00:00who killed Byron who killed Byron Griffey who killed Byron Griffey not knowing why
00:09somebody would have murdered him was the biggest thing we didn't have a murder
00:15weapon we didn't have any real DNA at the scene Byron was laid out almost like one
00:24would be laid in the casket he was staged Tommy Tomlin and Corey Higgs were obviously on the
00:34suspect list but Byron's friends Charles and Anthony might be hiding something we've known
00:43Charles and Anthony for years Anthony was so kind and patient my oldest son works for him and his
00:53brother well but I thought that was his brother
00:58Charles and Tony are not brothers they're together they're lovers
01:23Anthony asked me to marry him we were going to get married Humphrey Bogart style at the Rialto
01:28Anthony asked me to marry him we were going to get married Humphrey Bogart style at the Rialto
01:53it was all just crazy it was like wait what Charles and Tony are gay have been for 24 years
02:15now Tony's leaving Charles for my mother who's leaving my stepfather who raised us
02:22what the is happening I'm furious I'm so upset that I would introduce Tony into our family and that the
02:35two of them would just blow it all up for their own selfish needs not only did that rock of your family get
02:43just completely destroyed you know Charles and Tony boom that's blown up too
02:50we brought Laura in to interview her to see if Anthony had disclosed anything to her about
03:04the murder of the murder of Byron Griffey
03:06did Nancy tell you about the death of Byron?
03:10Charles did
03:10what did he tell you?
03:12he just said they went out to go see a friend to have a lunch
03:16and they couldn't get onto the property they kept calling him and nobody came out to the gate to
03:22unlock it and let him in and so they left and then the guy ended up dead
03:27that's it
03:29Anthony would party
03:36yeah I'm not so sure I don't know either one of these guys
03:40no
03:41how much contact have you had with Charles over the last five years?
03:46times
03:46what do you know about Charles?
03:48Charles is dangerous
03:49he scares me
03:52why?
03:53and I don't know why my intuition will tell me that but it didn't tell me everything else
03:57if these guys are wrapped up in that homicide out east
04:04one can't let the other one get over it
04:08Anthony would party
04:10well we all say that
04:13but we all get surprised
04:15when you guys came to Florence how did you guys introduce yourselves?
04:29uh we did start off calling ourselves brothers
04:35initially figured that would help us get broken to the town
04:40yes Charles and I were together for a long time but we weren't really close
04:46physically
04:47for the last
04:4910 or 15 years
04:52there was no romantic inclination between us
04:57uh that had already faded by the time I was starting to have feelings for Laura
05:03a few hours prior to this happening I just told Charles
05:14bottom line is I'm not gonna stay with you
05:17Charles's personality was controlling
05:21and I was okay with giving up businesses and personal belongings
05:27to just try and be happy
05:30Laura told me that she was moving out she had a place to go
05:34so I packed a bunch of clothes into a garbage bag and threw them in my car and went
05:38I knew that Charles was very vindictive
05:44I knew there would be problems in the future
05:48but I was hoping to work through that
05:54always an optimist I guess
05:57before I had even gotten to Laura
06:01Charles had called her and let her in on everything
06:06so she was freaking out pretty bad
06:08I told her yeah it was true
06:10but we weren't together for years physically
06:15it was just basically a convenience because we were working the same businesses
06:19I told her I was gonna go talk to Charles again
06:24and I was hoping I could just reason with him to be human about it
06:29drove all the way home
06:31when I got there
06:33Charles was gone somewhere
06:34so I left him a note
06:37I had business credit cards
06:41and the business phone
06:42so I just set it on the table
06:44and I just walked out
06:46I was a police officer in Florence in 2012
06:51I believe it was a Sunday night
06:54when I got called into the police department
06:56they said hey Anthony's missing
06:58there's a suicide note
06:599-1-1-1-2 emergency
07:02Charles was thinking Anthony was going to kill himself
07:05he starts crying
07:07you know he's really upset
07:08he was telling me you know he really loved Anthony
07:10he was hoping he was alright
07:12and he told us to check where the horses were
07:14my mom was so distraught
07:17she's like Charles told me
07:19Anthony's gonna kill himself
07:20we have to find him
07:21so my friends and I started driving around town
07:24there's cop cars everywhere
07:26all the load
07:27going to the church
07:28the main street grill
07:29all the places you know
07:30so we're like
07:31oh man where would he go
07:32like what would he do
07:33where is he gonna kill himself
07:36I didn't know any of this was happening
07:41I was hanging out with my horses
07:45yes I had a firearm with me
07:50but at the time I always had a firearm with me
07:53a couple officers from the Florence police department showed up
08:00so I just came wandering up
08:02hey what's going on guys
08:03and how you doing buddy
08:04and they're like
08:05fine how you doing
08:07they were doing an evaluation
08:10to see if I was suicidal
08:12if I wanted to commit suicide
08:14I'd have done it
08:15there was no reason not to
08:17but I didn't
08:18because I wasn't going to commit suicide
08:20the officers took me to Florence police department
08:25do you have any weapons on the air?
