00:14Being a homicide detective in the city of New Orleans, a stressful day at work, could
00:20mean having seen things that 99% of the population has never seen and will never see.
00:329-1-1, what's going on from the M-A-C-H-I-C-H?
00:35There's a man shot by Chapitula, and, like, I think that's Andrew.
00:41Chapitula St. Andrew?
00:43Yeah.
00:44He's laying on the ground.
00:46Oh, my God.
00:48They're going to spill trombones.
00:50We have units on our way.
00:53Is this your car?
00:54Yeah.
00:54All right, we're going to cut this traffic off and send it down that way.
00:57Temple.
00:58I get EMS to the intersection of Chapitula in the area.
01:01We have one victim down.
01:04Person, gunshot.
01:06Couple to the body, one to the head.
01:09Hey, guys, just watch out y'all stepping, all right?
01:11They got casings everywhere.
01:13They got enough matter right here.
01:15We're going to fight homicide.
01:28The only information I have is a black male who was shot, about six casings on the scene, and an
01:37SUV
01:37apparently fled from the scene.
01:39A dark gray GFC Yukon just got information that the same SUV may have crashed somewhere in New Orleans East.
01:49This is the warehouse district.
01:51It's kind of mixed residential apartments and businesses.
01:55It's right outside of the Prince Quarter of New Orleans.
02:04As I'm walking into the crime scene, I notice immediately that there's just a large number of people in the
02:10area.
02:11It was the last night of Essence Festival.
02:13A three-day festival every year that we have around Fourth of July brings in a lot of visitors to
02:19the city.
02:21In this case, the first responding officers were working in detail, literally within probably 100 yards of where the homicide
02:27occurred.
02:30What do we have?
02:33We got one body?
02:34Yeah, one body.
02:35Okay.
02:38We had a deceased male on the scene.
02:42There's a lot of people there, but nobody wanted to come forward with what they possibly saw related to the
02:49actual homicide.
02:51So, I knew that I was going to be relying on video surveillance evidence in the area.
02:56Ugly Dog has cameras.
02:58See, they have a camera right there on the side.
03:01All of the casings are over there by that Nissan, by the Ugly Dog.
03:06So, I think he probably got shot over there and ran over this way.
03:09Yeah.
03:10Okay.
03:13It looks like the cameras were pointed in the direction where the murder took place.
03:18Unfortunately, the Ugly Dog is closed at this time, so I have to come back tomorrow.
03:23Any idea who the victim is yet?
03:26This is a guy named DeMond Foley.
03:28DeMond Foley?
03:29Okay.
03:33DeMond Foley is 36 years old.
03:35He's self-employed.
03:36He was out enjoying Essence Fest, but instead he was shot and killed.
03:44Blood starts here.
03:46Okay.
03:48Street drops.
03:50Download trajectory.
03:52Now you have to the right.
03:55Contact.
03:58More casing here.
04:01There were a number of shell casings.
04:03They all appear to be the same caliber.
04:07Those are definitely not a millimeter.
04:11Blood goes all the way over that, in that direction.
04:14Yeah.
04:15There's blood on the gun too.
04:18There was a handgun that was in very close proximity to the victim.
04:23At this point, I'm not sure if that belonged to the victim or the perpetrator.
04:30It's a FNC, FNX, 40.
04:36Was that magazine to capacity?
04:38Do we know?
04:392, 4, 7, 9, 8, 9, 12, 13, 1 in the chamber.
04:4513, 1 in the chamber?
04:46And they're 40?
04:47Yes.
04:49The magazine in that gun was at full capacity, and there is a live round in the chamber.
04:57The gun is a .40 caliber, but the spin cases that are on the crime scene, they're non-millimeter.
05:04It's likely at this point that I'm looking for another gun.
05:07The deputy that was blocked in the street right there, he said he heard a six shot.
05:13He waited a few minutes.
05:14There was nobody around, but he saw the door color and SUV the Yukon had come from this way.
05:21And they took the shot straight right there to Washington.
05:23Okay.
05:24Did he see the shots coming from the Yukon?
05:26No.
