00:14How did you first hear about it?
00:17I got woke up.
00:20My nephew pounded on the door to the house.
00:23My nephew's crying. He never cries.
00:26He just puts the phone in my face.
00:30It's my mom on the phone.
00:33And she goes, your dad's dead.
00:43We just heard somebody beating on the windows,
00:46and it was my boss's brother, bloody.
00:49He needs help.
00:53This guy didn't go very far.
00:55He dropped right there as soon as he got out of the car.
00:59If you follow from here, there's a perfect trail of bloody shoe prints right to where he collapsed.
01:05They're willing to shoot these two men in cold blood, kill them in a parking lot, and move on.
01:10You'd have to surmise that he would kill anyone else easily.
01:13He has said he's been itching to shoot somebody.
01:17It's not very often that you run across cases like this, where it's a random act of violence.
01:25The girlfriend's testimony was critical.
01:28What's his name?
01:29Because she was an eyewitness.
01:31The girlfriend.
01:32We didn't know if we could find her.
01:34We also didn't have a murder.
01:36And then I open up the box.
01:38We're missing the murder weapon.
01:41Gotta be kidding me.
01:42For those most affected by a homicide, the first 48 is just the beginning.
01:49The whole world is different now because he's gone.
01:51This is the story of the fight for justice in the weeks, months, and years after the first 48.
01:59The first 48.
02:139 on the line.
02:14Do you need a police power or medical?
02:15I've got a caller on the line.
02:16It says she was inside cleaning the building, and somebody came and assaulted her boss outside.
02:25The assailant's left in a vehicle.
02:29We just heard somebody beating on the window.
02:32Then it was my boss's brother bloody.
02:35Do you see which direction they took off in?
02:38No.
02:39It's a small SUV though.
02:41I've never seen they face.
02:43Okay, we're gonna get off through there as quick as we can.
02:46They passed out.
02:47He needs help.
02:52Patrol finds a man lying on the sidewalk.
02:55And another next to an open car door.
02:58Both shot dead.
03:07We got two guys that are dead out there.
03:11So, looks like it's gonna be one of those up for 30 hour deals.
03:16I've worked more homicides than anybody in the history of the department.
03:2420 years now.
03:25I've always said that murders are kind of like putting puzzles together.
03:29This is where I should be.
03:30All right.
03:31What do we got here?
03:32Keith is this guy.
03:33I guess he's a cleaner.
03:35The first victim is 61 year old Keith Williams.
03:47Keith was the owner of a nighttime cleaning service.
03:50He leaves behind his wife of 34 years, Mary, and was a loving father to her three children.
03:59This guy didn't go very far.
04:01He dropped right there as soon as he got out of the car.
04:06If you follow from here, there's a perfect trail of bloody shoe prints right to where he collapses.
04:12Okay.
04:13The second victim, over 50 yards from Keith's car, doesn't have ID.
04:20We got one, two, three, four, five, six.
04:25The team finds nine nine millimeter casings.
04:28We got show casings here.
04:29We got show casings over there.
04:32So we're in the shooting's car.
04:35You're trying to look at the evidence there, the show casings and where these gentlemen were laying,
04:39trying to come up with the theory.
04:41If it was premeditated or if this was just a heat of moment type incident, it was a bit challenging.
04:46We don't find that much at the scene to tell us what happened.
04:49So yeah, you're thinking, man, this is going to be a difficult one to solve.
04:53Witnesses show a cop. They're heading back to the division to talk to us.
04:59Well, I need to get downtown.
05:02We always want to get our witnesses, especially it's an eyewitness, to the interview room as quickly as possible to really start advancing this investigation.
05:13Then.
05:15What's that number real quick?
05:168-4-0.
05:18Someone's trying to get a hold of these victims.
05:20At that hour, that's probably someone close to them that knows them.
05:24Hey, this is Detective Calhoun, Tulsa Police.
05:27You were just calling a gentleman's phone just now?
