00:25Poisonous mushrooms have killed three people
00:27and a man is in hospital fighting for life.
00:30As a result of suspected mushroom poisoning.
00:33The death gap mushroom poisoning is the Chernobyl of poisons.
00:36Erin Patterson from Liangatha decides to invite over for lunch her in-laws
00:40and she invites her estranged husband Simon.
00:43He decides to pull out.
00:44Pete Wellington is served.
00:46So devastated about what's happened.
00:48I love them.
00:49And three died.
00:50Do you know anything about a deal of drugging in your house?
00:53Why would she want to kill them?
00:55Could this all be a terrible accident?
00:57Erin Patterson has been arrested in a dramatic early morning raid on her Liangatha home.
01:02She's been charged with multiple counts of murder and attempted murder.
01:06But most significantly, four counts of attempted murder
01:09for trying to kill her husband Simon Patterson over a number of years.
01:27Since May 2022, we know Erin and Simon go on a camping trip together.
01:38They are separated.
01:39They've been separated for many years.
01:41But they were friends, they were texting, they were calling.
01:45They were going on holidays together quite frequently with and without the children.
01:52Simon recalls on one camping trip that he was eating a chicken curry.
01:57He remembered that Erin Patterson was cooking the meal,
01:59something he wasn't really keeping too close of an eye on.
02:03They went to bed in the tent that night and it was hours later he said he remembered waking
02:08up and becoming violently ill and then he ended up in hospital for 20-odd days and 16
02:14of those were in a coma.
02:17He had three different bowel resection surgeries.
02:20There was results that just didn't make sense.
02:23The hospital was running around trying to figure out why he was in such excruciating pain.
02:28This man was dying.
02:30His family had been told to come in and say goodbye to him,
02:33that this may be the final time that they ever get to see him.
02:38Simon believed that this camping trip formed part of a whole string of sinister attempts
02:44to take his life.
02:47But it was never ever put before the jury.
02:49In this world, there is God bless.

04:31At the moment it's very quiet.
04:34It's almost like that feeling that people are just sitting and waiting now.
04:39You know, the time has come for those to have their day in court.
04:43There will be a bit of interest around the region about what is the evidence, what is there
04:52that's potentially damning or what is it that's possibly missing.
04:56There must be more to the story than what we have heard.
05:04Once there's an outcome of the case, you know, that'll be when a lot of people will be able
05:07to process their grief and to decide to move on.
05:10There's a lot of people in our community that will need closure.
05:17So I've got the court sketch from Erin Patterson's first appearance in Moorway.
05:22Um, immediately after she was charged.
05:36So this was November 3rd, 2023 and, um, it's signed by the sketch artist and, um, this was a gift that I got from my partner because we're both, um, working the news and, you know, this is the kind of, kind of stuff that we're going to do.
06:06We gift each other, which makes me think like, like, feel like a bit like of a crazy lady.
06:10And then you've got the photo of Erin's first interview, the only interview she's ever given to the media or comments she's ever given outside of her house.
06:21I took that one.
06:22I got nominated for a quote for this one.
06:24That's why it's printed.
06:26And then I've got this one as well, which is a, um, it's a scientific drawing of the Death Cab mushroom.
06:32That too was a birthday gift from a friend.
06:35So there you go.
06:36I've got like a little collection of, um, mementos from the mushroom, mushroom case.
06:50Interestingly, in this case, the trial was held at Morwell.
06:53From the 50s, 60s, right to the end of the 80s, Morwell was a boom town.
07:03Morwell might only be 50 kilometres from Langatha, but in terms of culture, it's nothing like.
07:11There's definitely a good community here.
07:13I mean, sometimes we get a bit of a bad rap.
07:15Morwell's a cold town.
07:18It's a place that is in the process of reinventing itself.
07:22There's a lot of youth crime in the area and there's just no resources for anyone.
07:27I will be honest, a lot of the time it's like a ghost town.
07:30Um, so just seeing so many people around is a nice change.
07:34The defence chose to do it in Morwell in the belief that the local people were less likely to convict.
