00:58Well, definitely, this is a case of kidnapping and serious illegal detention under Article 270 of the Revised Penal Code.
01:07Kidnapping and serious illegal detention is a serious case.
01:12But if the reason for this baby snatching is to sell the child or to earn money,
01:18there are additional cases under the Republic Act 10364 or the Anti-Trafficking In Persons Act.
01:25We often hear about this case in those who buy children instead of going through the right process of adoption.
01:33Many are looking for an infant or a baby snake,
01:36and there are also many who have a bad heart that kidnaps children to sell them.
01:42And it is not only the kidnapping of children that is included in the trafficking of persons.
01:46Sometimes, the parents really recruit their children to sell them.
01:52Sometimes, the recruitment in the streets or in informal settler communities
01:56or in hospitals and maternity clinics is really a disaster.
02:01This is an attempted child trafficking and it is against the law.
02:04But the kidnapping of infants is also a disaster because there is a market for it.
02:09Sometimes, even in social media, there are people who allocate babies for sale.

02:20What is the punishment for those who kidnap infants?
02:23Will the punishment be lighter if the infant is returned?
02:27Well, in the Philippines, kidnapping or kidnapping of a person, including infants,
02:32is a serious crime that violates the law.
02:35And if a minor is kidnapped, the penalty is reclusion perpeto to death.
02:40But we know that there is no death penalty.
02:42So, only reclusion perpeto or up to 40 years in prison.
02:47Under Republic Act 10364, the penalty is 20 years in prison and fine of up to Php 2 million.

03:05If the child is returned within 3 days from the kidnapping,
03:09the case can be reduced from kidnapping and serious illegal detention to slight illegal detention only.
03:16The prison reclusion perpetua will be 6 years and 1 day to 10 years only.
03:21If the child has already passed the period and was caught with a crime,
03:24the child can also be considered a mitigating circumstance of voluntary surrender
03:31and the sentence can also be reduced if the child is considered guilty.