05:31It could have been someone who would confirm the identity of, you know, these men.
05:35So there's no time to waste.
05:37Who is that gentleman to you?
05:39Calhoun speaks with Keith's wife, Mary.
05:44Who's the gentleman that he's with?
05:46His brother.
05:47OK, his brother.
05:48What's his brother's name?
05:52Yeah, so we got a call out here that there was a shooting.
05:56I wanted to meet with her in person, but unfortunately, he couldn't meet right then.
06:01And so I did not want them to continue the lingering worry about, you know, what was going on.
06:06We have two men out here that were found deceased.
06:10No!
06:11No!
06:12No!
06:13No!
06:15Cecily!
06:18Cecily!
06:20There's been a strike.
06:22Then I'll put it on the speaker.
06:24OK, here we are.
06:26Glenn's wife, Cecily, joins the call.
06:30Ms. Williams, I'm trying to figure out who these men are.
06:32OK, tell me what the tattoos are.
06:44OK.
06:46Well, listen, Ms. Williams, I hate to tell you this, but there is a gentleman out here that's deceased that has a tattoo on his right arm.
06:52No!
06:55Why would they shoot him?
06:56Why would they shoot him?

06:58That's what I want to know.
07:00We don't know.
07:01I just want you to know that, you know, we're going to do our best.
07:04Any time you tell someone that their loved one's gone, you're going to experience a wide range of emotions.
07:08It's difficult to hear, but it's also a reminder for us that this is an individual that's now deceased that is loved by someone.
07:17So, the guy here on the sidewalk is going to be Glenn Williams.
07:2753-year-old Glenn Williams, Keith's younger brother, had recently moved to Oklahoma to help Keith with his cleaning business.
07:35He leaves behind his wife, Cecily, and six children.
07:43I'm going to head back down to the office.
07:46OK.
07:48So, we have the two brothers who are hard-working men, working late hours, gunned down.
07:55It was frustrating because we didn't have much to go on.
08:05Three hours into the investigation...
08:08You doing all right?
08:10...Kennedy sits down with the woman who called 911.
08:13Jamil, I'm sorry we're meeting in any circumstances.
08:18Who do you work for?
08:20Keith Williams' janitorial.
08:24When you talk to a witness that's been through such a traumatic incident, you have to settle them down.
08:30Let them breathe a little bit.
08:32The other gentleman that's out there with him, who is that?
08:36His brother.
08:38What time did you get to work?
08:41At 10.30.
08:43That was when I texted him and said, at Midtown, there's some people outside parked.
08:47She had seen a suspicious vehicle.
08:50She actually drove past it.
08:52Her and her mother, who was helping her clean the dialysis center,
08:55they were a little bit freaked out when they see a stranger in a car on the outside of a building.
08:59So it made sense that she called Glen and Keith.
09:04And then he called and said he was just gonna come and check on us.
09:10Okay, can you describe the car?
09:13It was an SUV.
09:14Um, I want to say it was like an Equinox.
09:20So, I assume you start cleaning.
09:23Yes.
09:26What called your attention? Did you hear gunshots?
09:28I think I heard him knocking at the window or something.
09:32So I went and looked out the window.
09:34Seeing his brother walking towards the window, he was just moaning like, ugh.
09:41Okay.
09:43I didn't even know they were shot. I thought they were just beat up bad.
09:46Did you know of him having problems with anybody?
09:53No.
09:55All right, well, we'll see what we can find out about maybe figuring out who they are.
10:01Bear with me.
10:05We're gonna do our best.
10:06I was hoping we would get more information out of that interview.
10:14I was a little bit disappointed.
10:16Oh, my God.
10:19This sucks.
10:26Four hours in.
10:28There wasn't a lot of information that Miss Jamila had provided.
10:31So I reached back out to the family in hopes of them providing some information, some ideas, maybe some names.
10:40Hello?
10:41Hey, Miss Williams.