08:29law enforcement did receive the note that Anthony had authored
08:34some believed it to be an admission of guilt
08:38with the murder of Byron Griffey
08:40so I have the note
08:45it says
08:53I hold no one responsible for my actions but myself
08:56please don't hold anyone else responsible for anything that I have done
09:01and then I signed it
09:02Anthony has right
09:03I don't know
09:06it was a personal note to Charles
09:09about Laura
09:10and that's all it was
09:12if I hadn't known CBI was going to read it
09:15I probably would have worded it differently
09:17we brought Charles in
09:19so that they both could be questioned
09:21do you remember pretty much everything we talked about
09:23back in October about the Byron thing
09:25would it be okay if we just square up a couple of things
09:28because there's been some things
09:30that I've found the last couple months
09:32that have been causing me some concern
09:33let me just go ahead and give you the rights real quick
09:35so you are not underwarsed
09:38I just want to make sure there's nothing else that you forgot
09:40we had realized
09:42there were inconsistencies in their story
09:45we were hoping at some point
09:47one would turn on the other
09:49and say something that hadn't been said before
09:52Mark if you have evidence
09:54I don't believe you do it because I did nothing
09:55I mean what have you got
09:56when I learned that Charles and Anthony weren't brothers
10:16wow it was a sense of betrayal
10:18I think a lot of people in Florence felt that way
10:24it was almost like the whole town got duped
10:27as an investigator for the Fremont County Coroner's Office
10:33I would have to call funeral homes at strange hours of the night
10:37there'd be a call to Charles Giebler
10:40for him to come pick up somebody that just passed away
10:43and he'd just say hold on
10:45talk to Anthony
10:46and then roll over and give the phone to Anthony
10:48so you know at that point it's like
10:51well I don't sleep with my brother
10:54gay relationships have been in this world
10:58from the beginning of time
11:00it's nothing new
11:01it's who you are
11:03and some people can't accept that
11:06lying about who you are
11:08and not wanting to tell everyone
11:10is self-preservation
11:12it's really hard for me to wrap my head around
11:15how long of a relationship they had
11:18this was a full-fledged like life
11:20that these guys built together
11:22and so it's really hard that
11:25Tony's never really addressed it
11:27or like talked about it
11:28and then being gay myself
11:30it's like you couldn't spot two other gay guys
11:33I do understand why it wouldn't be public information
11:36but they were like family to us
11:39they could have trusted at least us
11:41to know their secret
11:43well as long as we're sitting here today
11:50I need to clear up some things Tony
11:51there's none that's still HR
11:54but looked at your cell phone records
11:57watched your travels that day
11:59when you left the farm
12:01you told me that you guys went and had lunch in Pueblo
12:05there's about an hour of time
12:09that I need you to look out for
12:10during the interviews with Charles and Anthony
12:14they stated that they left Fowler about 1 o'clock
12:17they drove to Pueblo
12:18they ate lunch at a buffet restaurant
12:21which they had a receipt for
12:23we contacted the buffet restaurant
12:26to see if we could get some surveillance footage
12:29from the cameras
12:30unfortunately the cameras had already erased themselves
12:35as we're putting the timeline together
12:39if they would have left Fowler
12:41a little before 1 o'clock
12:43it's about a 35 minute drive
12:45from Fowler to the buffet
12:46receipts showed that they were stamped in at 226
12:51which you pay before you eat
12:53so there was almost an entire hour
12:55that was unaccounted for
12:57it does not take an hour and a half
13:04to get from Fowler to the buffet
13:05so rack your brain
13:07it'll be very loose
13:08I hardly remember that date
13:11and you've got an hour of driving around
13:16no hour by other than each other
13:19you guys have been mistaken
13:21do you remember what you told me
