00:00 Attorneys acting on behalf of their client Calvin Lee filed a writ of habeas
00:05 corpus on Tuesday night consistent with when someone is detained beyond 72
00:10 hours without being charged. Initially Lee's attorneys said police
00:15 suggested he was being charged for gun possession after they alleged a Glock 17
00:20 was found on his person. However on Monday witnesses present when Lee who
00:26 also goes by the names Tyson and Sixtan was arrested. They challenged the
00:31 assertion and also called for the release of CCTV footage to substantiate
00:36 their claim. In response to the writ of habeas corpus the police have asked for
00:42 an additional four days that is until Saturday to keep Lee in detention as
00:47 they are now investigating him they say for charges under the anti-gang act. Lee
00:53 was detained on Saturday night after witnesses say eight jeep loads of police
00:58 entered the apartment complex on St. Paul Street searching and detaining him.
01:03 Police returned with Lee on Monday executing a search of his apartment.
01:09 Following heated confrontation with police four other people were arrested
01:13 during the exercise. Residents tell TV6 police raids have become a regular
01:18 occurrence on St. Paul Street as they were confronted with police even today.
01:24 Residents claim such action is more consistent with harassment than
01:28 preserving law and order. During the 2011 state of emergency scores of people were
01:34 charged under the anti-gang act but DPP Roger Gaspard was forced to intervene
01:40 dropping the charges against 53 men arrested and charged under the
01:46 legislation. Gaspard said then that there were no evidential basis to prosecute. In
01:53 2018 a settlement was reached for the state to pay over $400,000 to eight men
01:59 if they withdrew their claims for malicious prosecution for the time they
02:04 served while detained under the act in 2011. Lee was charged with four others in
02:10 2020 for gang-related activities. The anti-gang legislation was amended in
02:16 2021 and last year over 30 people were charged under the act.