10:43I know it's a shock right now, but is there anything else that you can think of?
10:46Any problems, any disputes with any individuals that may be mad at these guys?
10:49Well, I'm just confused that they were having with their employees, which was Jamila herself.
10:54They lost their cover of her job because her and her son didn't show up to do anything.
10:59Jamila's getting ready to get fired, and her son had just been fired.
11:04And, you know, that was news to me, because Jamila sure didn't bring that up in her interview.
11:09Okay, bye.
11:11It piqued our interest.
11:14We wanted to do another interview with Jamila.
11:19This is how Dad did it. He said, nothing gets wasted.
11:31You know, things like this remind me of him.
11:37Still miss him every day.
11:38My mom and my dad got together when I was a young teenager.
11:47And he's the guy that raised me.
11:51It was always service.
11:53He was the type of man that gave, instead of taking or wanting or even asking.
11:57First time the cookout together as a family, we went to go help him prep his food.
12:04And he's like, no, no, no, I cook.
12:06Y'all sit down, relax.
12:07This is my job.
12:09So this is family for me.
12:10My dad and my Uncle Glenn were actually the closest out of all his siblings.
12:16Uncle was looking for a change, so he came down here.
12:19And my dad gave him a job helping him clean the sites and stuff.
12:23He talked about work, his volunteering, and his family.
12:28You help out those three things, your life's good.
12:4717 hours since brothers Glenn and Keith were killed.
12:51What's our motive here?
12:53As the team prepares for Jamila's second interview.
12:55The wives of Glenn and Keith, they had this theory that Jamila might be involved and her son could be involved.
13:04We get a lot of theories, and we have to take those seriously, follow up on some of those theories.
13:10That's how sometimes we solve cases.
13:12But we try not to get tunnel vision and just focus on one motive.
13:16Well, at this point, I think we've got to be looking at robbery.
13:19It's robbery.
13:20So why are you killed?
13:22We got robbery.
13:24We have that these guys have done something in their personal life that this is a hit.
13:28Because they're pissed off getting ready to fire you?
13:32Option number three, if it's not a hit and it's not a robbery, then it's a total complete stranger do.
13:38Which I don't really know.
13:39That's scary.
13:41It's very scary, but I don't know if that's what this is.
13:43The worst case scenario is this perpetrator still out there, willing to shoot, attack, or kill anyone that gets in their way.
13:53The next day.
13:55Appreciate you coming down.

14:00When Jamila came back, I was wondering why she went and retained an attorney.
14:06The first time we spoke with her, she was very cooperative.
14:09I'm just going to be blunt with you.
14:11The family members have come up and they've mentioned you as a problem.
14:16A problem.
14:19They said they were getting ready to release you.
14:24That's shocking to me because the few times I've talked to his wife, it was like we had a great connection.
14:31The goal was to see how she responded. We want to know the truth.
14:34We want to know the truth.
14:35Did you have anything to do with setting this thing up?
14:40I didn't expect nothing like that.
14:44No.
14:49Oh, no.
14:52It doesn't make any sense that somebody would want to hurt this man.
14:57All right.
15:00Jamila allowed us to go through her cell phone.
15:02And we didn't find anything.
15:05So I had no reason not to believe anything that Jamila was telling me.
15:10We are done with the phone.
15:12She was very sincere that she was not involved in this.
15:16And we were able to exclude her as being involved at that particular moment.
15:21We'll get you out of here.
15:23As the first 48 ticks away.
15:26The puzzle wasn't coming together very well.
15:29You know, we keep swinging.
15:38The following couple weeks or so, we were following up on leads.
15:43We were looking into any type of angle to try to identify somebody who may be involved.
15:51We were just needing a break.
15:53Well, that's amazing.
15:55All right, man. Appreciate it.
15:58There was a shooting at a restaurant called Incredible Pizza and two people were shot.
16:03They survived.