13:25the day I talked to you Sunday
13:27the day after Byron's death
13:29do you remember telling me
13:30what vehicle you drove out there
13:31it was a black Mercedes S500
13:341997
13:36it was the black
13:39the before normal Mercedes
13:40ok
13:40here's what was bothering me the most
13:44I pulled the Savannah's video
13:47from different locations
13:50I know you're not in the black Mercedes
13:53in fact I can tell you exactly what you're driving
13:55I'm concerned why you're not being honest with me about that
13:58I ain't afraid I don't know what you're talking about
14:03they say that they're driving their Mercedes
14:09they decide to go to lunch
14:11then go by the Home Depot to buy the deck box
14:14that they're going to place out of the marina
14:16for their boat
14:17we got surveillance footage
14:20that shows where they had bought the deck box
14:22and the investigator was able to identify
14:25that they were in a white Astro van
14:27that is totally inconsistent
14:30with them being in the Mercedes
14:31imagine if you will
14:36how that looks
14:38the day after I'm talking to you
14:39you say black Mercedes
14:41you're always says black Mercedes
14:43and then I find out independently
14:45that you're in a different vehicle
14:47why are you being dishonest with us
14:51about the vehicle
14:51why would you lie about something as stupid
14:54as what vehicle you drove
14:56unless you know
14:56I don't believe I was lying
14:59it must have been mistaken
15:01I could have sworn I was in that car
15:02to the best of my knowledge
15:06the car that we drove down there
15:08was a black Mercedes
15:09that was honestly primary mode
15:13of transportation for me
15:14and my brain told me
15:16that that's what I was driving that day
15:18because it made sense
15:19Tony you're lying to me
15:21about what vehicle
15:22you're driving that day
15:23must have been mistaken
15:24the next day you forgot
15:26what vehicle you drove
15:27I didn't think there was any reason
15:30to have total recall
15:31of an average day
15:33it wasn't an average day
15:35Tony a man died that day
15:37and you were there on his property
15:38when he died
15:39I didn't know that at the time
15:40I never made it past the gate
15:43I don't know what to tell you
15:44both Charles and Anthony
15:49seemed to forget
15:50that they were in the Astro van
15:51there was no other seating
15:55in the van
15:55other than the two front seats
15:58Charles and Anthony
15:59had no intent
16:01on picking Byron up
16:02and taking him
16:03anywhere that day
16:04because there was nowhere
16:06for an 80 year old man
16:08to sit in that van
16:09Charles and Anthony
16:12were not there
16:13to take their friend
16:14for a birthday lunch
16:16they were there
16:17to murder Byron
16:20so you know guys
16:21we did not do anything
16:23to Byron
16:23that's the honest good truth
16:25Charles and Anthony
16:26denied everything
16:27so we start going through
16:31and looking closer
16:32we learned they had
16:34some very deep dark secrets
16:36that made me think
16:38how can this case
16:40get any crazier
16:41CBI had told me
16:52that Charles and Anthony
16:54were suspects
16:55they had a motive
16:56to kill my dad
16:57I mean
16:59it's all about money
17:00the police were really focused
17:02on Charles and Anthony
17:04so it made me
17:06kind of second guess
17:09Cory
17:10Charles and Anthony
17:14is the only ones
17:15that knew that he was
17:15going to the farm
17:16the farm itself
17:19is isolated
17:21there would be no way
17:22that a neighbor
17:23would have heard
17:23a gunshot
17:25Charles and Anthony's story
17:28was falling apart
17:30and during the investigation
17:32we uncovered some less
17:34than savory details
17:35about them
17:36I think most funeral directors
17:45want to generally help people
17:47and there's some
17:49that want to take advantage
17:50of people at their lowest point
17:51the funeral home I worked for
17:54had a great reputation
17:56in this community
17:57they've been in this community
17:58for generations
17:59and then these guys
18:01come in
18:02and just snowball everybody
18:03the people that hated
18:06Charles and Anthony