05:26No, he just heard the shots?
05:27He said there was nobody out here.
05:29Okay.
05:31The GMC Yukon Denali was seen fleeing the crime scene by sheriff's deputies.
05:36The tires were screeching.
05:38That's a little suspicious, so we want to know more about that vehicle.
05:43Rob?
05:43Yeah.
05:44I contacted the RTCC, and they gave me a video for the Denali.
05:50And the vehicle was in this area at the time of the homicide.
05:55Okay.
05:59So they have people over there.
06:00They want to know if the victim is somebody named Penny.
06:03Penny?
06:04Yeah, Penny.
06:05And I was asking them to describe Penny, and they showed me a picture of him.
06:09I said, what kind of car are you driving?
06:11They said, well, he's driving a Denali.
06:13Uh-huh.
06:15Detective Smith was approached by someone at the crime scene who is concerned with whether
06:22or not Penny is the deceased victim.
06:25I go over to speak to the gentleman.
06:29How are you doing, man?
06:30How are you doing, man?
06:30How are you doing?
06:30I'm Detective Long.
06:31Ah.
06:33Who's ?
06:33Me.
06:34You?
06:34Okay.
06:35What brought you out here?
06:36I was asleep.
06:37I just got a phone call, and they said that they saw him on Instagram.
06:40He was at the drug, and they said that they thought that this was him.
06:44Okay.
06:45What does he look like?
06:47Is that a recent picture?
06:48Yeah.
06:49How recent?
06:50Uh, about three weeks.
06:53The gentleman shows me a photograph of Penny.
06:57It's not the deceased individual that's on the ground, but I can't tell him that, because
07:03I still want to get as much information as I can.
07:06I then ask what Penny's real name is, um, and he tells me it's Alfred Pennington.
07:26He tells me someone named Alfred Pennington drives a dark color GMC Yukon.
07:33That matched the description of the vehicle scene fleeing the homicide scene.
07:39So, um, the RTCC gave me a plate on the vehicle.
07:42It is, um, a Texas plate.
07:45Oh, that's who it's registered to?
07:46Yeah, they call him.
07:47It's registered to the Pennington.
07:47They call him to Pennington.
07:49Alfred Pennington.
07:49They call him Penny.
07:50So, this is who the call registered to.
07:53Detective Smith confirmed with us that the registered owner of the GMC Yukon
07:57was, in fact, Alfred Pennington.
08:00So, he became a person of interest.
08:03I wanted to use...
08:05All right.
08:05Cool.
08:11We got information that dark colored SUV, a Yukon, fled the scene at a high rate of speed,
08:18heading towards the interstate, and in New Orleans East, right after this shooting,
08:25there is a dark colored SUV with the same plate on it, uh, that crashed.
08:30So, we're going to be heading out there right now.
08:42What did they get?
08:43I mean, it looks like the tire just blew out.
08:45But, I mean, they probably hit something at some point.
08:47Yeah, because the outside of it's all chewed up.
08:49Yeah.
08:50Was anybody here?
08:51Any witness or anything when y'all got here?
08:53It was an airport call.
08:54I pulled up on it.
08:55This is exactly what I saw.
09:00That license plate matched the license plate on the vehicle that was fleeing the scene.
09:05It belongs to Alfred Pennington.
09:08So, at this point, I do have enough probable cause for a search warrant for that vehicle.
09:13Let's have it towed.
09:14Okay.
09:15You get it put in the cage for me?
09:17Yeah.
09:17Okay.
09:18Thank you, Paul. I appreciate it, man.
09:19No problem.
09:20Bye, man.
09:20Bye.
09:30Hello.
09:31Good morning.
09:32Good morning.
09:34Good morning.
09:35Yeah.
09:38In processing the vehicle, my goal was to find any evidence that's related to the crime scene,
09:45like a gun, and any identifying evidence on who was inside the vehicle.
10:01If you could take the phone, for sure. And let's do DNA. Exterior and interior door handles DNA.
10:12What I need at this point is a gun that I can link to the shell casings found at the
10:17crime scene.
10:25No gun.
10:30So far, I've got really no evidence that Alfred was actually in here.
