02:44It's rich in Hispanic and Vietnamese culture.
02:48They have their own businesses.
02:49It's on the edges of New Orleans, really.
02:52Everything past this area is like swampland.
02:55It's a very tight-knit community where they all seem to know each other and try to help each other out.
03:00When I arrive on the crime scene, there are certain things I'm looking for right away.
03:08Shell casings, blood on the scene, video surveillance cameras.
03:14In this particular case, there's businesses that have video surveillance cameras pointing
03:20towards the parking lot where all this happened.
03:22So this video, these cameras is what caught it, I'm assuming?

03:35So, from what I'm told from witnesses, they speak Spanish.

05:14My victim, his name is David Cano, and he's 46 years old.
05:19He's a citizen from Honduras, and he's here just trying to make money for his family to send it back
05:25home to help support the people he loves.
05:28So, I picked up four shell cases from in between those two vehicles right here.
05:35So, it looked like they were possibly standing over there.
05:38The deceitant was standing over here.
05:40Got a pilot loading that we picked up, and that's it, no casing.

13:22But the other guy is still shooting at him.

13:44the teenagers were loitering in the area
13:47and kind of making everyone feel uncomfortable.
13:49He could see the firearm in their waistband.
13:51And they thought that there was a possibility
13:54that the teenagers were trying to rob them.
13:56David Cano shot around into the air
13:58to scare the teenagers away.
14:00And the teenagers started to run away.
14:03And then David Cano fired another round.
14:06Then the teenagers who were running away
14:08started to return fire.
14:10So why do you believe the guy shot in the air?
14:14He's always the threat.
14:16We have had experiences like this before,
14:18like four more times that we have brought.

15:54And you see the victim, David, gets out of the driver's seat,
16:00and then a few minutes later, you can hear that first shot.
16:09And then you see the two guys running away, basically,
16:15being scared off.
16:16And then you see the decedent follow them.
16:22And it looks like the decedent shoots in their direction
16:24and actually hits this car window.

16:30And then the guy in the red shoots back.

16:44He kind of grabs himself.
16:46And then he walks over to the white truck.
16:49And later, falls down next to the white truck.
16:54The two teenagers who are being shot at run this way.

17:45Well, you have a unique case because in Louisiana, it's a stay-in-your-ground state.
17:51So, when you're being fired upon, you can shoot back in self-defense.

17:57In Louisiana, we have a stay-in-your-ground law, which is basically you don't have a duty to retreat in a lethal force situation.
18:06I'm going to investigate this incident the same regardless if it's a self-defense case or if it's a homicide.

20:30I get the video surveillance from the camera on the street that my witness said the teenagers
20:37ran back to after the homicide occurred.
20:43I see the two teenagers still wearing the same clothing right after the shooting and see them
20:49running away and turn the corner towards Peltier Drive.

20:55Now we know the direction where they went after the homicide.

25:54Basically, this camera turns, like, every 10, 15 seconds, and it tracks motion as well.

26:12Looking at the footage, we know it's them based on their clothing.
26:16From the store and from witness statements, they're wearing the exact same clothing.
26:23Okay, so they go into this driveway, see them get off the bike, put it right in this driveway by this fourplex.

26:33So now they're walking on foot, and the shooting and the stores and all that are over there to the left.
26:38So one of them probably lives in that fourplex.
26:41So I think the approach today is to go find that location, knock on all four doors and see what we can find.
26:49Hopefully get lucky and it's our suspects.
26:51So this article came out, a woman asked for help after two shootings in three days in her neighborhood.

27:32It says she's working to raise money for Cano's family to send his body back to his mother in Honduras for a proper burial.

38:42I ultimately get an arrest warrant for the 15-year-old.
38:46I charge him with obstruction of justice and juvenile possession of a handgun.
38:51I know he had a firearm.
38:53And after he shot David, he left the crime scene with the pistol that he used to shoot him,
38:58which is obstruction of justice for removing evidence from a crime scene.
39:02The juvenile suspect is found outside of our parish.
39:09I attempt to speak with him, with his family member present.
39:16But he and his mother refused to give me a statement.
39:23He was then booked and eventually brought into juvenile custody.
39:30Ultimately, even though this appears to be a case of self-defense, it was the juvenile in possession of an illegal firearm.
39:46So, he's arrested in connection with David's death.

40:22Christina, the person who organized the vigil for David Cano, she acts as a community
40:40liaison for the Hispanic community out in this area of town.
40:45I talked to his mother, I think she's being very strong because he's the only son she
40:51had here in the US.
40:53So the only hope that she had for any support or anything that she had back there was him.
40:58I think for a lot of her prayers, the miracle happened that we were able to raise so quickly
41:02the money to be able to send him back home.
41:06David was a friend of mine.
41:09He was a very good guy.
41:12He was very, very humble.
41:14He doesn't have family here.
41:15He doesn't have a wife.
41:16He was a baker.
41:17Like, he worked in the Dong Phong Baker for over 10 years.
41:21At the Vietnamese store, he'll be the one taking out their trash from him.
41:25He really loved the people that sold food out there.
41:27Like, that was his spot.
41:28You know, and it was just like, pretty much, I really think he just felt like he was the
41:32protector.
41:33There's a lot of community members right now that feel unsafe.

41:38And they're getting guns that are not registering, things like that.
41:42What I explained to them is that that gun will not always be what saves your lives.

41:48Because even if you shoot one of them, they could come back and retaliate.