07:41Yeah, I think folk are really interested in the case.
07:43They've all got an opinion on what's going on.
07:45It's actually bigger than I expected.
07:48Um, more reporters, I think, than I expected.
07:52Day one of the highly anticipated mushroom murder trial gets underway here in Morwell.
07:59Day one of the highly anticipated...
08:01Erin Patterson has pleaded not guilty to all charges...
08:05...and has always maintained her innocence.
08:07I'll go again.
08:09Something we've been waiting for for nearly two years, it's finally starting.
08:13It felt like we were driving up and unpacking the circus tent
08:19and erecting it around the front of the courthouse.
08:25We've got these really smart, big, noted legal minds
08:31that have come in to this small little country town of Morwell
08:34that are trying to convince your average Joes of why they should pick one side.
08:40There was a line every day to get in.
08:43There was an atmosphere outside of anticipation.
08:46It's this incredibly important murder trail
08:49that's made international news everywhere.
08:51And you're in this, like, tiny, suburban-looking court.
08:54Oh, yeah.
08:54Thanks, ma'am.
08:56Port four in the Morwell law courts.
08:58You walk in the door.
08:59The jury box is basically directly in front of you.
09:02Then we've got two big banks of public seating.
09:06On the right-hand side of the bar table,
09:08we have the Crown Prosecution Team being led by Dr. Nanette Rogers,
09:12who is one of the sharpest legal minds in the field.
09:15She's supported by Jane Warren
09:17and two other members of the prosecution team as well,
09:20including Sarah Lenthal.
09:22On the left-hand side, leading the defence team
09:24is highly respected criminal barrister Colin Mandy Essie.
09:30Seated to his left was his junior barrister, Sophie Stafford.
09:34Across the table, supporting them,
09:36the two solicitors are Bill Duke,
09:37who's a very senior legal figure within Melbourne,
09:41and Ophelia Holloway.
09:43But perhaps the most incredible thing about the whole thing
09:46is that Erin is right behind you.
09:48That never happens.
09:50You're never that close to an accused.
09:51So close, I could almost feel her breath on the back of my neck.
09:55Every time you want to look at her,
09:57you've got to turn around and look at this woman.
10:04We're about to start the trial.
10:06Mouthguards are in, and then a bombshell.
10:09Serious charges have been dropped
10:11against accused mushroom lunch killer Erin Patterson.
10:14Charges of attempting to murder her estranged husband
10:16will not proceed.
10:18I don't know how everybody in the room
10:20didn't gasp in that moment.
10:22It may have been that it was a difficult thing
10:25for the prosecution to kind of justify it.
10:27You know, there was less evidence
10:29than compared to the lunch charges.
10:31So let's drop it.
10:32Allegations without any forensic backup
10:35would, in the judge's view,
10:37pollute the stream of justice.
10:40It was very hard to stay composed in that moment
10:42because you could imagine Simon Patterson
10:45hearing about the fact that his testimony
10:47will now sound very, very, very different.
11:01Simon Patterson arrived at court
11:04ready to face his estranged wife for the first time
11:07since she was accused of poisoning his entire family.
11:12So on the 1st of May, on the third day of the trial,
11:15we get the first major prosecution witness,
11:18Simon Patterson, Erin's estranged husband.
11:21A lot of what Simon talks about
11:24when he's in the witness box
11:25is his relationship with Erin,
11:27how they met, how they came to be a couple,
11:29how their relationship slowly fell apart.
11:33For most of Simon and Erin's relationship
11:35up until their separation,
11:37it sounded like Donna and Gail
11:39had a pretty good relationship with Erin.
11:42Donna and Erin had pretty similar interests.
11:44They were both really curious, busy minds.
11:46And so they would bond over, you know,
11:48things like science, world affairs,
11:50and they would talk about a lot of those topics
11:52of conversation all the time.
11:53So they had a pretty special bond.
11:57Erin inherited a large amount of money from her family.
12:02She loaned money to her extended family.
