MSC Akiteta II To Be Arrested For Its Sibling’s Debts

It's not every day that a ship gets arrested, but this ship will be arrested in India for its

sibling's deaths. Yes, that's exactly what's happening off the coast of Kerala, in a case

that's making waves across India's maritime and legal circles. After the Kerala High Court

ordered the conditional arrest of the cargo ship MSC Akiteta 2, the vessel was detained

at Thiravantapuram's Veringham boat. But here's the twist, it wasn't arrested for its own actions

but for the damage caused by its sibling vessel MSC Elsa 3. Owned by MSC Shipping Company,

both the vessels are a part of the same global shipping fleet. In May 2025, the MSC Elsa 3

sank off the coast of Alapuza while carrying six 43 containers resulting in massive environmental

fallout. In the weeks that followed, tiny plastic pellets called nurdles began washing up on the

beaches in Thiravantapuram. Experts called it a serious ecological crisis with long-term risks

to marine life, coastal ecosystems and human health. Citing this environmental disaster,

the Kerala government filed a legal case seeking Rs. 9,531 crore in compensation from MSC Shipping

Company. And the High Court's move to arrest MSC Akiteta 2 is a way to secure that compensation

by holding the company accountable through its assets docked in the Indian waters. This isn't

the first time that a ship has been held for its deaths. In June 2025, three cashew importing

companies also filed claims over their lost cargo. While rare, ships getting arrested isn't

uncommon in India. In 2020, Obama's flagged vessel was arrested in Mumbai over unpaid port

dues. In 2021, a cargo ship was detained in Chennai for damages caused in an oil spill.

But the case unfolding in Kerala is very different. Because of its sheer scale, its environmental consequences
