When friends find Brad McGarry shot to death in the basement of his Bellaire, Ohio home, evidence suggests a robbery. When detectives learn that Brad was an openly gay man working in the dangerous world of coal mining, a more complicated motive emerges.

00:00This was
00:29a targeted event.
00:34The killer was laying in wait for him.
00:37There's all kinds of reasons
00:38to kill somebody,
00:39but really, you get down to it.
00:41It's money, it's sex.
00:45And nine times out of ten,
00:47whoever killed you,
00:48someone would have loved you
00:49at some point.
00:599-1-1, where is your emergency?
01:16Hi, we have an emergency.
01:19Okay, what's going on?
01:21Oh, my God.
01:22My husband's friend is dead.
01:24Did you say he's dead?
01:26I think so.
01:28He's on the floor.
01:29There's blood everywhere.
01:30I'm going to throw up.
01:32What is his name?
01:33Oh, my God.
01:35Brad McGarry.
01:36Listen, I need you and your husband
01:38to back out of the residence
01:40and wait outside for the officers.
01:42Do you hear me?
01:42I was just general patrol
01:47in Bel Air.
01:49When I got the call,
01:50I went out there immediately
01:52and responded.
01:55The first thing I see
01:56is some people,
01:57David Kenny and his wife.
02:00I talked to David,
02:01and he told me what happened.
02:04Once you go from the beginning,
02:05how are you coming about
02:06coming out here?
02:07I just talked to him.
02:08He had a wedding last night.
02:10He said, you guys come out whenever.
02:11And I called him.
02:13He didn't answer.
02:14And I told my wife,
02:15I said, let's just go ahead
02:16and go out there.
02:20He said that he, his wife,
02:22and their daughter
02:24had brought Brad McGarry a gift
02:26and that when they got there,
02:29Brad wasn't coming to the door.
02:31My daughter knocked on the front door.
02:33I told her, I said,
02:33go knock on the back door.
02:35I went up right behind her.
02:37They noticed that the door
02:38was slightly ajar.
02:39I noticed that the kitchen
02:42was scattered.
02:42There was stuff all over there.
02:43I told my wife,
02:44I said, Sherry,
02:44something's wrong.
02:47They noticed that the house
02:48was ransacked.
02:50So Sherry Kenny had,
02:53David Kenny get his gun.
02:55And we went in,
02:57and I yelled for him.
03:00And that's what he said,
03:01you two stay here.
03:05He went down the basement.
03:06And then he yelled,
03:27call 911.
03:29I'm trying not to freak out.
03:30I'm sorry.
03:31I can't not to tell you,
03:33I'm not supposed to see that.
03:40He was highly upset.
03:42And they had her daughter with him.
03:45You know,
03:45they were all,
03:46three of us were very upset.
03:48I did go in,
04:11in the basement area.
04:12It had a lot of articles
04:14and clutter in it.
04:17And then I seen Brad McGarry's body.
04:22Brad's body was laying face down
04:24near a hot tub
04:25that was in the basement.
04:30We found some blood evidence.
04:35So we had to collect that.
04:38We did find a bullet fragment
04:40that we believe was
04:41a part of the incident.
04:43We collected that as well.
04:46The fragment was a smaller caliber gun.
04:49It would be high probability
04:51we're looking for a .22 caliber gun.
04:55There was talk
05:08that, you know,
05:10could it possibly be a suicide?
05:12So we searched the basement
05:15extensively for a firearm.
05:17I don't see a firearm.
05:19They flipped him over,
05:20they didn't see a gun.
05:22And that's the case.
05:23It wasn't no suicide.
05:25We found no weapon
05:26around the immediate area.
05:28At that point,
05:28we know that we're dealing
05:29with a homicide.
05:33Through the course
05:34of our investigation,
05:35we learned that Brad
05:37was at a wedding Saturday
05:38and Sunday he was
05:40at his family's house.
05:42We knew that Brad left
05:44his family around 2 p.m.
05:46He would have returned home,
05:49Blair, around 3 p.m.
05:51And we know that the Kenneys
05:53made the 911 call
05:54around 6 p.m.
05:55So we know that Brad was murdered
05:58sometime between 3 and 6 p.m.
06:02While we're processing the scene,
06:03the team went out
06:04knocking on all the doors.
06:06We canvassed the area
06:07where Brad lived,
06:08from the top
06:09all the way down,
06:12well past where it took place.
06:14We can check in
06:14and see if there's any cameras
06:16on that side.
06:17We try to figure out
06:17if anybody see anything.
06:19The neighbors that I talked to,
06:21nobody's seen anything
06:23out of the ordinary.
06:25We try to figure out
06:25if anybody's got any cameras.
06:27Do you guys have cameras on back?
06:29Chief Kovalec,
06:30who at the time
06:31was the chief of Blair P.D.,
06:33lived down the road from Brad.
06:34He knew Brad
06:35and he had an excellent
06:36security system
06:38that had a very good
06:39view of the road.
06:41That's something we had to look at
06:42to investigate the case further.