18:07were kind of the other
18:08business people in town
18:10because Charles did not
18:11play very well with them
18:13a funeral director
18:17it's all about
18:18being professional
18:19you know
18:20you go out
18:20to somebody's house
18:22and take one
18:23of their loved ones
18:24out the door
18:25that has just passed away
18:26you shouldn't be
18:28in a t-shirt
18:28these guys just kind of
18:31did whatever they wanted
18:32Charles would show up
18:35in cargo shorts
18:36flip-flops
18:37I just couldn't believe it
18:38I thought it was
18:39so unprofessional
18:40Charles and Tony
18:42they always put you
18:43in that situation
18:44where you were like
18:45whew
18:46that's kind of sketchy
18:48or like morally cloudy
18:50they asked us
18:52to do a few shaky things
18:54here or there
18:55felt like you were kind of
18:56like in the little
18:57mini town mob
18:58and Charles was the mob boss
19:00then we were the henchmen
19:02these people were doing things
19:06that they shouldn't be doing
19:07I mean
19:08it felt like
19:09they were definitely
19:11out to get us
19:12a smoke grenade
19:15was thrown through
19:16the window of the mortuary
19:17and it's not like
19:18everybody in Florence
19:20just has smoke grenades
19:21but Charles Giebler
19:22was heavily into weapons
19:24can't prove it was them
19:28but nobody else
19:30is going to do that
19:31and then years back
19:35right around pioneer day
19:37before the big parade
19:38had brought over
19:40the 39 Packard
19:41and the 38 Cadillac limo
19:43it was very important
19:45to Bill Holt
19:46the owner of the mortuary
19:48that those vehicles
19:49be in that parade
19:50we drove them over there
19:53the night before
19:54the next day
19:56all the ignition
19:58wires had been cut
20:00car wouldn't start
20:03somebody didn't want us
20:04in that parade
20:05and went in
20:05and snipped the wires
20:06behind the dash
20:07it was obviously
20:10Charles and Anthony
20:12who else would do that
20:15Charles always liked
20:18to talk about
20:19how he would get one over
20:20especially on the IRS
20:21or the government
20:22or any kind of
20:23authority figure
20:24Charles started that church
20:26so that he could become
20:27tax exempt
20:28and kind of funnel
20:29some funds through there
20:31that was definitely
20:35not the first
20:36like tax scheme
20:37Charles told me
20:39that you would not believe
20:41the tax breaks
20:42that's why they did it
20:44one of the obligations
20:50that law enforcement
20:51has is to investigate
20:53the background
20:54of any potential suspect
20:55we became aware
20:57that Charles had been
20:58found catfishing
20:59he was setting up
21:00these online relationships
21:02clearly sexual in nature
21:04in representing himself
21:06as a younger individual
21:07this kid in New York
21:09tell me about you
21:10Facebook has this new thing
21:12this little role playing
21:12kind of game
21:13it's just a game
21:14the kid in New York
21:16didn't think it was a game
21:16no he didn't
21:17Charles had a rock and roll
21:20mortician persona
21:22that he was trying to keep up
21:24that he was
21:25you know
21:26younger
21:26in a band
21:28worked as a mortician
21:29so is this a little being
21:31you spent on the internet
21:32with these kids
21:32I guess so
21:33I confronted him about it
21:35he said it's just a role play
21:38I said okay whatever
21:41a poor 18 year old kid
21:42in New York
21:43was pretty devastated
21:44he didn't know
21:45that Charles was
21:47a 51 year old man
21:48he thought he was
21:49a 25 year old
21:50little hard body kid
21:52Charles
21:53the things that he did
21:55in his life
21:56like the catfishing
21:57and going into politics
21:59and the church
22:01being a bishop
22:02that played into
22:03his narcissism
22:05he liked to
22:07show off
22:08be the man that
22:09people were talking about
22:10Charles definitely
22:12thought of himself
22:13as above the law
22:14maybe he thought of himself
22:16as the law
22:16as more accurate
22:17because he had his own
22:19sense of justice
22:20and he also
22:21had God
22:22on his side
22:23Charles
22:24also liked to boast
22:26he would say
22:27if I was ever
