00:00 Former Toronto Assemblyman Paul Yong was deprived of a fair trial when his accuser testified
00:08 against him behind a screen the Court of Appeal heard on Tuesday.
00:12 Yong's lead counsel Datuk Hisyam Tehpotek said the High Court had wrongfully invoked
00:17 Section 265A of the Criminal Procedure Code to protect the witness's identity.
00:23 He said the identity of Yong's accuser, who is the prosecution's 50th witness during the
00:28 trial, was already known to Yong and his family as she was working as a maid in their household.
00:35 In his reply, Deputy Public Prosecutor Mohamed Amril Johari said it was normal for a rape
00:40 victim to testify in camera in court without facing other parties except for the trial
00:45 judge.
00:46 Court of Appeal Judge Justice Hadharia Syed Ismail, who chaired a three-judge panel, remarked
00:52 that it was common for rape victims to testify from another location.
00:57 As they were traumatized, she said, they could not look at the accused persons.
01:02 The panel then fixed March 1 to deliver its decision.
01:05 On July 27, 2022, the Ipoh High Court found Yong guilty of raping his 23-year-old Indonesian
01:13 maid in a room of his house between 8.15pm and 9.15pm on July 7, 2019.
01:21 Fifty-four-year-old Yong was given a stay of execution pending his appeal.
01:26 He is currently out on a 30,000 ringgit bail.