06:46In most murder cases
06:48like this,
06:49you find that the person
06:49that killed you
06:50is someone that loved you.
06:50So, we were very interested
06:53into Brad's romantic relationships
06:55and the Kinneys
06:57shed some light on
06:58Brad's relationship statuses.
07:11We learned that Brad
07:12was a homosexual man
07:13and David and Sherry
07:16told us at the scene
07:16that Brad had a
07:18kind of on again,
07:19off again boyfriend
07:20told us his name
07:22was Sean,
07:23didn't know his last name.
07:25Now, I want to find out
07:26everything I can about Brad.
07:28He was born and raised
07:29in the Ohio Valley.
07:31Found out that
07:32he used to be a hairdresser
07:33and then he became
07:35a coal miner.
07:36So, we're trying to
07:38identify anybody
07:39that was close to him
07:41that shed some light on this.
07:48I was friends with Brad
07:49for over 20 years.
07:51He was in his 40s
07:52when he passed.
07:54We met when he
07:56was a hairstylist
07:57in my town
07:58and the very first visit
08:00when I went to him
08:01we just automatically clicked.
08:03Brad was an only child
08:05and I was an only child
08:06so we had a lot
08:07of that in common.
08:09He loved his big hugs.
08:11He would always give me
08:12a great big bear hug
08:13and about knock me over.
08:15Even though he worked
08:16at one of the nicest salons
08:17in the area,
08:18he still just wasn't making
08:19where he wanted to be in life.
08:21So, he decided
08:23to become a coal miner.
08:25I met Brad when I first
08:27moved into our home
08:28in 2010.
08:30He came over
08:31and introduced himself
08:32and asked if he could
08:35let his dogs run around
08:37in my yard
08:37because the previous owner
08:39allowed him to do that.
08:41So, that's really how we met
08:43because he wanted
08:44to use my yard.
08:45He was very friendly
08:48and kind
08:49and funny
08:50just full of life.
08:52He was out
08:53and he was proud.
08:54It wasn't a secret
08:55with anybody.
08:57Back then
08:58if they would have
08:58had pride events
08:59he would have been
09:00at every single one
09:01leading the parade.
09:03That's just who he was.
09:15The murder of Brad
09:18was a big story.
09:20It was covered
09:21on all the local
09:23news stations.
09:24The call came in
09:25at 6.15 Sunday evening.
09:27They say 43-year-old
09:28Brad McGarry
09:29had been found dead
09:30on his basement floor.
09:33The day that Brad
09:34passed away
09:35it was like
09:36time stopped.
09:37I just didn't even
09:38have words.
09:39When I found out
09:40Brad was murdered
09:41in his basement
09:42I really didn't
09:44know who would
09:45do that to him.
09:46Why would anyone
09:47want to hurt Brad?
09:49Rumors are swirling
09:50that it was a hate crime.
09:52We learned
09:53Brad McGarry
09:54was gay.
09:54It was no secret.
09:56He was out.
09:57He had been
09:58a hairdresser.
09:59He became
09:59a coal miner.
10:01It was kind of
10:02an interesting
10:03dynamic.
10:05With Brad being
10:06a gay man
10:07and living in
10:08a small town
10:09in a small area
10:09like this
10:10he did have
10:11a little trouble.
10:14When we would
10:15be out somewhere
10:15sometimes
10:16you know
10:17somebody would
10:17yell a comment
10:18or something
10:19there was
10:20those good old
10:20boys that
10:21don't care
10:22for homosexuals.
10:23Did somebody
10:24specifically come
10:26to that house
10:26to assassinate Brad?
10:28We had to
10:29entertain at the time
10:30that this could be
10:31some type of
10:31a hate crime
10:32based upon
10:33his sexual orientation.
10:37So our next step
10:38is to figure out
10:39who hated Brad
10:40enough
10:40to kill him.
10:41As soon as we
10:50were working
10:51this case
10:51I had every one
10:52of Brad's friends
10:52that had known Brad
10:54for several years.
10:55I did go to the police.
10:57I wanted to help
10:57in any way I could.
10:59I just felt like
11:00they needed to know
11:01a little bit more
11:02about Brad
11:03to be able to
11:04make a better
11:06decision on which
11:06direction to go
11:07to look for somebody
11:08that would have
11:09murdered him.
11:09And I've seen
11:10a lot of stuff
11:11in the newspaper
11:12about it being
11:12a hate crime
11:13or whatever.
11:14He used to be
11:15really flamboyant.
11:17He was telling us
11:17about working
11:18at the coal line
11:19and I was like
11:19this is the last place
11:21I could ever imagine
11:22you working.
11:23I understand that.
11:23And he, uh,
11:25he's like, well,
11:26you know, working
11:26at the coal line
11:27with those guys
11:27down there,
11:28you know,
11:29they all know
11:29that he's gay
11:32and he
11:34didn't really
11:36get beat up.
11:37When Brad decided
11:46to go from
11:46a hairdresser
11:47to a coal miner,
11:48it was quite drastic.
11:50I wasn't sure
11:52how well
11:53that was going
11:54to go over for him.
