00:00The Court of Appeal has set aside a leave order granted to a Muslim convict who is challenging

00:07a Sharia Appeals Court's refusal to hear his application to renounce his faith.

00:12A three-member bench led by Justice Aziza Nawawi unanimously granted the appeal by the Attorney General's Chambers

00:19to revoke the High Court's decision last year.

00:22Aziza said the man's case centered on renouncing Islam

00:26and that civil courts have no power to hear renunciation cases.

00:30The 55-year-old man filed an application at the Shah Alam Sharia High Court in 2014

00:36seeking to renounce Islam after divorcing his wife.

00:39The Sharia High Court dismissed the application on October 7, 2019

00:44and instead ordered him to go for counseling.

00:47On October 17, within the 14-day period, he filed an appeal to the Sharia Appeals Court

00:53but failed to serve it on the Selangor Islamic Religious Council or MAIS

00:58within the prescribed period for service.

01:00His application was objected to by MAIS and struck out by the Sharia Appeals Court

01:05which prompted him to file for leave to commence judicial review proceedings in the High Court.