16:05The pizza restaurant shooting happened six days after the double homicide of Keith and Glenn.
16:09They were able to ID the suspect.
16:12That suspect got picked up on a different crime and had a gun on him.
16:17The test came back on the gun and it was the same gun that was used in the double homicide.
16:23There was a match.
16:25There was a knife and hit from cartridge casings tied to the actual firearm that was used in our homicide.
16:29We were ecstatic.
16:31Me and Chase both were like, wow, this is what we need.
16:34We went from nothing to a solid suspect.
16:38Andriel Smith.
16:40Born and raised in Tulsa, 35-year-old Andriel Smith has prior felony convictions for burglary and assault and battery.
16:49He was pulled over and arrested out of a SUV.
16:52He looks fine everything, sir.
16:56Six days after the pizza shooting, Tulsa PD pulled over Andriel, driving an SUV that matched a vehicle on a tip sheet for unrelated crimes.
17:06Officer Twilliker doing great police work, just following up a lead that was put out at their squad table.
17:13He had a revolver and he had a semi-automatic handgun.
17:17Our lab, they get a lot of guns turned in all the time.
17:19And all of them get tested, you know, because you never know when a gun's going to connect to a crime to be solved.
17:26If he did the two brothers, then that's quite a body count.
17:30It's not a slam dunk, but it gives us a place to start.
17:35And he's already sitting down in Tulsa County Jail.
17:38Then, Detective John Brown is also familiar with the suspect, Andriel Smith.
17:44Andriel is a suspect in the shooting case I had back in April.
17:47My victim knows Andriel Smith from time they did together.
17:53A victim got out to go over to the suspect's car.
17:56Right.
17:57And he started getting shot.
17:59My guy survived and he IDs Andriel.
18:03Warrant was out and he just hadn't been picked up yet.
18:07And he's a suspect on Incredible Pizza?
18:09Yeah.
18:11And then the shield casings from Incredible Pizza match up to my crime scene.
18:16The gun checked the three different shootings.
18:19And in one of those shootings, Andriel Smith was named as a suspect in it.
18:23So we're like, hey, we're onto something here.
18:26So we have two victims from the homicide.
18:28We have one from the Incredible Pizza.
18:29We have one from John Brown's case that he was said to have been responsible for shooting just in the Tulsa area within a very short timeframe.
18:38He just likes to shoot people as they're approaching his car for no reason whatsoever.
18:42That's his MO.
18:44We're thinking this could possibly be our guy.
18:47We need to check into him a little bit closer.
18:50We need to put bookends on that gun when this gun was purchased up to the time to where he was caught with it.
18:56We need to make sure that nobody else has had that gun.
18:59You're going to need some kind of connection to put him at the scene or something, right?
19:15Yeah.
19:17More than just that knife it hit.
19:20Yes.
19:21We have the murder weapon.
19:23We have the person who had the murder weapon.
19:25We have a person who has used that weapon at a couple of other shooting scenes where he's been listed as a suspect.
19:32But I don't have enough yet to arrest him for the murder.
19:35But we found out that he was booked in along with his girlfriend.
19:40Love you, baby.
19:42And she had bonded out.
19:45Kennedy looks up the woman's booking photo.
19:49It looks like she's had the holy beat out of her.
19:52The girlfriend had bruising on her face and some other indicators that she had been physically assaulted.
19:58You guys, I'll sit there.
19:59Sure, go ahead.
20:00Okay, because I have a...
20:02You got messed up leg, don't you?
20:03Yeah.
20:05Man, something's... something's bad going on here.
20:09And so we needed to get some information out of her.
20:12Back at the crime scene.
20:22This is horrible.
20:24Horrific.
20:25Lynn Williams' family holds a vigil.
20:28We moved here so he can get a job with his brother and to earn a good income.
20:34And he was murdered in cold blood.
20:37Daddy, I love you.
20:42His children are hurting.
20:45It's too much, you know.
20:48My dad was too good of a person.
