her complaint to be for
22:44pain and suffering, this is one of the easiest $10,000 verdicts that I've ever seen.
22:49I mean, when I saw her and the blood dripping from her arm in the video, it was upsetting.
22:55And to think that they're going to come in and accuse her of falsifying documents, et cetera,
22:59she deserves every penny and I wish she could get more.
23:02Not all pit bulls are bad.
23:03They're not.
23:04And the reason that they get the rap that they do and the reason some communities are banning
23:08them is because of incidents just like this, when you've got morons who have pit bulls,
23:13don't train them properly, despite when they're getting out of their properties and roaming
23:18at large, prior bites and do nothing about it.
23:21And then everybody, every pit bull owner, despite how sweet they may be and how great they are,
23:27all get painted with that same broad brush.
23:29That's all I've seen.
23:30I would have given them the money of, what were the other dogs, chihuahuas?
23:33What were the little ones?
23:34I think they were terrier, Yorkies.
23:35Yorkies.
23:36Two Yorkies.
23:36I would have given her the money if the Yorkies bit her.
23:38I think that it was just, she was a dog bite and she was injured.
23:42That was horrific.

23:55We could not be more unanimous, ma'am, that you're entitled to every penny of the $10,000
