A conversation between newsroom speakers explores the ongoing developments around the detention and judicial custody of Caucus Chanta Party members amid protests in the national capital. Saurabh Das and Ashutosh Ranka were remanded to five-day judicial custody, while Abhijeet Dipke also faces potential judicial custody. Despite facing bailable charges where bail can legally be secured with ease, the party has opted not to move bail applications immediately. The discussion notes that this approach appears to be part of a larger political strategy and war of narratives centered around optics and social media messaging. The dialogue further examines procedural aspects, noting that judicial custody can be sought for up to 14 days by Delhi Police depending on the law and order assessment. Additionally, jail intake logistics indicate Dipke could be assigned to Mandoli Jail under Tihar's administrative jurisdiction based on alphabetical processing rules.

00:00But you know, Anshul, at the same time, if Abhijit Dipke is, we're speaking on October 17th now.
00:07Three days earlier, correct me if I'm wrong, is when Saurav Das and Ranka were, in fact, Ashutosh Ranka were
00:14sent into the five-day judicial custody.
00:16So then, there is a lot of developments coming in.
00:20Whether that judicial custody for Das and Ranka will be extended along with Abhijit Dipke also being sent to judicial
00:28custody,
00:28that will also remain to be the question.
00:30Because the protests clearly have not died down even after these people have been taken into distension.
00:37Protesters have still been running to beat Jantramantar, beat Central Delhi, all of these locations, scattered across these locations.
00:44And the movement has continued.
00:50Yes, one thing that needs to be understood is that it's just judicial custody.
00:54It's not a police custody, which means that the people are not in the custody of police.
00:59They have already been sent to jail.
01:01In general criminal cases, what happens when a person is sent to judicial custody,
01:07that actually means that the investigators have done away with their investigation or the part of the investigation that required
01:12their inputs.
01:13But in this case, since they have been sent for judicial custody,
01:16it is probably the easiest thing to go ahead and apply for bail of Saurabh Das and Ashutosh Ranka.
01:21And these are all bailable charges.
01:23These are not criminal charges that have been pressed against them.
01:25So, it is actually very, legally speaking, it is very easy to secure bail.
01:30So, completing the five-day judicial custody is in itself a surprise
01:34because the lawyers of the Kaukera Chanta Party could have easily moved the courts
01:37and they could have easily sought bail for both Saurabh Das and Ashutosh Ranka.
01:42Even today, if Abhiji Dipke is sent to judicial custody,
01:45then bail becomes the right of Abhiji Dipke.
01:48So, immediately after that as well, within the next few hours,
01:52if the legal team feels it's the right way to go ahead,
01:55they can also apply for bail for Dipke as well
01:57and he could be allowed to walk out freely within the next few hours
02:01or probably in the next 24 hours itself.
02:03But will that happen?
02:04That is something that remains to be seen
02:05because the manner in which the CGP has not gotten their other leaders out on bail
02:10definitely seems like there is a larger strategy that is in plan over here.
02:15So, it remains to be seen if at all, after the five-day custody that will end,
02:19it is very unlikely that the custody would be extended
02:22because in such cases where there is not even a proper crime per se.
02:28So, the extent of judicial custody will not be extended by any imagination.
02:34By the rule of law.
02:34So, it is likely that after the five-day custody comes to an end,
02:37they will be allowed to let out naturally by the rule of law
02:40and by the powers that has been given to the executive magistrate as well.
02:45But yes, the larger question that remains,
02:47why hasn't bail been applied till now?
02:49And if at all Dipke is sent to jail,
02:50will the Kokrujanta Party actually try to secure bail for Abhiji Dipke as well?
02:55So, Anshul, one may actually look at this as perhaps,
02:59and as you have yourself mentioned,
03:02going by the legal stance here,
03:04these are all bailable offences.
03:06So, at this given point, the fact that an Ashutosh Ranka and a Sauravdas
03:10continue to be in custody
03:12is perhaps then more of a symbolic move on their part as well
03:17because there is strategies going on and ahead on every end.