20:51It just hurts to know that this innocent man was shot.
20:56And I had to come to the reality that he's not coming back.
20:59One day after Andreo's girlfriend was released...
21:13We found out that his girlfriend lived in a small town south of Tulsa.
21:18Oh, we got a nice house here.
21:20She agrees to meet.
21:24This was a very important interview.
21:26And we needed to address this with caution.
21:30We don't want to push her too hard.
21:31We don't want to scare her.
21:33They may be willing to talk to us about it.
21:35The other flip side is that they do not want to talk about it because they're scared.
21:40Detective Kennedy, Detective Calhoun.
21:43We're with Tulsa Police, okay?
21:46Andreo.
21:48Tell me how long you've been knowing him.
21:50Two dollars.
21:52Six years.
21:53I noticed whenever you got booked in, I noticed you looked like you had two black eyes.
21:58Yeah.
22:00Had he been beating on you?
22:02Yes.
22:04We were kind of taken back.
22:06She still had some of the black eyes that were viewable.
22:10Right.
22:12I was assigned a case back on September 5th.
22:15It was a double murder of two brothers.
22:18Were you there that night?
22:20Yes.
22:23I was laying in the back seat.
22:26We're there.
22:27We were there.
22:29There was almost a sigh of relief.
22:30So now we're getting somewhere.
22:32I was kind of brogging and still sleeping.
22:35When I heard him get out the car.
22:37And he was talking and he's like, we don't need no help.
22:40We're all right.
22:42And he's like, back up.
22:43Need to back up.
22:45And then the dude was like, I can be here if I want to be.
22:49We're here to check.
22:51And then I heard the gunshot.
22:53He shot the first guy.
22:56And then I heard the other guy trying to run off.
22:59And then I heard five gunshots.
23:03Andrea.
23:04He knocked back in the car.
23:08OK.
23:09You had to be saying, what the hell?
23:11Yeah.
23:13But he just told me to lay down and not to worry about it.
23:16Like, nothing never happened.
23:20Is there a reason why you didn't call the police after that?
23:23Because he told me he'd kill me and my family.
23:26OK.
23:27And I believe him.
23:29She lived in fear, you know, and she was scared of this guy.
23:33And she believed there's a possibility he could kill her.
23:37We're just very fortunate, lucky that we were able to talk to her on this day and time when Andrea was in custody.
23:42And proved that he was serious about taking my life.
23:45He was shot on my leg.
23:47He would do weird stuff all the time, like, make me sleep in the bathtub just in case he felt like shooting me.
23:54So his best would be easier to clean up.
23:57This is someone that had been abused, not just physically, but also mentally.
24:01It's just pure, it's evil. It's sick.
24:04We were just blown away at some of the stuff she told us, that some of the abuse that she went through.
24:11Did you not say, hey man, like, what the heck was that about?
24:13And why did you shoot those guys?
24:16He had said he'd been itching to shoot somebody.
24:20He'd been itching to shoot somebody, like his trigger finger is itching.
24:24I really think he just shot those people because he wanted to.
24:28The double homicide, the pizza shooting, with John Brown's case, and then with this young lady being shot in the leg.
24:35This is an individual who apparently has a desire to shoot people and kill people.
24:42It's very disturbing. We need to prevent any future attacks.
24:45I really think he's gone up there.
25:00She says his behavior toward her has changed over their years together.
25:04All over jealousy and paranoia.
25:08I appreciate your cooperation. I appreciate you being honest. You take care.
25:15At that point we had enough to charge Andreo.
25:1920 days since the double homicide.
25:22Andreo was still in the Tulsa County Jail.
25:24So we get Andreo into the interview room.
25:28We were hoping that he would confess, especially when you have the evidence to back it up.
25:34Why did you do these things?
25:36We don't know what's going on in his head.
25:38And the only person that can explain that is Andreo himself.
25:41We were homicides.