12:06She was more than generous to Simon.
12:08The way Simon stepped through
12:10how Erin had loaned, you know, all his siblings money,
12:13I found it really perhaps revealing
12:15in the fact that Erin didn't have much else
12:17or many other people in her life.
12:20You know, that's how important
12:21the Patterson family were to her.
12:25Simon's main role in this trial
12:27is to talk about this turning point
12:29in his relationship with Erin,
12:30that from the prosecution's perspective
12:32is where things started to go south.
12:35And that's the moment that gives Erin
12:37a semblance of a motive
12:38to have murdered Simon's family.
12:42There's this situation where Erin feels like
12:44she hasn't been invited to Gail's 70th birthday party.
12:47So she's having a conversation with Simon around that.
12:50She feels particularly upset about the fact
12:58that she's been left off the guest list.
13:01She, I believe, feels that she's been abandoned
13:05by this family that she's embraced.
13:07I want to ask you about 2022.
13:24There was a change in the relationship, was there?
13:26Yes.
13:28She said that she discovered that my tax return
13:31for the previous financial year
13:33had for the first time noted that we were separated.
13:36It was my understanding it was going to have implications
13:39on family tax benefit.
13:41She was upset about it.
13:43You know, he lists himself as separated in his tax return,
13:46which means that now she needs to apply
13:47for child support payments.
13:49It's only like $40 or so a month
13:52that Simon needs to pay Erin for child support.
13:54Erin's getting annoyed, basically saying, like,
13:56this is the bare minimum.
13:57This is not all you need to pay.
13:59This is just the baseline.
14:02She's sending messages to both Don, Gail, and Simon,
14:05basically saying, I need Don and Gail
14:07to decide on what it is that was to happen financially.
14:10What couldn't be said during the trial
14:13is that typically these sort of assessments are made
14:16based on, you know, taxable income,
14:19and in the kind of year leading up to that,
14:21Simon had been, you know, incredibly unwell
14:23because he says Erin poisoned him.
14:26And I'm cross-examined on my finances,
14:28and I'm made out to be a villain
14:30when I want to scream out to the jury,
14:34this crazy woman tried to kill me three times,
14:37but I can't do that.
14:40I can't do that.
15:10The pre-trial hearings are designed
15:15to test the strength of the evidence
15:18that'll eventually go to trial.
15:20It's very tip and iceberg, really,
15:22you know, when you sort of think
15:23about big criminal trials like this,
15:24you've got, you know, the trial's the tip,
15:26and there is this huge iceberg of evidence
15:29the jury's not going to hear below it.
15:32It's almost like an off-Broadway rehearsal.
15:34You start with a full break of 52 cards
15:37and you might go into the trial with 26 cards.
15:43And it was here in pre-trial
15:45that we learnt for the first time
15:47that it's Simon Patterson's version of events
15:49that he had eaten meals
15:51that his estranged wife had been cooking for him.
15:54He would become incredibly unwell
15:57after eating food that she'd prepared
15:59for him and for nobody else,
16:02that it was when they were away together
16:04and that there was no other explanation
16:07for that particular, you know, severe illness.
16:10He hadn't really confided in anybody.
16:12He'd told really only his doctor, Christopher Ford.
16:16The doctor's advice was to start keeping a diary,
16:20to start trying to put together the pieces himself.
16:23What are the kind of consistent things here?
16:24What was I doing in the lead-up
16:25to all these instances of being sick?
16:28And he then kind of pins it on Aaron.
16:31He had us on the edge of our seats
16:32as he was talking about the different meals that he ate
16:35and then the horrendous symptoms
16:36that he says he suffered afterwards.
16:39The first was in November 2021.
16:42He recalled that Aaron Patterson
16:43and had given him some penne bolognese to take home,
16:46which he ate the next day.
16:48In May 2022, while camping with Aaron,
16:51he ate a chicken curry prepared by her
16:53and ended up in hospital.
16:55This was a really quite significant event
16:57in Simon Patterson's life.
