00:00The ambulance that was supposed to save a life is still in a disaster.
00:16In Barangay Santa Ana in Taytay, Rizal, an accident occurred where a five-year-old boy was hit by an ambulance.
00:26According to the police, the boy followed his sister across the road when the ambulance passed by.
00:33But before the accident, the ambulance was hit by a mixer used in the road construction.
00:41The driver said that they came from a hospital in Quezon City and that they were expecting a patient.
00:48What does the law say about this?

00:56Atty., what does the law say if emergency vehicles such as ambulances can have a discretion?
01:03Well, the drivers of emergency vehicles, whether it's an ambulance, firetruck, or police car,
01:09they are not excused from the requirement that they should exercise diligence and care in their duties.
01:17Otherwise, it's ironic or in a sense, ridiculous that the one who should help save a life is the one who will be the cause of its disappearance.
01:27So, depending on the events and if there is a strong discretion,
01:32there may be cases of reckless imprudence resulting in physical injuries or in homicide.
01:38Reckless imprudence is punishable under Article 365 of the Revised Penal Code
01:42that makes crime inexcusable and very reckless.
01:50So, is there no excuse?
01:52Is it really reckless?
01:54Is the driver at fault?
01:56All of this will be looked at to find out if the driver should be punished or not.
02:02But the main point is, it is not automatic that there is no liability because this is an emergency vehicle.
02:08Of course, though, we need to remember that emergency vehicles have a special privilege
02:14under Republic Act 4136 or the Land Transportation Law.
02:19This is an exemption in speeding in case of emergency
02:23and the so-called right of way for police and other emergency vehicles.
02:28If you see an emergency vehicle coming,
02:32you should stop, stop and wait until these vehicles pass.
02:38It is really important to follow the rules and give way to emergency vehicles,
02:43especially ambulances and firetrucks.