25:43Two gentlemen were murdered around the Best Buy.
25:47Have you heard about the murder of those two guys?
25:49I don't know.
25:51All right.
25:53On the 17th, you got arrested.
25:55Mm-hmm.
25:56And when you were arrested, that gun that you got arrested with, the 9mm, was that your gun?
26:02I don't know.
26:05Whose gun is it?
26:07It was her gun. It's not her name.
26:13But we were able to find a time when she had pawned it and got it out of the pond.
26:17Which was in pretty close proximity to where all these crimes occurred.
26:21And then, of course, he has it afterwards.
26:24They had had that gun the whole time.
26:26Well, we had the testing done on that gun.
26:29And that gun was used to kill those two gentlemen on September the 5th.
26:36I don't know about that.
26:38I haven't killed anybody.
26:40Okay.
26:41It's still been then where she has not killed anybody.
26:44So, did you give the gun to somebody?
26:48It's always been in your possession?
26:50Nope.
26:52Whose possession has it been in?
26:54I think I'm done talking now, because I think he's trying to trap me.
27:00He's pretty much locked himself in.
27:03We got him dead to rights with the murder weapon.
27:06It kind of defaults back to him.
27:08He knew that he was caught.
27:09Okay, well, I'm going to let you know that you're being arrested on two counts of first-degree murder.
27:15Okay.
27:21Most people would be devastated.
27:22Most people would know, hey, I've been caught.
27:25He didn't have that demeanor.
27:26He just said, okay.
27:27He was not defensive.
27:29He didn't seem to be shocked or anything.
27:32That kind of just showed us how hardened he was.
27:35And he didn't have a care in the world.
27:38Okay.
27:39All right, I'm going to go this way.
27:41This is my good angle.
27:42I don't know.
27:43You have a good angle?
27:44Every angle.
27:51Three years into the court proceedings.
27:53It's not very often that you run across cases like this, where it's a random act of violence.
28:01You want to make sure that you're doing justice by the victims.
28:04But then you're really focused on, here's a guy who is presenting a risk to my community.
28:11We better make sure we get this right.
28:14The district attorney's office, they were always in contact.
28:17Every couple of months, even while waiting for trial.
28:19It made things a lot more tolerable, knowing that they were trying on their end.
28:25We had a lot of evidence to work with.
28:29We knew we had a strong case.
28:31We had cases where he was alleged to have committed other shootings around the time of these homicides.
28:37You had people identifying the make and model of Carr in the same general area of Tulsa.
28:46And then you had the ballistics testing that matches the firearm that was used in the homicides.
28:51If we want to present cases to a jury, we have to present a motion to the district court judge to determine, is this legally appropriate?
29:04The prosecution files a notice of intent to introduce evidence from the other alleged shootings during trial of the double homicide.
29:11We received a ruling in which the judge was not going to allow what we felt was relevant evidence.
29:18The court denies the motion, holding that evidence from the other alleged shootings are unnecessary and risk causing unfair prejudice.
29:26And the criminal court of appeals unanimously affirmed the court's decision to deny our motion.
29:36That constrained our ability to tell what we felt was a much broader view of Mr. Smith.
29:42Our wings were clipped in how we could present our case to the jury.
29:47We need to make decisions based on changes in the case.
29:49Five years after Glenn and Keith's murder, a new trial date is finally set.
29:57Our first setback, obviously, was when we lost the ability to present the connected cases.
30:04Yeah, we can't show that he was using the same gun in the murder and the other shootings.
30:11Now, the only evidence that could be presented to the jury was the evidence from the actual homicide.
30:16And then our weakness is the girlfriend.
30:22We didn't know if we could find her.
30:24We also didn't have a motive.
30:26No motive is always a weakness in the murder case.
30:30He doesn't know these people.
30:32He wasn't looking to rob somebody.
30:34Because you want the case to make sense to a jury.
30:38You look for a motive.