11:55Being a coal miner
11:57is a hard job
11:58and I think
11:59that he
12:00kind of took
12:02that on
12:02as a challenge.
12:03You're going
12:04underground,
12:06you're going
12:06to work
12:06and it's,
12:08you know,
12:09hazardous
12:09and you've got
12:09to keep your head
12:10on straight
12:11with the dangers.
12:13And turned out
12:15he liked it
12:15and it was
12:16also a good
12:17paying job.
12:20Brad worked
12:20very hard
12:21in the coal mine
12:22so that he could
12:23become a foreman
12:25in advance.
12:27Brad definitely
12:28embraced who he was
12:29as a gay man
12:30but when Brad
12:31first started
12:31in the coal mine
12:32he did have
12:33some reservations
12:33about how
12:34he was going
12:35to be treated
12:35because they're
12:36usually menly men
12:37that are coal miners
12:39and once he started
12:40he wanted to be
12:41a little bit more
12:42somber looking
12:43so he took
12:44all of his little
12:45gold chains off
12:46and he put his hair
12:48down because he always
12:48has little spikies
12:49in his hair.
12:54We need to interview
12:55some of Brad's
12:55co-workers
12:56to see if
12:57there's anybody
12:58had issue
12:59with his sexual
12:59orientation.
13:00Some coal miners
13:02came forward
13:04we spoke to them
13:05got a statement
13:07but all in all
13:09from what
13:10we were able
13:12to develop
13:13from the investigation
13:14he was just
13:14a good guy.
13:16Turned out
13:16that everybody
13:17liked Brad a lot
13:18nobody had a single
13:20bad thing to say
13:21about him.
13:22As we're going
13:23through all these
13:23possible motives
13:24for Brad's killing
13:26now we're throwing
13:27out the sexual
13:28orientation.
13:29You keep coming
13:30back to somebody
13:33wanted Brad dead
13:34for a reason
13:35so we've got to
13:36try to find out
13:37what that reason is.
13:43I attended
13:44the autopsy.
13:45Once the body
13:46arrives at the
13:47doctor's office
13:47the clothing
13:48will be removed
13:49and bagged up.
13:50The good news
13:51was we found
13:51Brad's phone
13:52so we were
13:53pretty excited
13:54to get into
13:55Brad's phone
13:55hoping it'd
13:56have a lot
13:56of things
13:58that would
13:58help us
13:58our investigation.
13:59Fortunately
14:00we couldn't
14:00get into it.
14:02The phone
14:02was sent
14:02off to a lab
14:04to retrieve
14:05the information
14:06on it.
14:08At the autopsy
14:09the medical
14:10examiner
14:10did note
14:11some bruising
14:12to Brad's face
14:13he believed
14:14could have been
14:14from some type
14:15of blunt force
14:16trauma.
14:18Medical examiner
14:19extracted
14:20one small
14:21caliber projectile
14:22that we believed
14:23to be a .22
14:24caliber.
14:26The medical
14:27examiner
14:27determined
14:28that Brad
14:29was executed.
14:31His death
14:32was execution
14:33style.
14:34Someone put
14:35a gun
14:35right up
14:36to Brad's
14:36head
14:37and pulled
14:37the trigger
14:37twice.
14:41Shooting
14:41someone twice
14:42to us
14:43tells us
14:43I wanted
14:44this person
14:44dead.
14:47We searched
14:48Brad's house
14:49a couple times
14:50because it
14:50was a crime
14:51scene.
14:52Our crime
14:53scene unit
14:53processed a
14:54scene
14:54taking DNA
14:55samples
14:56taking fingerprints.
14:58When we went
14:59up to the upper
15:00level
15:00you know
15:01we took
15:02every room
15:03searched it.
15:04It looked
15:05ransacked.
15:06Some of the drawers
15:06were dumped out
15:07there was stuff
15:08on the floor
15:08stuff on the
15:09cabinets
15:09it was in a
15:11general state
15:11of disarray
15:12worth thinking
15:13hey
15:13could robbery
15:15be the motive
15:16here
15:16behind this.
15:17upstairs
15:19there was
15:20a 9mm
15:21pistol
15:21registered to
15:23Brad
15:23and that
15:25was a
15:25red flag
15:26because
15:27if you're
15:28going to
15:28steal
15:28and you're
15:29going to
15:30grab and
15:30dash
15:31that would
15:32be
15:32jewelry
15:33money
15:34and
15:34especially
15:37firearms
15:38it's a
15:38given
15:39it's gone.
15:41You know
15:41there's high
15:41dollar items
15:42laying around
15:42here
15:43that you
15:44know
15:44a thief
15:44could have
15:45easily
15:45took
15:45and made
15:46some money
15:46off of
15:46stuff
15:47laying around
15:48brand new
15:49in boxes.
15:50It just
15:51stuck in my
15:52mind
15:52you know
15:53that this
15:54was just
15:54too neat
15:55of a
15:56happening
15:56and I
15:58remember
15:58that I
15:59said
15:59something
16:00just
16:00doesn't
16:01seem
16:02right.