22:28going to kill someone
22:29I would use a 22
22:30to the back of the head
22:31they were
22:36very much a threat
22:38I believe
22:39to the community
22:40everything
22:41that Charles and Anthony
22:42did
22:43was all a scam
22:44and you've got to just wonder
22:47what happened to Irene Witte
22:50Irene Witte and her husband
22:55Frank had lived
22:56in Florence
22:57almost all their lives
22:58they operated the funeral home
23:00next door
23:01when Frank Witte died
23:04we took care of his
23:06wife
23:07because her family
23:09kind of just left her
23:10high and dry
23:11I'd heard bad stories
23:13from Charles and Tony
23:15about how awful
23:16Irene's family was
23:18and they're the ones
23:19that took care of her
23:20they took her soup
23:21they fed her
23:22they took her to the doctor
23:23Charles took over
23:25as a financial situation
23:26and a week before
23:29she passed away
23:30she had changed
23:32her will
23:32and left everything
23:33to them
23:34the number was
23:35700 to a million dollars
23:38100% believe
23:40Charles was part
23:41of Irene's death
23:42Charles and Anthony
23:47always spent money
23:48they liked to flash
23:49it around
23:50but after
23:51Byron died
23:53they took it up a notch
23:55they bought boats
23:56jet skis
23:58they started spending money
24:00like crazy
24:00at this time
24:02business was slow
24:04Charles and Tony
24:05weren't making much money
24:07at all
24:07the Colorado Department of Revenue
24:10was attempting to shut down
24:12some of the businesses
24:13that Charles and Anthony
24:14owned for failure to pay taxes
24:15so they were in financial trouble
24:18it made us believe
24:21that that would have been
24:22a large motive
24:24as to why
24:26Byron was murdered
24:27the next step
24:30was to get
24:32a search warrant
24:33for the White Astro Band
24:34knowing that they
24:39had bought the deck box
24:40and that they were
24:41at the North Shore Marina
24:42we thought that they
24:43might have discarded
24:44the murder weapon
24:45divers were sent
24:47to look for
24:48a weapon
24:49unfortunately
24:50we were not able
24:52to obtain the weapon
24:53from the Marina
24:54the evidence
24:56from the Astro Van
24:57came up empty
24:59there was no DNA
25:00there was no blood
25:01in the Astro Van
25:02so again
25:03we were pretty much
25:04at square one
25:05at the same time
25:07we had not been able
25:09to rule out
25:10other suspects
25:11Tommy Tomlin
25:12and Corey Hicks
25:14Tommy Tomlin
25:16did take a polygraph
25:18which he failed
25:19we couldn't pinpoint
25:20where Corey's
25:21whereabouts were
25:22and Corey's alibi
25:24did have some holes in it
25:25as we began
25:27to dig deeper
25:28we found that Corey
25:29had a very good motive
25:31to hurt Byron
25:33so have you ever
25:34taken a polygraph before?
25:36do you know anything
25:37about polygraphs?
25:38I don't know
25:39a whole heck of a lot
25:40about it
25:41other than
25:41heart rate
25:42breathing rate
25:43blood pressure
25:43or you know
25:44all those nice
25:44physical things
25:45Corey is extremely
25:47intelligent
25:48he can take control
25:51of any situation
25:52that you put him in
25:53how'd you sleep
25:54last night?
25:55not so good?
25:58what was going on
25:59with you last night?
26:00I'm just going to
26:01shut my mind off
26:01thinking about today
26:02about today
26:03I was just nervous
26:04and just running
26:06all of it through my head
26:07so what do you want
26:10this polygraph
26:11to prove to me?
26:12and that I wasn't
26:14there
26:14didn't have anything
26:15to do with it
26:16it's not me
26:17so I don't want
26:21to dredge up
26:21because it's obviously
26:22very serious
26:24and difficult
26:25for you to talk
26:26about
26:26but
26:26what happened?
26:32but
26:33when I'm outside
26:35looking in
26:35you have a pretty
26:37good motive
26:37to murder Byron
26:39based on what
26:52I understand
26:52you made allegations
26:55that Byron
26:57was sexually
26:57assaulting you
26:58Corey Higgs
27:02was Byron's
27:03step-grandson
27:04I still saw him
27:05as my friend
27:06even though
27:08I know it was
27:08ulteriorly motivated
27:09you fought his part?
