00:00The Kuala Lumpur High Court has allowed a former manager's wrongful dismissal claim
00:06against Bank Negara Malaysia due to procedural unfairness in the domestic inquiry and appeal
00:11processes.
00:13Justice Ahmad Bache said Waikohila's dismissal violated the sacrosanct rules of natural justice
00:19as she was denied the right to be represented and heard prior to her termination.
00:24In a 23-page judgment, Ahmad said the flaws were so serious and profound that the court
00:29had to grant the plaintiff's suit.
00:32He said Kohila had been put in a disadvantaged position even before the inquiry as she was
00:37not given access to documents used during the in-house proceedings.
00:42Ahmad said Kohila was also denied the right to counsel and was not given a list of the
00:46bank's witnesses.
00:48On March 29th, Ahmad found the bank liable for wrongfully dismissing Kohila seven years
00:52ago, allegedly for misconduct following her involvement in political activities.
00:58She was accused of canvassing support for party socialist Malaysia in the 13th general
01:03election and conducting herself in a manner not befitting her status as a Bank Negara
01:07employee by participating in a public rally.
