21:08When it becomes more significant damage,
21:09it's where you can see the inside of the boat
21:11come all the way through into the bow area there.
21:14To do that is a very high-speed impact.
21:28We then went on to look inside the boat.
21:31Inside the seats were five lifejackets.
21:34That suggests that they won't be worn at the time.
21:37And when we looked at them,
21:39you can see they were all past the service dates.

21:55It's all adding up a bit in terms of the breach of duty of care.

22:16the moment they hit that boy, there wasn't a call for help
22:21and a search and rescue mission launched straight away.

22:32Police searching for a man who went missing off the Dorset coast nearly two weeks ago
22:45say a body has been found in the water.
22:4924-year-old David Hall reportedly fell from a boat in Pool Harbour
22:53in the early hours of May the 2nd.
22:56The man recovered from the water hasn't been formally identified,
22:59but police say it's believed to be that of Mr. Hall.
23:17There's a high degree of evidence required in order to establish what's happened.

23:44I'm now conducting an investigation into what I believe is a manslaughter
23:50and specifically gross negligence manslaughter.
23:53My belief is that the negligence has led to David's death.

24:15and he would appear to be sitting in the front of the rib facing backwards.
24:23I mean, what I'm seeing there is a boat at speed
24:26and you can tell that by not just the way it's crossing the stream,
24:29but the wake that it's leaving behind,
24:32the way the boat is on what we call the plane where it's out of the water,
24:35normally happens at at least 12, maybe 15 knots.
24:40What was the speed limit at that point when it accelerates?
24:44It varies between six knots and ten knots.
24:48We can say that the collision occurred at a particular time...

24:52..because diver has a sequence of nine flashes...

24:55..and that sequence was interrupted by the impact of the rib.

25:21So, had he been at an appropriate speed,
25:24those first two flashes before the third...

26:15Just to orientate here, if we look in the distance we can see the crane, that's pretty much where
26:19the Yacht Club is and the rib came out of the Yacht Club and came along in front of the
26:24port there.
26:25The rib comes around this side of Stakes Cardinal just over your shoulder there and heads off
26:30down the channel, which is where the rib impacts Diver Cardinal down in the distance.
26:44In the port there's quite a number of CCTV cameras but we've managed to line up one with
26:49Stakes Boy here and it was clear from the CCTV we've got approximately 60 seconds of run time
26:55from Stakes down to Diver.
26:58I calculated Mr. Smith's speed with approximately 30 knots, you know that's at least three times
27:06the speed limit, 30 knots you're doing about 200 metres in about 12 seconds.
27:13Throughout that passage Mr. Smith is choosing, he's making that decision as skipper, he's choosing
27:18to materially exceed that speed limit.
27:30As you come round this corner and you're looking down towards Diver Boy there's a lot of backscatter
27:35and that all creates a really significant challenge for the skipper at that stage.
27:39We're trying to pick up the red and the green flashing lights, we're trying to pick up the
27:43flashing white light of Diver.
27:45It is a bright white light isn't it and operating at a safe speed there is no reason not to see
27:50that, you've just got to slow down and look for it.
27:54That's what training at night gives you which is that appreciation of the challenges.
27:58Mr. Smith's qualifications were really daytime qualifications and he didn't appear to have had any training that
28:06helped him to be safer at night.
28:17The sort of combination of the decision to go, the speed, the lack of navigation and planning,
28:22safety briefs, all of these things together add up to a situation where the duty of care
28:29that the skipper's got for those on the boat is simply not being, you know, not being followed.
28:35To what degree do you think?
28:37In my opinion it fell very far below the standard that should be reasonably expected and that's
28:44directly the reason that sadly the incident arose and David Hall lost his life.
28:50It's an entirely avoidable incident, an entirely avoidable death and that's the real tragedy of it.

37:15That reconstruction at night is a very good demonstration
37:19of what it should have looked like.
37:21Now, this is the route that was taken, but in daylight,
37:25and also carried out at a similar sort of speed
37:29at the time of the incident
37:30to represent as accurately as possible
37:33the findings of Paul Glatzel in his expert statement.
37:37They accelerate and get up to speed
37:40as they come round stakes.

37:51You look at the daytime
37:59and see how fast those boys come up
38:01and try and think about doing that at night,
38:03and you realise it's just not something you should be doing.

38:06And I think this just goes that little bit more
38:11to showing to not just jury,
38:12but also for judge,
38:13on the level of culpability of Smith.
38:16In my experience,
38:27the key thing for a victim's family
38:28is to get a fair and thorough investigation.
38:32Justice may be one result of that,
38:35but that's for the court to make a decision
38:39as to what will happen.
38:41The evidence in this case is very strong.
39:01He's driving his rib impaired,
39:03taking no account of the conditions,
39:06not adopting a safe speed,
39:08and the outcome of that,
39:11unfortunately, was the tragic death of David.
39:24The failings by Morgan Smith were very significant.
39:29You have to be held to account for it.
39:31It's going to be quite a tricky sentence for the judge.
39:44He's a young man.
39:46I hope there's a sufficient sentence
39:49that it's going to discourage others
39:50from behaving in the way that Morgan Smith did.
39:54When you're working on a case that's had a fatality,
40:07you're always conscious
40:08that there's a great many people
40:09being affected by it,
40:12family and friends.
40:14It's a tragedy for everybody.
40:17This sort of behaviour won't be tolerated
40:20and will be prosecuted.
40:22I hope the sentence Morgan Smith gets
40:28recognises the harm he's done
40:30and ensures David Horne's death isn't in vain.
40:41A boat skipper has been jailed
40:43for causing the death of his passenger
40:45after a collision in Poole Harbour.

40:51for the gross negligence manslaughter
40:53of David Horne.
40:59One of the hardest things
41:00as an investigator
41:01when you're dealing with fatality
41:03is often that a lot of them
41:04are just unnecessary.
41:06If people had done their job,
41:08had been careful in many instances,
41:10it wouldn't happen.
41:11I'm conscious that when we move on
41:15to another case,
41:16that the Horne family
41:18will still be living with this.
41:21And I hope they have managed
41:23to find some form of closure
41:24at some stage.
41:25the Horne family
41:26of the God
41:28of the Holy Spirit
41:42and who does not happen
41:44as we're here
41:45in the same way.
41:46I'm conscious of that
41:47and what you'll be doing
41:48is it's very important
41:49to our friends
41:50and to our friends
41:51and to our people
41:52of the people
41:53who have had been
41:54David was a happy young chap.
42:24He got to a national level in sailing in the UK, and it was always his ambition, once
42:31he'd finished his professional qualifications in accountancy, that he was going to go and
42:35travel and see the world.
42:40David's death had a massive impact on us.
42:44It's an experience that you can't put into words.
42:49One moment he's with us, the next moment he's gone.
42:51This is just such a wrench.
42:56I've never worked full-time since.
43:03Even now, it's difficult to talk about it.
43:09What my wife and I were hoping after what's happened to us was that nobody goes through
43:16the same scenario again.
43:18And this is all because people didn't follow basic safety requirements.
43:24And all we hope is from David's death, people learn that cutting these sort of corners,
43:30the risk's far too high.
43:33Morgan should not have been driving that boat.
43:36If we'd have only made sure everybody had life jackets on, there's a good chance David
43:41may still be with us.
43:43Just looking at the possible transfer and it's pretty cladded.
43:56One of the crew members has suffered an amputation of the leg.