16:03You really
16:03ransacked
16:04three drawers
16:05open.
16:06The more
16:07that we
16:07looked at
16:08it
16:08the more
16:09everybody
16:10started to
16:11come to
16:11the opinion
16:13that this
16:13was just
16:13straight out
16:15staged.
16:19Once you
16:19go ahead
16:20with the
16:20theory that
16:21the crime
16:21scene was
16:21staged to
16:22throw us
16:22off the
16:23trail
16:23you've
16:24got to
16:24say
16:24what is
16:25the trail?
16:27Early
16:27on
16:28David
16:28Kinney
16:28and his
16:29wife
16:29Sherry
16:30on the
16:30lawn
16:30said
16:31they
16:32thought
16:32he
16:33had
16:33an
16:33ex-boyfriend.
16:34We thought
16:41that it
16:42would be
16:42entirely
16:42possible
16:43that this
16:43might have
16:44been some
16:45type of
16:45scorned lover
16:46type situation
16:47and that's
16:48when the
16:49house of
16:49cars start
16:49to shuffle
16:50a little bit.
17:04early on
17:05to further
17:05their
17:06investigation
17:06they were
17:07casting about
17:08for a
17:08person of
17:09interest
17:09and police
17:10always look
17:11at ex-lovers
17:12because
17:13sometimes
17:14they're the
17:14killer.
17:15The Kinney's
17:16told us
17:16about our
17:16on-again
17:17off-again
17:17boyfriend
17:18of Brad's
17:20named
17:21Sean.
17:22It was
17:22kind of
17:22a tumultuous
17:23relationship
17:24he kind of
17:25had a
17:26checkered
17:27past.
17:28They didn't
17:28know his
17:28last name
17:29but we
17:29were able
17:30to identify
17:30that person
17:31and we
17:32went to
17:32his house
17:33was met
17:34by his
17:34family
17:34and they
17:35said to
17:35hey
17:36he has
17:37violated
17:38his probation
17:38he's been
17:39in the
17:40northern regional
17:40jail for
17:41three weeks.
17:42Brad's
17:43ex-boyfriend
17:43it turned
17:44out that
17:46was a
17:46guy who
17:47engaged
17:48in a
17:48very brief
17:49fling
17:49with Brad
17:50and he
17:51had an
17:52ironclad
17:52alibi.
17:53He was
17:53in jail
17:54at the
17:54time.
17:55That takes
17:56him off
17:56the suspect
17:57table but
17:57as someone
17:58that was
17:59intimately
17:59close with
18:00Brad we
18:00definitely
18:01wanted to
18:01see if he
18:01could help
18:02us with
18:02the case
18:03and he
18:03did.
18:06When
18:06interviewed
18:07Sean
18:08in jail
18:08and he
18:09was
18:10visibly
18:10upset
18:11that
18:11Brad
18:12had
18:12been
18:12murdered
18:12when
18:14we
18:14asked
18:14about
18:14his
18:15relationship
18:15with
18:15Brad
18:15he
18:16really
18:16minimized
18:16it
18:17a great
18:17deal.
18:19We
18:19asked him
18:19who
18:20possibly
18:20could
18:20have
18:20did
18:21this
18:21he
18:22didn't
18:22come
18:22up
18:23with
18:23anything
18:24plausible.
18:28As
18:29we're
18:29interviewing
18:29Brad's
18:30friends
18:30and
18:30family
18:31we're
18:31learning
18:31about
18:32a man
18:32he'd
18:33been
18:33having
18:33an
18:34on
18:34again
18:34off
18:34again
18:34relationship
18:35for
18:35quite
18:35some
18:36time
18:36that
18:36was
18:37known
18:37as
18:37DJ
18:38no one
18:39knew
18:39his
18:40last
18:40name
18:40to find out
18:41who this
18:41DJ was
18:42maybe he knew
18:43something.
18:44I remember
18:45being out in my yard
18:46and Brad came home
18:49and he couldn't wait
18:50to tell me
18:50about this guy
18:52DJ that he had met
18:53at the mine
18:54and he
18:56really had a crush
18:58on him
18:58from first sight.
19:01He was a
19:01gentle giant
19:02and
19:03was
19:05very
19:06playful
19:06like Brad
19:08was.
19:09Brad and DJ
19:10had a relationship
19:12in the mine.
19:13They would see
19:13one another
19:14there
19:15and then
19:16started planning
19:17to see
19:18one another
19:18outside
19:19of
19:20the mine.
19:21their relationship
19:26was
19:27very
19:28secretive
19:28and
19:29on the
19:30down low
19:30but
19:31Brad did
19:32eventually
19:32share with me
19:34that DJ
19:35was married
19:37and there were
19:37children involved.
19:48They had had
19:50a long-term
19:50secret affair
19:52that DJ
19:53was unwilling
19:55to make public
19:56because he was
19:57married
19:58and had
19:59three stepchildren.
