Dave & Chuck the Freak talk about a man who is suing the New York Public Library for $4.6 million because he was traumatized by working in a desk that was too small for him.

00:14library he worked there and he said they gave him a desk that was way too small for him

00:24and it has traumatized him oh yeah that's how i feel so he's suing for 4.6 million

01:21have to uh sit here with everybody it's uncomfortable i well i understand that but then maybe then maybe

01:26this isn't the job i need 4.6 million it seems unreasonable it seems quite unreasonable i don't

01:36william martin's tale began in october 2021 when he was told he had to work at the first

01:44floor service desk seen here at the library on fifth avenue in midtown he had to work at the lower

01:51part of the desk you see how tall that lady is she's only five six yeah this lady's kneecap

01:58yeah at the desk i can't work at this tiny desk uh this welcome desk features a staggered countertop

02:05with a roughly 12 inch drop and he said as a big man it was crampy why didn't he go to the

02:12taller desk because this is where he was ordered that's his workstation i mean okay comfortable if

02:20we put you dave at a tiny little desk yeah which basically i have been but like you i have to cross my

02:26legs in this direction in order to sit down your legs wouldn't even be able to fit underneath

02:30like if you had these keyboards that i deal with do you have keyboards underneath you don't have

02:35anything i have the where we plug our headphones into yeah side so it's we got this thing here

02:42what do you got down there there's one you can't like you can't stretch our legs oh yeah i know you

02:46have to go sideways i got a man spread towards lisa we're gonna have to yeah we need a lawsuit

04:20and i went to slide my chair in at this banquet and my knee hit one of the supports i didn't realize

05:15he said it was the way i was sitting at work

05:18that was the major contributor to it

05:20so when my back was a mess

05:23and and it was like just

05:24devastated

05:25uh i was in a chair

05:28that used to have arms

05:29and so the arms would stop me here

05:32and then i was like having to reach

05:35way over

05:37and so that's why my back was

05:38so did you have a hunchback for a while

05:40i did i did

05:41and also you uh could not get

05:43i could get hard

05:44i mean that's

05:47yeah that's my blood pressure

05:56when that happened

05:57my whole quality of work

05:59uh physical life

06:02they gotta bust those things out

06:04there's nothing even down there anymore

06:11they always every time something goes wrong

06:13they take a panel off

06:14i know they look

06:15but there's like they take a panel off

06:17to look at one little thing

06:18that's like the size of like uh

06:20you know a little box or something

06:22they could bust all that out

06:24so uh

06:25they're not going to this guy in new york

06:27that's suing

06:28um he said all i sought

06:29was a desk with appropriate accommodation

06:32given my larger physical attributes

06:35yeah

06:36his union eventually stepped in

06:38helping him get assigned to a different desk

06:40within the library

06:41but a couple years later

06:43he found himself in the same situation again

06:46a new director was brought in

06:47and they ordered him back to work

06:50at the cramped first floor desk

06:52things only got worse after he complained

06:55so he got a lawyer involved

06:57i would just break it

06:59he's probably so big

07:01that if he just got up real fast

07:03he might pop that whole top of the desk right off

07:05yeah

07:06the whole thing falls apart

07:07yeah like uh-oh i broke it

07:09a few months later

07:10he says he was falsely accused

07:11of sleeping on the job

07:13okay

07:14and later suspended

07:16prompting him to ask for a transfer

07:19and seek medical leave for depression

07:21well it's so boring

07:44claims his mental health has been damaged

07:48that he just trembles at the thought

07:50of going back to work

08:25claims the case is without merit

08:28saying we take employee accommodations

08:30and concerns with the utmost seriousness

08:32and we're dedicated to treating our staff

08:34across the library with fairness and respect

08:36so okay

08:37so he's asking for 4.6

08:39but realistically

08:40anything they gave him

08:42he'd be thrilled right

08:43like even if they were like

08:45you're not getting 4.6

08:46we're gonna give you