30:39We knew we probably had Jamila, and she could give us the chain of events leading up to the homicides.
30:46At 1030, that was when I texted and said, at Midtown, there's some people outside the park.
30:52Jamila was the first person at the crime scene that noticed something was off.
30:58And so we were really looking forward to her explaining how the event unfolded and give a description of the vehicle that was involved.
31:07And so when Officer Terwilliger makes contact with Andrea and his girlfriend at the motel, they're in a Chevy Equinox.
31:16So that was an important tie-in.
31:21But then we found out that Jamila had passed away from natural causes.
31:28You never know what to expect when time passes.
31:31We were very surprised when we found out that Jamila had passed, and even sad by it.
31:38And unfortunately, this is not good for prosecution.
31:46When we lost Jamila, we lost kind of a key component of that background information.
31:57Yeah, I mean, she also is the one that described that it was an equinox.
32:02Losing her, that was a hit for sure.
32:06So far, we were having some difficulties.
32:09But we had good contact with the girlfriend, and we'd met with her several months before the trial.
32:17I hoped that she remembered what had happened.
32:19I hoped that she'd be willing to testify, truthfully.
32:23I got the sense that the girlfriend was motivated to participate in the case.
32:28The girlfriend became a strength, and no motive was defused.
32:35She described him as the type of person that would commit these senseless killings,
32:40with no remorse and really no provocation at all.
32:45With the domestic violence backdrop, lack of let it really isn't necessarily a weakness anymore.
32:52We had context for the type of person he was.
32:55But just one week before trial, we'd ordered all the property.
33:04One of our big pieces of evidence linking the defendant to the murder was we found the murder weapon in his underwear.
33:11In his underwear, we were looking through the boxes of evidence, just casually attaching exhibit stickers to exhibits.
33:21That's really the putting the bow on the case.
33:24There were two guns that were collected.
33:27There was a revolver, and then there was the murder weapon, which was a semi-automatic 9mm.
33:32I open up the box, and I see a revolver, but not a semi-auto 9mm.
33:39So we have a box that has the identifiers for the murder weapon.
33:45And he said, this box is empty.
33:48We're missing the murder weapon.
33:53We had a gun, but it just wasn't the right gun.
33:56Of course we had the gun that wasn't implicated in the murder.
34:00And so I called Detective Kennedy.
34:02I asked him to look into the missing murder weapon.
34:04Well, Detective Kennedy gives us a call and says, it was destroyed.
34:10Oh, okay.
34:11Who destroyed it?
34:12The government.
34:14They destroy the murder weapon in a brutal, senseless, double murder case.
34:20You've got to be kidding me.
34:22I was going to have to explain, government destroyed its murder weapon due to human error.
34:29Well, that's going to play really well to the jury.
34:31This definitely was a wrench in the gears for our preparation.
34:37So, we structured our witness list around the murder weapon with every single hand that had ever touched it to be ready to testify.
34:46We planned to really show the jury that this murder weapon that was collected from the defendant is the same one that was tested and the same one that matched back to the casings at the murder scene.
34:59We don't always have this many witnesses for one piece of evidence, but we don't know how the girlfriend will present to a jury.
35:08Knowing that we didn't have the gun, I had a residual feeling of worry and a little bit of doubt.
35:14The courtroom atmosphere was definitely tense.
35:24There had been some allegations that this particular defendant might not always control himself.
35:29Normally, I keep multiple pens on my table. I haven't done that. I don't want to have any sharp objects within reach. This was a scary guy.
35:42And the whole, I just don't care, disposition he had. It just made it hard to even look at him.
35:51My mother ended up passing away before the trial actually started.
35:56But my wife was there with me at the trials every day. Somebody had to be there for my dad and my uncle.
36:04I was. I was going to be there.
36:07As the prosecution calls Andriel's former girlfriend to the stand.
36:12The girlfriend's testimony was critical because she was an eyewitness and because she's the one that had purchased the gun that came back as a match to the murder scene.