20:01From what
20:02I got
20:03from Brad
20:04DJ had feelings
20:06for Brad as well
20:08but he
20:09didn't want
20:10to lose
20:12his family
20:12and didn't
20:14want to cause
20:14them embarrassment.
20:16So where Brad
20:17wasn't really
20:18ashamed
20:18of his lifestyle
20:20DJ
20:21was.
20:31We found out
20:32that Brad
20:33and this DJ
20:34fought a lot
20:35over
20:36DJ not leaving
20:37his wife
20:38for Brad
20:38and it was
20:39a point of
20:40contention
20:40and that it
20:41was a kind
20:42of a rollercoaster
20:43type relationship
20:44which is exactly
20:45what we were
20:46looking for.
20:47But we had
20:48no clue
20:49of who DJ
20:50was at that
20:52particular time.
20:53We reached out
20:54to our contacts
20:55at the mine
20:55to try to find out
20:57who this DJ was
20:58and no one really
20:59knew who we were
21:00talking about.
21:00Sui, we're
21:18interviewing
21:18one of Brad's
21:19cousins.
21:19Sunday we went
21:20to Granny's.
21:21We were sitting
21:22around the table
21:22which is me
21:23and Brad
21:23and Heather
21:25which is another
21:25cousin.
21:26And she had
21:28told us
21:29that she was
21:30there when
21:31Brad received
21:31a text from
21:32this DJ
21:32and that Brad
21:34shared with her
21:34that he was
21:35going to hurry
21:36up and leave
21:36so he can go
21:37home and have
21:38a romantic
21:39encounter with
21:39this DJ
21:40at Brad's
21:41house.
21:53At that time
21:54DJ was
21:55a person
21:56of interest
21:57for the simple
21:57reason that he
21:58was married
21:58that he's
21:59leading a dual
22:00life.
22:02Two can keep
22:03a secret
22:03if one is
22:04dead.
22:13When Brad's
22:14cousin was
22:15interviewed
22:15she's the one
22:16that told us
22:17about Brad
22:19and his meeting
22:20with DJ.
22:22At this point
22:23of investigation
22:24this DJ's
22:25was shaping
22:25out to be
22:26our top
22:27suspect.
22:28We needed
22:29to aggressively
22:29try to figure
22:30out who this
22:30DJ was.
22:33And so
22:33one of the
22:34things that we
22:34were very
22:35interested in
22:35was Brad's
22:36phone.
22:36So if we
22:37get into
22:37Brad's phone
22:38it could be
22:38just full
22:39clues.
22:40But using
22:40Brad's actual
22:41cell phone
22:41to further
22:42investigation
22:43wasn't an
22:44option at the
22:45time.
22:45We had to
22:45send it
22:46away and that
22:47could take
22:48weeks
22:48to get
22:49back.
22:59The
22:59Kennys
22:59were upset
23:00about what
23:00was going
23:01on.
23:01Hi, please call
23:02my uncle, one of my best friends.
23:03After I was done talking
23:05with David, David shook my hand.
23:06He kind of pulled me
23:07into him and he's asking
23:10that we would do
23:10everything we could
23:11to find out
23:12who killed him.
23:16I told David we're going to
23:17need to talk to him
23:18in a day or so.
23:19And I called him up
23:20and he said he'd be right
23:21there and wanted to
23:22help.
23:22Question, our tech
23:25guy's here.
23:25I'm going to give him
23:26a call here in a second.
23:27Would you have any
23:28ideas about what
23:30Brad might have
23:30used for passwords
23:31on different things?
23:37Maybe his birthday.
23:41What he might have used
23:42to open his phone
23:43or Facebook or...
23:45If I had to guess
23:47it would be his birthday
23:48something to do
23:50with his grandmother
23:50maybe her birthday
23:52or something
23:54of that nature.
23:56That's really all
23:57I could honestly think of.
24:01You got your phone on here?
24:02Yes, sir.
24:03We asked David
24:03if we could process
24:04his phone
24:05because he had
24:07been one of the last
24:09people to communicate
24:09with Brad.
24:10We could use David's
24:11to narrow down
24:13our window
24:14for time of death,
24:15time of the murder.
24:17Listen, this is just
24:18standard paperwork here.
24:19But since it's your phone,
24:20it's your personal property,
24:21we've got to get
24:22your consent.
24:23Does that understand
24:24all right?
24:24Yeah, that's fine.
24:26While we're processing
24:27this firearm,
24:28he seemed very upset.
24:32I'm sorry.
24:34It's okay.
24:37Hey, first...
24:38Huge being a crime.
24:39It's all right.
24:40I've just been trying
24:41so hard to...
24:45Okay.
24:46While he's talking
24:46and being interviewed,
24:48at the same time,
24:49the phone's being researched.
24:51Let me get you
24:52some paper towels, okay?
24:53All right,
24:54and we'll be right back.
24:55I'll put a glass of water.
24:56Yes, sir.
24:56All right.
24:57Be right back.
25:00Yeah.
25:07There were some
25:08texts
25:08and some pictures
25:11in the phone
25:11that were deleted,
25:12but it really
25:13didn't go away.