10:36I don't know.
10:39I don't know.
10:40At this point, I still need to determine who was in that vehicle.
10:43At the time, the homicide occurred, whether they were the driver or passenger.
10:48Thank you much. I appreciate it.
10:50I need to find the murder weapon, and I need to find video that captures the murder.
10:56Without any of that, I'm at a dead end.
11:08Our lab is on the fingers.
11:20That's a good one.
11:27I need to find the murder weapon, and I need to find a gun.
11:34Dog Saloon, which is a business that's located just outside of where the homicide occurred.
11:41They supposedly have video of the entire offense, so I'm anxious to see that video.
11:52I am born and raised in the city of New Orleans back in 1985.
11:57My grandfather was unfortunately murdered.
12:01It was an armed robbery, and since I was a child, I've grown up wanting to be a policeman,
12:09specifically homicide.
12:10I was motivated by his case, and I have had, as long as I can remember, a sense of wanting
12:17to just do my part in solving crime.
12:27Hey, what's going on, man?
12:28Doing well.
12:29How are you?
12:29Good, good.
12:30Nice meeting you.
12:31Yeah.
12:31The video from the camera that's right there.
12:34Have you seen it yet?
12:35Uh-huh.
12:36OK.
12:37So I'm looking for a gray Yukon Denali that fled, supposedly.
12:45Oh, God.
12:45This is a good video.
12:48That's the Denali, huh?
12:50Yeah.
12:51That's the Yukon.
12:52Yeah.
12:55They're in between the two cars.
13:07Wow.
13:09The video recording from Ugly Dog, it is from a little bit of a distance in terms of being
13:14being able to identify the shooter, but I can hear the gunshot and the victim is seen running
13:22away and the shooter is seen chasing after the victim, continuing to shoot as the victim
13:28eventually collapsed across the street.
13:29I don't know at this point that the shooter is Alfred Pennington for sure, but I do see the
13:38shooter get into the driver's side of the dark gray GMC Yukon and flee.
13:44Having this video is great.
13:45For the first time, I'm able to see exactly what occurred.
13:48What I need at this point is to be able to identify who that shooter is and who it was
13:53that was operating that GMC Yukon.
13:56That's the one angle.
13:57OK.
13:58And then I have the other one from behind looking down Annunciation.
14:03Sweet.
14:06So there's the SUV right there.
14:09That's the shooter.
14:10Come across the street and then get in his SUV.
14:14OK.
14:18Here's the victim coming, huh?
14:19Yeah, right.
14:20Walking right there.
14:23It goes around the front.
14:26That is a great video.
14:34Yep.
14:38And then they're in between the two cars.
14:50Looks like he had a distinct logo or emblem or something on his shirt, front and back.
14:57You see his shirt?
14:59You're right, he did hear something.
15:00Yeah.
15:02So what I'm thinking, I'm going to go back here and try to pull a video of him walking and
15:06see if I can get him his face.
15:09But yeah, that's great.
15:15The video is pretty cut and dry.
15:17It definitely put everything into perspective.
15:21There's still many unanswered questions at this point.
15:24What occurred in front of the Yukon?
15:26Was there a physical altercation?
15:28Was there a threat?
15:30We collected a gun at the crime scene.
15:33Did the deceased victim pull the handgun out and point it at him?
15:37All I know about the gun is that it was stolen about a year ago.
15:40That doesn't really tell us much.
15:43The shooter.
15:43He's got a pretty distinct shirt.
15:45It's got some kind of logo on the front and back of it.
15:48So I have a reference point on what to look for.
15:52Hopefully we get a good image of his face.
16:10Hey, what is 911 with Hey, if we should, I was using it.
16:13There is a man that just got shot and he is on the ground.
16:17He's on the street on the side of his car.
16:21Louise, he's starting to look like he can't die.
16:25Oh, my God.
16:27Oh, my God.
16:29Yes, I need an alarm.
16:31They're on the street.
16:33Four minutes got shot.
16:34They need somebody here right now.
16:36Somebody en route?
16:38Yes, sir.
16:39OK, OK, thank you, baby.