27:12you did
27:12we got along
27:13really good
27:14if
27:16I was
27:17doing the sexual
27:19things that he wanted
27:20so he kind of had
27:22a dark side
27:23yeah
27:23about a year
27:26before
27:27the murder
27:27Corey had said
27:29that Byron
27:30would give him
27:31cash
27:31for sexual
27:32favors
27:32and
27:33that Byron
27:34would take care
27:35of him
27:35that way
27:36was there
27:38a time
27:39that you were
27:39consenting
27:40with him
27:41you could say
27:43yes
27:43I was consenting
27:44but
27:45I still didn't
27:47like the idea
27:47that was happening
27:48I didn't like him
27:52I mean
27:52I didn't like
27:52what he did to me
27:53I still feel bad
27:54and
27:56even though
27:58I shouldn't
27:58I still did
27:59I think
28:03Corey accused
28:04Byron
28:04because
28:05none of us
28:07were bowing
28:07down to him
28:08anymore
28:09to get him
28:10out of foster care
28:11accusing my dad
28:14just seemed like
28:15that would have
28:19been something
28:20he'd have done
28:20just to hurt us
28:23prior to 2012
28:26did you ever
28:28think
28:28of getting even
28:29with someone
28:30yes
28:32so Byron
28:34is arrested
28:35when we had
28:37the conversation
28:38with Byron
28:38after he had
28:40posted bail
28:41he said
28:42I did not
28:44do anything
28:44I did believe
28:46Byron
28:47a case
28:51was opened
28:52and Byron
28:53was charged
28:54with sexual
28:54assault on a child
28:55by one in
28:56position of trust
28:57Byron was
29:00found guilty
29:01after that
29:02my dad
29:03couldn't see
29:04his grandkids
29:04he went
29:07from
29:07the most
29:10loving
29:10caring
29:11person
29:11to
29:13the most
29:14depressed
29:15withdrawn
29:16person
29:17he was
29:18embarrassed
29:19and ashamed
29:20that people
29:21believed what
29:22Corey had said
29:23he was scared
29:24that Corey
29:25was going to sue him
29:26I've known
29:28Byron for years
29:29we were
29:30friends
29:31several weeks
29:32before he
29:33actually died
29:34Byron had said
29:35I have a letter
29:36to give to you
29:37it was a letter
29:38in a sealed envelope
29:39and he said
29:42if something
29:43happens to me
29:45be sure you do
29:46an autopsy
29:47and look at
29:49this letter
29:49and he said
29:50it's just
29:51concerning
29:51because of the
29:52situation
29:53surrounding him
29:54and Corey
29:55did he feel
29:57a threat
29:57against his life
29:58was something
29:59going on
30:00that was a major
30:01concern to him
30:02that was going
30:03to happen
30:03what would have
30:06led Corey
30:07to actually
30:08murder Byron
30:08was my big thing
30:10time had passed
30:12the court case
30:14with him
30:14was over
30:15Corey
30:16didn't gain
30:17anything
30:18out of any
30:18of it
30:19other than
30:20being able
30:20to hold
30:21Byron
30:22accountable
30:22Corey
30:23lost everybody
30:24that was
30:25family to him
30:26did you
30:28murder Byron
30:30yeah
30:30did you
30:31ask anybody
30:31to do it
30:32for you
30:32no
30:32did you
30:37walk out
30:37to his house
30:38or to the
30:39farm
30:39and go
30:40and do
30:40this
30:40I haven't
30:41been
30:41I haven't
30:42been on
30:42that farm
30:43for
30:43almost
30:46three years
30:46after
30:49Corey
30:50had taken
30:51his polygraph
30:51the results
30:53came in
30:53and it
30:54was found
30:55that he
30:56passed it
30:56at that
30:58point in
30:58time
30:59Corey
31:00was ruled
31:00out as
31:01a suspect
31:01we had
31:02no evidence
31:03that Corey
31:04was there
31:04that he
31:05was involved
31:06there's
31:06nothing
31:07that attaches
31:08him to
31:09this crime
31:09other than
31:10the fact
31:10that he
31:12had been
31:12lost by
31:13Byron
31:13Griffey
31:14so that
31:15ruled him
31:16out in
31:16our eyes
31:17I truly feel
31:18that if Corey
31:19would have walked
31:19up to the farm
31:20Byron would have
31:21been on the phone
31:22calling 911
31:23I don't think
31:24Byron would have
31:25willingly opened
31:27the door
31:27for Corey
31:28prior to
31:29the murder
31:30during the
31:33investigation
31:33we begin to
31:35realize that
31:36there's another
