00:00A stinging rebuke for federal prosecutors this morning.
00:06A federal judge says the Justice Department's own missteps may have tainted the grand jury
00:11that indicted former FBI Director James Comey.
00:14In a 24-page ruling, Magistrate Judge William Fitzpatrick has ordered prosecutors to turn
00:20over all grand jury material to Comey's defense, transcripts, evidence, even the audio, saying
00:26quote, the record points to a disturbing pattern of profound investigative missteps, missteps
00:32that led an FBI agent and prosecutor to potentially undermine the integrity of the grand jury
00:38proceeding, end quote.
00:40The judge zeroed in on two statements made by Lindsay Halligan, the interim U.S. attorney
00:44handpicked by President Trump to lead the case.
00:47He says she suggested Comey may not have a Fifth Amendment right not to testify and told
00:53grand jurors the DOJ had better evidence it would show later.
00:57The judge says both comments could have compromised the entire process.
01:02The ruling also says FBI agents rummaged through years-old evidence from a separate case without
01:07a new warrant, calling it highly unusual.
01:10Comey has pleaded not guilty to making a false statement and obstruction of a congressional
01:15proceeding.
01:15He wants the felony charges dismissed.
01:18The Justice Department is now moving to block the order, calling it contrary to law.
01:23A critical hearing is set for Wednesday.