25:14With the right
25:15equipment,
25:16it's brought up.
25:17David, there's some...
25:23There's some stuff
25:25on your phone
25:26that's a little...
25:27A little questionable
25:30here.
25:30Yes, sir.
25:32What...
25:32What, uh...
25:33How close were you
25:35and Brad?
25:36Very close.
25:37How close were you guys?
25:39We were very close.
25:40To Von Brink?
25:41My best friend.
25:43Did you guys
25:43have sex together?
25:45David's phone
25:50showed us
25:51that he and Brad
25:52were involved
25:53in a sexual relationship.
25:57When's the last time
25:58you raced
25:59everything with your phone?
26:04There's conversations
26:05like with Brad,
26:07like he would be like,
26:08oh, my God,
26:10this is...
26:11You guys sexed?
26:13When Ryan Aller
26:15was asking David Kinney
26:16if they were involved,
26:18had a relationship,
26:19David, at first,
26:21he was hesitant.
26:23And it took a while
26:24to get him to admit
26:24that they were
26:25sexual partners,
26:26but he did so.
26:28It kind of sounds like
26:29you and Brad
26:30were boyfriend, boyfriend.
26:32Oh, no, sir.
26:32We weren't boyfriend, boyfriend.
26:34It was...
26:35He left in the middle
26:37of dinner
26:37to go run
26:38because he's like,
26:39I'm gonna go
26:39take a nap
26:40with DJ.
26:42They call you DJs as much.
26:46We learned that
26:48David Kinney
26:49was this DJ
26:50that Brad was so excited
26:51to leave the family event
26:53to meet up
26:54with Eddish House.
26:56To me,
26:57it was like,
26:57whoa,
26:58very startling.
26:59That opened up
27:00Pandora's box.
27:03When was the last time
27:04you guys did
27:05do anything together?
27:06Oh.
27:06Brad McGarry goes
27:17to family dinners
27:18with David.
27:20Brad McGarry goes
27:21on vacation
27:22with David
27:23and his wife
27:24and kids.
27:25They are considered
27:26best friends,
27:28but it's more
27:29than best friends.
27:30Yes, sir, I know.
27:37It's starting
27:38to look pretty messed up.
27:40It was definitely
27:40suspicious,
27:41but hey,
27:42this is a married man.
27:44Maybe he doesn't
27:45want his wife to know
27:46or doesn't want
27:46everybody to know
27:47his behaviors.
27:49So that doesn't
27:51necessarily mean
27:52that David killed Brad.
27:54I'm gonna go
27:55step out
27:56and look at
27:56some more of this stuff.
27:57Yes, sir.
27:58One of the key things
28:02developed
28:03was the messages
28:05on Sunday,
28:07the day that
28:08Brad was murdered.
28:10And the text messages,
28:11they're texting
28:12back and forth.
28:14And David said
28:15he was gonna meet him
28:16at the house.
28:17And the GPS
28:18put him right there
28:20at Brad McGarry's house.
28:23I'm confronting
28:23David about this.
28:25He said
28:25he did not
28:26go in the house.
28:27So you drove
28:28by his house,
28:29you didn't stop?
28:30No, sir.
28:31I drove by his house
28:32and he was not home.
28:33I put it in it.
28:33It's in my phone, sir.
28:35I swear to God.
28:35I know.
28:36Listen,
28:37you drove by,
28:37he wasn't home.
28:38How long were you there?
28:40I wasn't there that long.
28:42How long?
28:43I could,
28:43I don't know.
28:44This is,
28:45oh my God, sir.
28:47There were just
28:47little cracks
28:48in his story
28:49and they became
28:51bigger and bigger.
28:52David,
28:53go.
28:55Go.
28:55You guys
28:59really think
28:59seriously?
29:01I'm not going
29:01to tell you a thing.
29:02I'm going to tell you.
29:02I'm going to tell you.
29:03David, look at me.
29:04I'm going to tell you
29:05I know.
29:06I knew you had
29:07something to do
29:08with Rastell.
29:08How can,
29:09oh,
29:10what else could it be?
29:12Oh my God,
29:13oh my God.
29:15You know exactly
29:16when he was killed.
29:18Yes, sir,
29:19I know.
29:19You were there
29:20when he was killed.
29:21No, sir,
29:22I was not at his house
29:23when that man
29:23was murdered.
29:24At this point,
29:25we also had
29:26Chief Kabalik's
29:27surveillance footage
29:28out and had time
29:29to look through it.
29:31Here's David
29:32driving down the road.
29:34Here's Brad
29:35driving down the road.
29:38Here's David
29:39driving away
29:40from the road
29:41and Brad
29:42dead in his house.
29:43I need to tell you
29:52a little something
29:53about Belmont County.
29:54We don't get it
29:55right every time,
29:56but you know what?
29:57We give it hell.
29:59We have something
29:59happens.
30:00One of us happens
30:01to all of us.
30:02Brad was well liked.
30:04He had some friends
30:05that were cops.
30:06Yes, sir.