16:52He shot them all up and down.
16:54OK.
16:56You were driving?
16:58Yes.
17:05Vino?
17:09Yeah.
17:10He's still in the corner.
17:11Still in the corner where?
17:12Right there.
17:13Like a car house.
17:17You're doing good, man.
17:19Y'all got the other guy?
17:20Get the battery under there.
17:20Yeah.
17:21Working at 30 for us, possible 30.
17:53I get a call from 5th District.
17:57They're saying that they're working a shooting.
17:59The two victims have been transported to the hospital.
18:02One of them was shot in the hip, but he's expected to survive his injuries.
18:06The other was shot in the chest area, and he passed away due to his injuries.
18:13His name is Stanley Williams.
18:16But to friends and family, he's known as Doody.
18:19He was in his 40s.
18:20He's from New Orleans.
18:22He grew up in this area.
18:31Once I walk through the tape, I'm able to see that there's our crime scene units.
18:36They're starting to cone certain things in the street.
18:40Some casings that are on the sidewalk.
18:43I noticed that most of the scene seems to be around a Jeep that's parked in the middle of the
18:47block.
18:47It clearly has some kind of bullet damage to it on the driver's side.
18:52And its windows are shattered out on the passenger side.
18:56There was a witness who was on scene.
18:59Detective Walt Vedman is going to talk to the witness and see what we can find out about who did
19:04this.
19:06So what do we have on scene?
19:09We got the, this is like the surviving victim's clothes.
19:12We got six .40 caliber shell casings all over here.
19:16Oh, Walt said, the witness says the shooter is a guy named Dino.
19:21And he came over here and started arguing about some video the victim took of him
19:26on the victim's phone or something like that.
19:29And then Dino started shooting him.
19:33Our witness was able to tell us that my decedent, Stanley, was sitting on the passenger side in the Jeep.
19:40There was some kind of argument happening between Stanley and the shooter standing on the passenger side of the car
19:47about some kind of video.
19:49The witness started hearing gunshots.
19:52He saw Stanley was shot and the driver was also shot.
19:57And he said, Dino did it.
20:01He didn't know Dino's real name.
20:04But he knew Dino lives in the area.
20:08So this is Dino's address?
20:09Supposedly this.
20:12And that came from Walt?
20:14This came from Walt who got it from the witness.
20:17So I'm raising S.O.D.
20:19OK.
20:19To get the house surrounded.
20:20And if we can get a warrant for the house.
20:22OK.
20:22Boom.
20:25Dino supposedly lives right around the corner.
20:27A couple houses down from where we're all standing.
20:31Now that we know where Dino lives, we need to get a search warrant.
20:34And now we're calling the SWAT team.
20:50Hey, Lou, it's Donny Williard over at Homicide.
20:53How you doing?
20:55Hey.
20:55So we got a 30 over here.
20:58We're still like wrapping up the actual original crime scene.
21:02Typing up a warrant very quickly on this house.
21:05And seeing if S.O.D. can assist with executing the warrant.
21:10I'm working just some intel real quick.
21:12Seeing if we can just figure out who the perp is.
21:15We might be hitting an empty house, though.
21:17It's possible.
21:19Type in your risk assessment, your search warrant.
21:22And when you get that, send it to me.
21:24All right.
21:24Sounds good.
21:26Once the witness told us where Dino lived at, I began researching the address,
21:32trying to see if I could find out, checking our databases, who lives there.
21:37All right.
21:37Well, this is interesting.
21:38We got a Devin Green, 36 years old.
21:46All right.
21:47So I pulled up the address.
21:49And I got a hit for a Devin Green, who is 36 years old, light-skinned black male.
21:56He's 5'7", which is exactly the description we got from the witness.
22:01But at the very least, even if we hit the house and it comes up blank, we can show a
22:05lineup.
22:06Yeah.
22:16No, no.
22:19No!
22:25No project over there.
22:28No, no.
22:35It's good.
22:42So a positive ID on our perp.
22:48Hey, Lou.
22:51Just got a positive ID from
22:53It is going to be Devin Green.