17:00Simon wrote in a Facebook post
17:01that his condition was so serious,
17:03his family were asked to come
17:05and say goodbye to him twice.
17:08In July 2022, he became unwell again
17:11after eating a beef stew cooked by Aaron.
17:14And finally, in September 2022,
17:17while on another camping trip with his estranged wife,
17:20he once again became ill
17:21after eating a chicken and vegetable wrap
17:23Aaron had pre-prepared.
17:25He was asked what he remembered.
17:26Did they share the same dish?
17:28No.
17:28He would say Aaron Patterson
17:29would eat something different than me
17:31or she would prepare it
17:32and I wasn't watching.
17:34When he was recounting this in pre-trial,
17:37he was really, really distressed
17:39about what she may have done to him.
17:42Simon nearly died from something,
17:45you know, and he wasn't struck by lightning.
17:47The defence then were arguing,
17:49this is a suspicion, this is a fear,
17:51but where's the medical evidence?
17:53Where is the evidence that shows the cause
17:56of this particular illness?
17:58And then at the 11th hour,
17:59we know the charges against Simon Patterson
18:01were thrown out.
18:02That was a massive moment
18:05because what falls away with those charges
18:08is also a lot of the evidence.
18:10Document after document,
18:12internet after internet search,
18:13book after book,
18:14potentially about poisonings that had been accessed,
18:17the Crown says, by Aaron Patterson,
18:18was disappearing.
18:20Exactly what is in or out often
18:22and happened in this case
18:24wasn't decided on
18:26until what felt like hours
18:28before the trial was about to begin.
18:31In Aaron Patterson's case,
18:32what happened in pre-trial
18:33was very, very different to the case
18:35that proceeded to a jury.
18:36The day before the lunch,
18:52Simon sent a text to Aaron
18:53saying that he wasn't going to be coming
18:55because he felt uncomfortable
18:56attending the lunch.
18:58And what we get in response
19:00is a pretty telling text from Aaron.
19:06And she's bloody annoyed
19:10that Simon won't turn up
19:11and says, you know,
19:12I've slaved over this all week.
19:15So the jury's sitting in there,
19:16listening to Simon,
19:18laying all this stuff out,
19:21but then they're not hearing
19:22half the story
19:23that we've been able to hear
19:24in the pre-trial.
19:25There's almost this information vacuum
19:27because they all knew
19:28those charges existed,
19:29but he's not talking about it.
19:31No one's asking him about it
19:33and they're just not going to hear about it.
19:35There was so much tension
20:01in the room today.
20:02Yeah.
20:02I mean, you could cut it with a knife.
20:05One thing that really surprised me today,
20:07we heard how many family members
20:09are expected to come
20:10and attend the hearing.
20:11I've never before really seen
20:12an area of a court
20:14sectioned off just for family.
20:15Yeah.
20:16But I think it'll be,
20:17it'll be really interesting
20:18to see them coming in
20:19to see engaging with it
20:20because I was actually
20:21quite surprised as well
20:22because I thought
20:23they'll tune in remotely
20:24being given a link.
20:26Why would you come?
20:27And keep themselves.
20:27They might not have been
20:28in the same room as Aaron
20:29since before she was charged, right?
20:31So there might be an element
20:33of wanting to see her
20:34and look at her.
20:35You're in public space,
20:36essentially,
20:37and that must be incredibly hard
20:39to hear some of the things
20:40they're going to have to hear
20:41and know that everyone
20:44can see them in there.
20:45It's probably the thing
20:47that stays with me
20:48more than anything else
20:49when covering court stories.
20:51Seeing the family
20:52of the deceased
20:54look at an accused killer,
20:57it's incredibly powerful.
20:59You can watch
21:00this person's entire body,
21:03their face, their posture.
21:05You can almost watch
21:06their blood pressure rise
21:08as they turn and look
21:09at the person
21:10who is accused of, you know,
21:11killing a loved one.
21:13I think it says a lot
21:14about how a person is grieving,
21:18how a person is processing
21:19the worst thing
21:20that could possibly happen to them.