31:36side to Byron
31:37that people
31:38didn't know
31:39everybody knew
31:42the young males
31:43if you needed
31:43money for something
31:44you'd just go
31:45see Byron
31:46he had ways
31:48of letting
31:49them earn
31:49money
31:50never got
31:51any specifics
31:52Byron I think
31:54was embarrassed
31:55you have to
31:57remember that
31:58men of his
31:59age
31:59who were
32:01gay
32:01they didn't
32:02talk about it
32:03Byron got a
32:05divorce long
32:06ago
32:06from Lynette's
32:07mom
32:08I personally
32:09never spoke
32:10to Byron
32:10about
32:11sexuality
32:12but I think
32:14that Byron
32:14was extremely
32:16lonely
32:16as far
32:18as
32:19a partner
32:21type
32:21relationship
32:22Tommy Tomlin
32:24was someone
32:26who would do
32:27just about
32:27anything
32:28for money
32:29as time
32:30went on
32:30we started
32:31to hear
32:32that he was
32:32in a relationship
32:33with Byron
32:34that he
32:35kind of
32:35withheld
32:36from us
32:36from the
32:37start
32:37so
32:39the next
32:40step
32:40was to
32:41meet with
32:42Tommy
32:42again
32:43I'd like
32:49to clear
32:50this up
32:50tonight
32:51so
32:51why
32:52because
32:52I don't
32:53want to
32:53ever talk
32:53to you
32:53guys
32:54again
32:54then
32:55help me
32:55out
32:56there is
32:58something
32:58else
32:58to happen
32:59alright
33:00I heard
33:06that
33:06I
33:07appreciate
33:08your
33:09candor
33:09there was
33:16a relationship
33:17between
33:17Tommy and
33:18Byron
33:18that was
33:19more than
33:20your everyday
33:21handyman
33:22he would do odd jobs
33:23around the house
33:24Byron would invite him over
33:26to have turkey pot pies
33:29and to watch porn
33:30and Byron would give him
33:35money for sexual favors
33:37I don't need to know
33:39any details
33:40but where did this happen
33:41outside
33:41at his house
33:43in town
33:43not on the farm
33:45I was high
33:46you have now
33:48helped me
33:49to help you
33:50with Tommy Tomlin
33:53knowing his drug issues
33:55if Tommy killed Byron
33:57in a heat of passion
33:58it probably wouldn't have been
34:00at the farm
34:01and it probably wouldn't have been
34:02as clean as it was
34:04so
34:05it was at this time
34:07that we kind of started
34:08shying away from Tommy
34:09as a top suspect
34:11what motive did he have
34:13I mean he could have worked
34:15for my dad every day
34:16and got money
34:17and now he gets nothing
34:20so
34:21I didn't see that
34:22Tommy had any
34:24motive to do it
34:26this was a very
34:29hard case
34:30we felt that we were
34:32getting very close
34:33to making arrest warrants
34:35for Charles and Anthony
34:36but the moment we thought
34:38we had it figured out
34:40there was a turn
34:42and
34:43now we had another
34:44dead body on our hands
34:45a few months
34:53after Byron's murder
34:55we felt that we were
34:56getting very close
34:57to being able to make
34:58an arrest
34:59of Charles and Anthony
35:01and we were in the process
35:03of drafting the arrest warrant
35:04and they were aware
35:05that they were being
35:06investigated for the murder
35:07of Byron
35:07it was tough
35:18we're dealing with
35:20the family collapse
35:21my mom had left
35:23my stepdad Dave
35:24for Tony
35:25and now
35:26this murder investigation
35:27is fully happening
35:29and like
35:30Charles and Anthony
35:31are suspects
35:32but they were always
35:33assuring me
35:34that this was nothing
35:35and it was gonna go away
35:37Charles was
35:41just
35:42absolutely
35:43rot
35:44anger
35:46fear
35:46stress
35:47and you could just
35:49see it on him
35:50Charles called
35:52and he told me
35:53Anthony had left him
35:55and that
35:56they were gonna be charged
35:57with murder
35:58and picked up
35:58the next day
35:59so he said
36:00you need to come
36:01get your dad's coins
36:02CBI told me to go
36:06then
36:06but I was scared
36:08and I didn't trust Charles
36:09we knew that Charles
36:12and Anthony
36:12were accused
36:13of killing Byron
36:15so we took
36:16Harry Tomlin
36:17with us
36:18just to be safe
36:20I am legally