22:57It's minutes before the briefing.
22:59I just got the call that my witness actually picked out Devin Green in the lineup,
23:04confirming that Dino is Devin Green.
23:09This is my suspect.
23:12I get a search warrant for Devin's house.
23:16All right, what's going on, guys? Good evening.
23:18Thank you all for coming. I know y'all were activated at kind of last minute.
23:22So earlier today, around 2 p.m., two victims were shot, one fatal, one non-fatal.
23:28We were able to identify the perpetrator as Devin Green.
23:31We actually knew where the perp lived.
23:34We don't know if he's inside.
23:36Appreciate y'all being here and if there's anything else.
23:40We want to get into this house as soon as possible
23:42because the last thing that we want is for my possible suspect
23:47to go back to the house and start cleaning things up,
23:50getting rid of evidence, getting rid of any guns.
23:53The more time that goes on, the more evidence that we are at risk of losing.
24:02All right, I guess we'll follow the train out of here.
24:12All right.
24:14The clock is ticking.
24:16Is Devin Green going to be inside or not?
24:18It's just the moments where I start to get, like, nervous, like,
24:22you know, catch him off guard or is he already in hiding?
24:26Find out pretty soon.
24:30All right, fellas, let's go.
24:32Take your time.
24:38Three, one, two, four.
24:46Police, there's one.
24:48Open the door all the way.
24:50All the way.
24:54Who we got?
24:55Who we got coming in?
25:06Someone else just came out.
25:09I don't think that's the target, huh?
25:11I don't think so.
25:12No, they just let him walk like that.
25:14No.
25:20So right now, he might be inside
25:22because they're still calling his name.
25:26Yeah.
25:26Which they would do if...
25:27It's been mocked.
25:29Just take this half section so no one drives up on us.
25:32Oh, .
25:33Shot.
25:34Back up.
25:36Take cover.
25:37Cover!
25:37Cover!
25:38Cover!
25:51We have Devin Green's house surrounded
25:54and somebody just started shooting from inside.
25:57I don't know if any of our guys are hit.
26:00We're calling for as many units as possible
26:02to respond to the area,
26:03get a perimeter around the location.
26:06Right now, it's a standoff.
26:09This is a tense moment,
26:10waiting to see what's going to happen next.
26:14But our SWAT guys are going to do everything they can
26:16to make sure that we come to a peaceful resolution.
26:29Good morning, everyone.
26:31This is an update involving an officer-involved shooting
26:34that occurred on October the 5th,
26:36around 7 o'clock at night.
26:39This incident took place during the service
26:41of a high-risk warrant related to a homicide
26:45that had occurred earlier in the day.
26:48That homicide suspect was a 36-year-old man
26:52by the name of Devin Green.
26:54Mr. Green fired at the officer from inside the residence.
27:01This resulted in our officer's returning fire.
27:05After a nine-hour standoff,
27:09Mr. Green finally surrendered
27:12and was taken into custody.
27:14In the exchange of fire,
27:17no one was struck,
27:19and therefore there were no injuries.
27:31The smoke is practically still settling.
27:34It's surreal.
27:36I can't believe the number of rounds
27:39that were being fired,
27:40that nobody got hurt.
27:42I'm grateful.
27:44Nobody wants to see anybody get hurt.
27:46We want the criminal justice system
27:48to hold people accountable.
27:49I can finally breathe some relief
27:52now that Devin is in custody
27:54and our guys are okay.
27:57We did the search warrant inside the house,
28:00and there was two guns,
28:03a rifle,
28:04and a pistol.
28:05The pistol matches the caliber of casings
28:09that we had on the scene of the homicide.
28:13Now, I want to see
28:14if I can get a statement from Devin.
28:17I still need to be able to prove
28:18that Devin's the one who killed Stanley Williams.
28:24Yeah, so he's at the hospital,
28:28so we'll see what he says.
28:59He's in the graves,
28:59so he's at the hospital.
29:00How's your case going?
29:01What's up, bro?
29:02Yeah, it's good.
29:03So I'm getting ready to look at some video from a restaurant,
29:06which is right across the street from Ugly Dog.