21:22It's going to be a long six weeks.

21:33There was the two faces
21:35of Erin Patterson
21:36that were really portrayed
21:37to the jury.
21:38One of this God-loving woman
21:41who took her children to church
21:43and invited her loved ones
21:44over for meals,
21:45but online,
21:46the prosecution really painted
21:47a different version
21:49of Erin Patterson.
21:51Has anyone seen
21:52the news in Victoria
21:53about four people
21:54killed by eating mushrooms?
21:57It's a homicide case.
21:59I think it's Erin Patterson
22:01from our group.
22:03Oh my God,
22:04all we talked about
22:05was murder.
22:06Oh my God.
22:08The group name
22:08was Keep Kelly Lane
22:09Behind Bars.
22:10Kelly Lane was a woman
22:12who was convicted
22:12of killing her baby,
22:14a baby that was never found.
22:15There was a big debate going on
22:18whether Kelly had faced
22:20a travesty of justice
22:22or whether she was actually guilty.
22:25Erin was on the guilty side
22:26and so was I
22:27and that's how I met her.
22:30I remember meeting Erin
22:31because she was really,
22:32really smart.
22:33She really got into detail
22:35about the case.
22:37She was really good
22:38at finding information.
22:39I guess that's what
22:41we really bonded over
22:42in the beginning.
22:44Erin and I connected
22:45a bit over
22:46what I was going through
22:48in my life
22:49with my breakup
22:50and also,
22:51you know,
22:52just what was happening
22:53with my ex-husband
22:54and she kind of related
22:56to some of that
22:57with Simon.
22:59Well, see,
22:59those people,
23:00they were her
23:01intimate acquaintances.
23:03The group was her
23:04whole world.
23:05Erin was extremely invested.
23:07I don't feel like
23:08the friendship was fake.
23:10I feel like,
23:10I feel like she did,
23:12she did actually
23:14become friends with us
23:15and I feel
23:16she called us family
23:18and I feel like
23:21when the group
23:23started to fall apart
23:25and we started
23:26to pull away,
23:27that's when she started
23:29to become aggressive.
23:31Erin had fake profiles
23:33that she was using
23:34to attack us
23:35and then she would
23:36come in under
23:37her real profile
23:38and stick up for us
23:39and have goes
23:40at the fake profile
23:41and it was almost like
23:43it was a way
23:43to kind of build
23:44a stronger relationship
23:45with people
23:46and align with people.
23:48At the end,
23:48when I had a conflict
23:50with Erin,
23:51she was very confrontational.
23:54She came across
23:55as a sledgehammer
23:56and so it made me wonder
24:01is she an introvert
24:03or was she
24:04just fitting in?
24:09I think my close relationship
24:10with Erin ended
24:11around March 2020.
24:13There were three women
24:14who were part of that group
24:15that gave evidence
24:16to the jury
24:17and they all gave
24:18varying accounts
24:20of what the interactions
24:21were like
24:21with her.
24:22During the time
24:23that you knew
24:24Erin Patterson,
24:25did she ever discuss
24:26or post information
24:27about her relationship
24:28with her husband,
24:29Simon?
24:30Yes, she did.
24:31She had some concerns
24:33about him paying his share
24:34and that it was
24:34very controlling.
24:36She used the word
24:37coercive at times.
24:39They were the people
24:41that she trusted,
24:42they were the people
24:42that she spoke to
24:44outside of the Pattersons
24:46and the Wilkinsons
24:47that were her support network
24:49in the real world.
24:52Her online profile,
24:54it showed an ugly side to her
24:56and also venting
24:58about her own in-laws.
25:00The messages
25:12were being displayed
25:13on these giant
25:15television screens
25:16on different sides
25:17of the courtroom.
25:23Erin Patterson's
25:24darkest secrets
25:25were really in that moment
25:26being absorbed
25:28by everybody.
25:30You know,
25:36for the first time
25:37we see that she is
25:38really annoyed
25:39and basically
25:40they're dead to me.