36:22allowed to
36:23kill
36:24Carrie
36:24so I brought a weapon
36:27with me
36:27basically I was their
36:29guardian angel
36:30Charles and Tony
36:34lived
36:35in a big
36:36beautiful
36:37Victorian home
36:38that they had
36:39restored
36:39it was the first
36:42and only time
36:43I had ever been
36:44in their house
36:44we weren't allowed
36:46to go to
36:46the secret room
36:48Charles and his friend
36:50were bringing
36:50everything to the
36:51living room
36:52when the state
36:53quarters came out
36:54there's 50 states
36:57my dad had bought
36:59four boxes of each
37:00they gave me back
37:0260 boxes
37:03a couple pennies
37:06whatever
37:06it was nothing
37:07compared to what
37:08they took
37:08but Charles said
37:10nothing
37:11no explanation
37:13as to where
37:14my dad's money went
37:15I was told
37:17there was a million
37:18dollars worth of coins
37:19but there was
37:20a semantial amount
37:21missing
37:22when Charles and
37:24Anthony came out
37:25to the farm
37:26to get Byron's coins
37:27they used a very
37:28heavy duty van
37:30Charles and Anthony
37:31loaded that van
37:32until it was
37:35squatting
37:35so you knew
37:37that you were
37:38getting to
37:39capacity
37:40when we went
37:42to pick up
37:43the coins
37:43we had just
37:44a regular
37:45pickup truck
37:47and
37:47it didn't even
37:49fill half of the bed
37:51like the truck
37:52didn't squat
37:52at all
37:53Charles kept saying
37:55I wanted to
37:56show you something
37:56like he kept
37:58trying to get me
37:59alone
37:59in like the
38:01dining room area
38:02but I was scared
38:04of him and I
38:05didn't want to be
38:05in the room
38:06alone with him
38:07Harry made sure
38:08that that didn't
38:09happen
38:09none of us
38:11were ever
38:11alone
38:12with Charles
38:13as we were
38:19driving back
38:20from Florence
38:21I called
38:22CBI
38:22and told them
38:23what all had
38:24happened and
38:24everything
38:25and after I
38:27hung up
38:27we kept
38:28driving
38:29and when we
38:34got about
38:34Pueblo West
38:35the passenger
38:36side window
38:37just shattered
38:39somebody came
38:42up and shot
38:42out the
38:42side window
38:43and then
38:45sped off
38:47and then at
38:48the next light
38:48flipped around
38:49and went back
38:50towards Florence
38:52I don't know
38:55I think I'm
38:56lucky that I
38:57wasn't shot
38:57that night
38:58the next day
39:08I was trying
39:09to get hold
39:09of Charles
39:10I had some
39:10questions
39:11about the
39:12funeral home
39:12I had chatted
39:14with Pam
39:15at the restaurant
39:16and Pam
39:17was trying
39:18to get hold
39:18of him
39:19also
39:19I got a call
39:21from Angela
39:22who was running
39:24the mortuary
39:24she said she
39:25hadn't heard
39:26from Charles
39:27and she wanted
39:28me to meet
39:28her over
39:29at the house
39:30and I told
39:31her absolutely
39:31not
39:32I'm sorry
39:33I can't
39:34but Tony
39:37brought Pam
39:38the key
39:38to the house
39:39and we drove
39:40out to the house
39:41we were really
39:43kind of hoping
39:44the car wouldn't
39:45be there
39:45and then he'd
39:45just be somewhere
39:46but the car
39:47was there
39:48and so we
39:48went in
39:48and we couldn't
39:49find him
39:49upstairs
39:50and we went
39:57downstairs
39:58and found him
40:01in the downstairs
40:01bathroom
40:02my friends
40:10and I
40:10we're going
40:11by Charles's
40:12house
40:13and there's
40:16ambulances
40:16everywhere
40:17I'll pull
40:19over
40:20just enough
40:22time to
40:23watch them
40:23pull him
40:32out on the
40:32stretcher
40:33and I was
40:33like what
40:33the
40:34there's a lot
40:45of unanswered
40:46questions about
40:47this case
40:48it would be nice
40:49if somebody
40:50stepped up
40:51and answered
40:52for what they
40:52did
40:53the questions
40:54that I still
40:55have 12 years
40:56later is
40:56ridiculous
40:57it's suspicious
40:58that Charles
40:59passed away
41:00somebody
41:01wanted him
41:02dead
41:02I think it
41:04was a
41:04suicide
41:05because he
41:06didn't want
41:06to have
41:06to go