29:09I have a good idea of who the perpetrator is.
29:12A gentleman named Alfred Pennington.
29:15So hopefully this catches him.
29:17I mean, I've got a good reference point with the shirt.
29:19He had like an emblem.
29:20Wow, why can I never get video like that?
29:25Look how clear it is.
29:28Now, I don't know who's panning this, but...
29:30It's got to be motion.
29:31Yeah.
29:31It picks up on alt motion that's going.
29:34I have video from the Ugly Dog that shows him walking this way
29:37from here across the street.
29:40And you can tell he's got some distinct logo on his shirt.
29:44So there were sheriff's deputies working or something?
29:46Yeah, right across the street from where the shooting happened.
29:49The shooting happened right here.
29:51Wow.
29:52That's breezy.
29:53Yeah.
29:56Hopefully that is turned that way when it happens.
30:02There he is.
30:03Is that the suspect?
30:06That is him.
30:09You see the logo?
30:12Oh, my God.
30:14That's Alfred.
30:15How do you know him?
30:17I have a picture of him.
30:19Perfect.
30:20All right.
30:21Now he's on scene.
30:23Damn.
30:25I'm able to pretty much identify this shooter from the Ugly Dog Saloon video
30:30as Alfred Pennington,
30:32using those identifying features from the T-shirt as a reference.
30:38It's clearly the same logo.
30:41Now watch.
30:41You're going to see victim right behind him.
30:43Look.
30:44Here's the victim.
30:47Oh, bro.
30:48He's skipping.
30:52No, I pan.
30:56Look, there's a victim.
30:58Yeah, I see him.
31:00It's at 1.23.
31:02What time did it happen?
31:03It happened at 1.24.
31:07Camera ain't going to catch it.
31:10No.
31:11But what this does, it gives me his face.
31:14Yeah.
31:17It is a very aha moment for me.
31:20This places Alfred Pennington at the crime scene at the time the offense took place.
31:26So at this point, I do have enough probable cause for an arrest warrant,
31:29and I'm confident that a judge will sign it.
31:32But I still have a lot of unanswered questions.
31:35What occurred in front of that GMC Yukon?
31:37And why did Alfred Pennington allegedly shoot DeMond?
31:43Hopefully, I am able to find Alfred Pennington
31:46and get answers to all these questions that we have.
32:17I just talked to Dino, a.k.a. Devin Green.
32:21After Devin surrendered, he started saying,
32:25I had an old groin injury, and it's aggravated right now,
32:29so I want to get checked out of the hospital.
32:31And so it was there that I interviewed him.
32:34So, Devin ends up telling me that Devin owed Stanley money,
32:40and Stanley had told Devin he was going to get back at him for this money owed.
32:45And Stanley was sharing a video that depicted Devin in a light
32:51that Devin didn't want other people to see him in.
32:55And so Devin felt his manhood had been disrespected,
32:58and Devin said, that's why he did it.
33:02He even went as far to say that the second person who was in the driver's seat
33:07was nothing more than collateral damage.
33:12So right now we're pulling back up in the area where the homicide happened.
33:19I still want to get as much evidence as possible.
33:23I'm going to walk up the block and just see if there's any other cameras,
33:27ring doorbells, or anything that might give us an actual look at what happened.
33:53I secured an arrest warrant for Alfred Pennington for the murder of Devin Foley.
33:59I received a phone call from Alfred Pennington's attorney
34:02who expressed that Alfred wanted him to turn himself in.
34:05He was aware that he did have an arrest warrant out for him,
34:08and he came in with two attorneys.
34:12Now, I have a lot of questions.
34:15The obvious question of what occurred in front of that GMC Yukon
34:20that he needed to possibly shoot Devin Foley.
34:24Okay, you do have a warrant for your arrest.
34:27The warrant is for a second of your murder.
34:30It's an incident that happened July 8th in the evening.
34:34Why don't you tell me what happened?
34:37I came down on Friday
34:41to go to the festival.
34:44I don't live here.
34:46I live in Houston.
34:48I just was out trying to have a good time.