30:07He had some friends
30:07that were co-workers.
30:11She got the entire
30:12Blair's Police Department,
30:14the entire
30:14Belmont County Sheriff's
30:15Office,
30:16the state of Ohio,
30:18crime scene specialist,
30:19the best crime scene
30:20guy in the state of Ohio.
30:22He is the best.
30:24He showed up.
30:25They're going to put it
30:26together.
30:27We're going to put it
30:27together.
30:29And it's going to come down
30:30like a load of bricks.
30:32Yes, sir.
30:33And your life
30:34will never be the same.
30:36You want that
30:37to be where this stands.
30:41You need to tell me
30:42what happened.
30:42The truth.
30:43Is she starting to tell
30:44your wife what's going on?
30:45Or does she know?
30:46No, she doesn't know.
30:47You sure she doesn't know?
30:48Yes, sir.
30:50Brad had shared with me
30:51on two occasions
30:52that DJ's wife
30:54had found text messages
30:56on DJ's phone
30:58that she had seen
30:59and had thoughts
31:00that there was something
31:01more going on,
31:02but they made her believe
31:04that she is crazy,
31:05that she is just
31:06imagining things,
31:07she is blowing it
31:08out of proportion.
31:09Did David's wife find out?
31:12Is that a possible
31:12motivation for Brad's murder?
31:14We had to ask ourselves,
31:15did Sherry have something
31:17to do with Brad's death?
31:25Maybe, I don't know
31:26if your wife's involved
31:27with it or not yet.
31:28Okay?
31:29No, sir.
31:29We're going to find out.
31:30No, sir.
31:31She is not, sir.
31:33We're going to find
31:33this out very shortly.
31:34Yes, sir.
31:35Do you understand?
31:36Yes, sir.
31:36I'm thinking it was an accident.
31:38Was it an accident?
31:39Am I right?
31:40As I start to confront David
31:41with the things
31:42that we're learning,
31:43David's stories continue
31:44to justate, grow, and change,
31:47and you can watch it
31:48in his mind
31:48where like a light bulb
31:50goes off
31:50and he just lays
31:51the story out for you.
31:53Tell me what happened.
31:58Drop all this
31:59and just let it out.
32:03Brad deserves it.
32:04Brad's family deserves it.
32:06Your wife deserves it
32:07and your kids deserve it.
32:08They don't deserve it
32:08and know the truth.
32:09Yes, sir.
32:10Just tell me what happened.
32:17It's just hard, man.
32:18I know it's hard.
32:20It's hardest thing
32:20you've ever done.
32:21You telling me
32:22what really happens
32:23harder than what happened,
32:24I'm better.
32:25Because what happened...
32:30Brad didn't want me
32:31to leave my wife
32:32for a while.
32:32It's just hard, you know,
32:35when you're with
32:36like our situation,
32:38me and him.
32:40I love my wife
32:41and kids to death.
32:43I said, I'm done.
32:44I'm not doing this anymore.
32:46I'm done.
32:47Then what happened?
32:50Brad, uh...
32:51got real loud with me.
32:58It was kind of like
32:59up in my face.
33:02He had, uh...
33:03one of those little
33:09derringers.
33:11Okay.
33:13What happened?
33:13I'm going to pour the derringer out.
33:18Freaked out.
33:19It's okay.
33:19Freaked out, too.
33:21What happened?
33:22Next.
33:28It's okay.
33:31I'm this far.
33:31He had it in his hand.
33:37Just kind of like
33:38waving it at me,
33:39you know what I mean?
33:40Okay.
33:41Telling me, you know,
33:42you're up.
33:42I'm tired of you.
33:43I can't believe you
33:44my emotions this long
33:45and just to call it quits.
33:47Okay.
33:48He kept waving it at me
33:49and just grabbed it.
33:51Okay.
33:54What happened if you grabbed it?
33:58I pushed him.
33:59Okay.
33:59I showed up.
34:09David tells us
34:10he did shoot Brad
34:12because Brad became angry
34:13with him that he wouldn't
34:14leave his wife.
34:16He said,
34:18if you end all of this
34:19now, then I'm...
34:20I'm done with you forever.
34:23He said, that's it.
34:24I told him, I said,
34:25man, I don't...
34:26We can't just drop
34:28each other like this.
34:29I said, you're my best friend.
34:30I'm your best friend.
34:32That's when he said,
34:33you need to leave your wife.
34:36He said, this has been going on
34:37for too long.
34:37You need to leave your wife.
34:38I feel David was happy
34:41living two lives
34:43with his wife
34:45and Brad.
34:46And David shot Brad
34:47because he was going
34:48to expose him.
34:51David had to know
34:52that the truth
34:52was going to come out.
34:54Let's talk about your wife.
34:57She's got to know,
34:57but I mean,
34:59she's going to have
35:00to find a side.
35:00You want to tell her
35:01or you want me to tell her?
35:02It's up to you.
35:04He opted
35:05to be the one
35:06to tell her.
35:08So I let him do it.
35:10I'm sorry, Craig.
35:20That was cool.