25:42I think understandably
25:43a person's communication
25:44style between
25:46their Baptist church
25:48in-laws
25:48and their online
25:50true crime friends
25:51is going to be
25:52a little bit different.
25:54The way she was speaking
25:55with her online friends
25:56was vulgar.
25:58It was rude,
25:59it was angry,
26:00it was disrespectful.
26:00But it's another
26:02layer
26:03in the deck
26:04of a person
26:07who
26:08can get very angry
26:10and hold a grudge.
26:11a world-renowned
26:29fungi expert
26:30called to give evidence
26:31in his own backyard.
26:33Tom May.
26:34He is, I'm going to say,
26:37Australia's premier
26:40mycologist.
26:40Can you tell the jury,

26:44So, iNaturalist
26:47is a publicly accessible
26:48website.
26:49It's where members of the public
26:51can make observations
26:53about nature.
26:54Do you have a profile
26:55on that site?
26:56iNaturalist.
26:57I do have a profile
26:58on iNaturalist
26:59and the profile name
27:01is Funky Tom.
27:10So, I think the first time
27:13that iNaturalist
27:13came to mind
27:14was when Tom May
27:15was giving evidence
27:16and he was being quizzed
27:17about iNaturalist.
27:18iNaturalist is a site
27:21where anybody can post
27:22photographs
27:23of living things.
27:26You've got the date,
27:28a GPS location
27:29and you've got an image
27:32that can then be sorted out
27:34with AI.
27:36The downside to it
27:37is the quality of the data
27:39is extremely variable.
27:41Posts that have been made
27:42by Tom May
27:43you can 100% trust
27:45but lots of other posts
27:48on May 21st, 2023
27:51Dr. Tom May
27:52identifies deathcap mushrooms
27:54in the Autrum area
27:55and takes a picture
27:56and posts about it
27:57on the iNaturalist website.
27:59There's a separate post
28:00that was made
28:00by Christine McKenzie
28:01in the Lark area
28:02on the 18th of April
28:03that also identifies
28:05deathcap mushrooms.
28:07A post that had identified
28:09mushrooms in Autrum
28:12just in the outskirts
28:13of Carambara
28:14and so it was through that
28:15that I was like
28:15maybe that is the next
28:17obvious step
28:18is to have a look at
28:19where that location is
28:22and what that looks like.
28:29Police have found evidence
28:30in Erin Patterson's devices
28:32that she had previously accessed
28:33the iNaturalist website
28:34and don't searches
28:35for deathcap mushrooms.
28:40So basically you've got
28:42the listing that's
28:43within her local area
28:44and it wouldn't have taken long
28:45for her to drive out here
28:46and this is the exact spot
28:49where Tom May
28:51found deathcap mushrooms
28:53in May 2023
28:54and these mushrooms
28:56could potentially be
28:58you know
28:59the murder weapon
28:59in the case.
29:00and now the prosecution
29:04needs to find out
29:05whether Erin's phone
29:06was in those same areas
29:07at the same time
29:08as those posts
29:09were made in 2023
29:10and in order to do that
29:13they call
29:13the premier expert
29:15in cell phone tower data
29:16Dr Matthew Sorrell.
29:19Now normally I'm given
29:21a week's worth of records
29:22or a month's worth of records
29:23or a day or an hour.
29:25In this case
29:26I had four and a half years
29:28of Erin's phone call records.
29:32In the end I was asked
29:33to examine three things.
29:35On the 28th of April 2023
29:36whether Erin's phone
29:38visited Locke.
29:39On the 22nd of May
29:41whether Erin's phone
29:43visited both Locke
29:45and Outram.
29:46The data that I see
29:47it's like the matrix
29:48it's numbers, numbers, numbers, numbers
29:50and you dive in
29:52and when you see something
29:54in that pattern
29:55it's really satisfying.
29:58I'm going to show you
29:59a tool shortly

31:24has a direct clear line of sight

31:27just north
31:28of the mushroom field

55:55some wouldn't her story was she bought these mushrooms from one an Asian grocer and two a local