36:22Andriel had some of the best attorneys in Tulsa and she was one of the most important witnesses in our case.
36:29So we had every expectation that the defense would go after her.
36:33And if she got on the stand and presented in a way that was rough or suspect, then the defense literally could have pinned the murders on her.
36:52The girlfriend really makes or breaks the case.
37:04If she had inconsistent testimony, then our case could very well land itself into reasonable doubt territory.
37:11She had to testify to emotional abuse, physical abuse, threats of violence, threats against her family.
37:22And that was all just leading up to being shot and witnessing the murder.
37:30Even though we didn't have a motive, she was able to give the jury a snapshot of how Mr. Smith was living this summer of 2018 and what his mind state was.
37:44I would ask her about the abuse that she suffered from him. Multiple times she broke down and started crying. And we had to take a little pause for her to compose herself. And then she would describe it.
37:59She was not afraid to go into the details. It was just hard for her. It was emotional. But she was strong too.
38:05And it added a lot of credibility to what she testified to about the actual events in the homicide. She stuck to what she remembered and what she saw and what the truth was.
38:17She was so convincing. There was a tangible chemistry when she testified and the jury felt it. You can feel it in the room.
38:26The woman that was in that video and the woman that was on the stand to testify were not the same person.
38:36Well, looking at the defendant, she wasn't scared anymore.
38:40The defense attorneys attacked the girlfriend's credibility by labeling the lack of charge after her arrest as a free pass.
38:48The girlfriend responded, I wouldn't call the PTSD following this relationship a free pass.
38:57I think only a survivor of domestic violence could match the energy that the defense attorneys were coming at her with.
39:05It really spoke to the changes that she'd made in her life.
39:08She was going to counseling and worked on dealing with the past trauma and the abuse that she'd been through.
39:15Knowing that my dad's murder technically helped a woman get her life back together.
39:24That would honor my dad to know that although he lost his life, knowing that his life helped would have made his day in a way my dad was able to help again.
39:38After three days of trial, closing arguments begin.
39:42The defense closing argument really highlighted the fact that the gun was missing and how do you know the gun ever existed?
39:49The defense attorney had said, should you take the government's word for everything else they're saying?
39:55And insinuated that we, the state, were trying to say to the jury, just take our word for it when that wasn't the case at all.
40:01From the time that the judge dismissed the jury till court was back in session, was literally an hour and 15 minutes.
40:12The jury returned a verdict of guilty on two counts of murder and also for the assault and battery of a dangerous weapon where the girlfriend was the victim.
40:25The jury wanted to give him the max, the most punishment they possibly could on everything.
40:30My mom, I know she's happy with the outcome.
40:44My mom, I know she's happy with the outcome.
40:58He got justice for what he did to my dad and my uncle.
41:02And he's going to die in prison where he deserves to be.
41:06I think the system got it right.
41:08This is one of the most violent, dangerous people
41:12that was walking the streets in Tulsa.
41:15And the jury saw that.
41:22Seven years this September.
41:24Wow, seven years ago this September
41:25is when my father was taken.
41:28Doesn't seem that long.
41:30It really don't.
41:32And then one year ago, we heard the verdict.
41:35Yeah.
41:36Guilty.
41:38Yeah, back in June.
41:40This is nice.
41:42Nice to be able to tell him.
41:45The man cared about everybody.
41:48There was nothing on this planet
41:50that would stop him from taking care of his kids.
41:53All three of us.
41:55As a husband, he bent over backwards for my mom.
42:00He's a great man.
42:02The whole world is different now because he's gone.
42:05He was the nicest man besides my dad.
42:09I've known.
42:11Yeah, he had a big heart.
42:15Do miss him a lot.
42:17You could hear my dad laugh across the park.
42:20And you could never mistake it.
42:27He turned my life around just by being there.
42:31And I miss him every day.
42:34Part of me just wished I could have said goodbye.