34:52So I went in the club,
34:55and I walked in.
34:57Somebody pulled my shirt.
34:58I turned around,
34:59and I saw who it was.
35:01And it's just God that I
35:04don't know what I'm even associated with.
35:07It's just like,
35:08what's up?
35:09And I'm like,
35:10I'm chilling, man.
35:11I live in Texas now.
35:13You know, I'm not into
35:14none of that footage just no more.
35:16And as I walked off,
35:18he pushed me and said,
35:21you're a bitch.
35:22You're gonna die tonight.
35:23And I immediately tried to exit.
35:27In Alfred's statement,
35:28he tells us that
35:30he felt threatened by Damond,
35:32and Damond told him
35:33that he was gonna die tonight
35:34and decided to leave the club,
35:37which is consistent with
35:39what we see so far in the video,
35:41that Alfred leaves,
35:43and then Damond follows behind him
35:46towards his vehicle.
35:50When I sat down in my car,
35:53as I took a breath,
35:58and he was grabbing at my door.
36:01Like, grabbing at my door.
36:03Yeah, let me in this bitch.
36:06Let me in this bitch.
36:07Yeah, he started clicking around.
36:10And he just was like,
36:12yeah, told him you gonna die tonight, bitch.
36:15I'm about to kill you.
36:17I'm about to take this bitch.
36:20And I got out
36:22when he was ramming up,
36:23when he was ramming on the door,
36:25like, instinctively,
36:26because I'm instinctively
36:27about to start shooting in the door.
36:29I don't know what he's about to do.
36:30I don't know.
36:31I'm just scared.
36:33I'm just scared.
36:39And he just came and got up on me.
36:44And he was reaching for the guy.
36:47I just held him off for a second.
36:49But I didn't even get to grab him.
36:52It just was so quick,
36:53and I just shot him.
37:03I just started shooting.
37:05And when I started shooting,
37:07he was running.
37:08But he was like,
37:10I was just scared, man.
37:12I was just scared.
37:14In his statement,
37:16Alfred Pennington admitted
37:17that he did shoot DeMond fully.
37:19He said DeMond pulled a gun
37:22and Alfred felt threatened.
37:25Eventually, DeMond started running away
37:27and he continued to fire his handgun at him.
37:31I was just scared
37:32and I just got back in my car.
37:36And I just dug down
37:37and just put the gas on like,
37:40I got a few blocks out
37:43and I just drove.
37:46Like, I just drove.
37:47Like, that's what happened.
37:54He's obviously emotional, right?
37:56I don't want him to answer
38:00a lot of questions
38:02with him and his case.
38:03But I want,
38:04we know the Warren's army out there
38:05and we want you to know the truth
38:07because obviously
38:07the investigation keeps going.
38:10I want you to get his side of the story.
38:12That's the best of the way that we've been.
38:15You know he's on arrest, man, right?
38:17Of course.
38:18I was hoping to clear this up.
38:20I have questions for you
38:21and I can't ask them
38:22because your attorney doesn't want me
38:23to ask them for you.
38:24So the only way for me to clear it up
38:25is to ask my question.
38:27That's it.
38:27There's a lot of holes
38:28that I need to build
38:29for my investigation.
38:31So without that,
38:33you will go to jail.
38:34Okay.
38:35I have one question for you.
38:37Sure.
38:40Do you turn the gun into you?
38:42It's evidence.
38:43I don't have to go, though.
38:45Okay.
38:47I don't have a problem.
38:49I'll be right back.
38:53The fact that I'm able to make an arrest
38:56for Alfred Pennington
38:57related to the homicide of DeMond Foley
38:59is great.
39:02DeMond, his family,
39:03are victims as well
39:05because they're the ones
39:06that are left suffering
39:07from the loss
39:09of their loved one.
39:11So it gives me satisfaction
39:13that I'm giving closure
39:14to DeMond Foley's family.
39:44DeMond Foley
39:51I want to call
39:52the mom
39:53of the decedent,
39:55Stanley,
39:56now that the chaos
39:57has kind of settled down.
40:01Hello.

40:05Yes, it is.

40:30with him.