35:22Listen to me.
35:23Please just let me talk,
35:24Sherry.
35:25Will you please let me talk?
35:26He flipped out on me.
35:29He grabbed the .22 derring shirt.
35:32Before he even did that,
35:33he slapped me around
35:34a little bit
35:34after I told him
35:35this was it.
35:37Okay?
35:38You are a kid.
35:39Listen.
35:42I can't even look at you.
35:46She appeared
35:47to be very distraught
35:49and kind of
35:51didn't really believe it
35:52at first.
35:53until you had
35:55an affair with him
35:56before.
36:01That was like
36:06dropping a bomb.
36:07She was
36:07upset at him.
36:09What the
36:11am I supposed
36:12to live
36:13to my life now?
36:15What are
36:16kids going to think?
36:23you and
36:24have kids
36:25through my
36:26whole world?
36:30Oh, my God.
36:34I was scared.
36:35What did you do
36:36if someone
36:36got you?
36:46Oh, my God.
36:49Me and our daughter
36:51are there.
36:51I know.
36:53I know.
36:53I know.
36:57The thing
36:57that upsets me
36:58the most on that,
37:00okay,
37:00if you bring
37:00your wife,
37:01fine,
37:01she's an adult,
37:02but to bring
37:03your innocent child
37:04that was so close
37:05to Brad McGarry
37:06and to see this
37:07and witness it,
37:08it's very hideous.
37:10Sweet.
37:11David tells us
37:20that after
37:20he shot Brad,
37:22he got rid
37:22of the murder
37:23weapon and
37:24he went back
37:25to his residence,
37:27spent time
37:27with his family,
37:28that he come up
37:29with the idea
37:29of taking the family
37:30with him
37:30to cover his tracks.
37:32He was doing
37:33all this
37:33to create,
37:35you know,
37:35the ultimate alibi.
37:41It was a shock
37:57to the whole community.
37:59There was a lot
38:00of mystery
38:00around who is DJ
38:02and then we learned
38:05that that was David Kinney.
38:07That was the man
38:09who stood on the lawn
38:10and pretended
38:11to discover
38:12his best friend
38:14and was crushed
38:15and was crying
38:16and saying,
38:17He's one of my best friends.
38:18Oh, my best friend
38:20and I can't unsee this
38:24and here,
38:26it was all a fake.
38:28I was really
38:29blown away
38:30by how he could
38:31have a double life
38:32like that
38:33and then just try
38:34to set up
38:35a crime scene.
38:37His children,
38:37his family,
38:38his friends,
38:39I'm sure they were
38:39absolutely floored
38:41to find out
38:41that he was in
38:43a relationship
38:44with Brad
38:45and I'm sure
38:46his wife
38:46was just devastated
38:47by it.
39:01Tension was high
39:02in the courtroom
39:03as the jury
39:04came back in
39:05and when the judge
39:06read the verdict,
39:07you can hear people
39:07in the courtroom
39:08gasp
39:09and start to cry.
39:11We the jury
39:11duly impaled
39:12and sworn
39:13find the defendant
39:14David Carl Kinney
39:15guilty
39:18of aggravated murder
39:20as charged
39:21in the indictment
39:21signed by all
39:2312 individuals.
39:25David Kinney
39:25was convicted
39:26of murder
39:27and sentenced
39:28to life in prison
39:30without the possibility
39:30of parole
39:31plus three years
39:32for using a gun
39:34in the commission
39:34of a crime.
39:35as he came
39:36out of the courtroom
39:37I locked eyes
39:38with him
39:38and it's just
39:39like he had
39:40no emotion
39:40no remorse
39:41for what he did.
39:50Finally
39:50justice will be served
39:53for Brad
39:55and pray
39:56and pray
39:56that during
39:57that time
39:58that David
40:00has
40:00enough time
40:03to think
40:04and reflect
40:06on everything
40:07that had happened.
40:10The community
40:11really
40:11came together
40:13on this.
40:14It would go
40:15to show you
40:16how respected
40:17Brad McGarry was.
40:20Being a gay man
40:21from a small area
40:22I could see
40:23where the police
40:24would think
40:24it was a hate crime
40:25but it was definitely
40:27a crime of love
40:28and betrayal.
40:30It was
40:31a needless murder
40:33to cover up
40:34a secret
40:36which ended up
40:37coming out
40:38not only to the wife
40:41but to the world
40:42and I can't imagine
40:44what she was feeling
40:47because she had suspicions
40:48and he was
40:50a close family friend
40:51but then for her husband
40:52to turn around
40:53and murder him
40:55that was devastating.
40:59There's no secret
41:00it's worth death.
41:02Death is so final
41:03you're never coming
41:04back from that.
41:05It's just not worth it.
41:13The basement
41:14had a family room
41:15where the kids
41:16would watch movies
41:16and that was their
41:18toy room for a while.
41:19The basement
41:19was where I did the laundry
41:21and just normal things
41:22like that.
41:23So I can't imagine
41:25anything else happening
41:26down in there.
41:27I was blessed
41:28to be part of him.