03:21We, the political parties, even though they have called for a halt
03:25in the protests in the National Capital till the Sera,
03:28we still see them issuing statements,
03:30we still see them in smaller numbers at this given point
03:34across the National Capital gathering.
03:36So, there is a lot that continues to happen
03:38even when the protests are at a halt from their end.
03:41So, for the CJP leaders,
03:43perhaps at this given point,
03:44there is a bigger symbolic message
03:46that they can send from custody
03:48instead of bailing themselves out.
03:53Well, definitely, the CJP has laid up this entire issue
03:56and remember, the line that has been taken
03:59or the allegation that has come forth
04:01from the side of the Cockroachanta Party
04:02is that Sauravdas and Ashutosh Ranka
04:06were arrested for waving the national flag
04:08and it is on that line that their protest has gone ahead.
04:10In fact, yesterday, the march that was called,
04:12again, was called specifically to,
04:16specifically to actually hoist the Indian flag.
04:20But remember, the issue that they had started with
04:24initially was the resignation of Yanesh Kumar
04:27but slowly that has shifted to the waving of flag
04:30or unfurling of the national flag.
04:32So, definitely, there is a lot at play.
04:34There is a lot more that meets the eye
04:36at this point in time.
04:37A lot of strategy, a lot of thinking
04:39is going into each and every step
04:41that is being taken
04:42because, as I mentioned,
04:44if we speak logically,
04:46if we look at things logically
04:48from a neutral standpoint,
04:50definitely, if there was anyone else
04:53who had gone inside the jail
04:56or would have been sent to judicial custody
04:57for the charges that have been pressed
04:58against Sauravdas and Ashutosh Ranka,
05:02then definitely that person
05:03would have gotten out on bail
05:05within a matter of hours
05:06or probably in a matter of 24 hours.
05:09But in this case,
05:09the CGP has not decided to go ahead
05:12and take that step
05:12which definitely shows
05:13that there is a larger strategy at play.
05:17This is a war of optics.
05:19This is a war of narrative
05:23that is being fought.
05:24We have spoken about it
05:26as to how the Delhi police
05:27is also trying to build a narrative
05:28for themselves,
05:29how the CGP is also trying
05:30to build a narrative.
05:31So, a war of narrative,
05:32a war on social media
05:33is something that is happening
05:34and that could be one of the
05:35strategies as to what has been utilised
05:38by the Kokhrun Janta Party
05:39and that could be speculated upon as well.
05:43Absolutely, Anshul.
05:44So, coming back to Deepke,
05:47if indeed he is sent
05:48to judicial custody today
05:50like his other co-conveners,
05:52what's the time period,
05:54the exhaustive time period
05:56in this case
05:56that he could actually
05:57be sent in for?
05:59And, again,
06:01will he also be perhaps
06:02sent to Tihar itself?
06:08Well, yes,
06:09the maximum sentence
06:10or the maximum duration
06:12at one go
06:14on which a person
06:15could be sent
06:15in judicial custody
06:16is 14 days,
06:17two weeks.
06:17But, in different cases,
06:19the Delhi Police
06:20sees that
06:21as on a case-to-case basis.
06:23So, if at all,
06:24they think
06:24that a two-day,
06:26three-day judicial custody
06:27would be enough
06:27as Abhiji Dipke would be
06:29kept bound down,
06:30he would remain
06:31inside the jail
06:31and by that point,
06:32the protests might subside
06:34and the situation
06:34might get back to normal.
06:35So, yes,
06:36it is now
06:37the entire peregrative
06:37of the Delhi Police.
06:38If at all,
06:39they feel
06:40they can get
06:41the maximum custody
06:42of 14 days
06:43or they can ask
06:44the court to send
06:46Abhiji Dipke
06:46to judicial custody
06:48for a maximum period
06:49of 14 days
06:50at one go
06:50and that is something
06:51that could be done.
06:52That is the exhaustive limit
06:54which is in their hands.
06:55But, yes,
06:55the Delhi Police
06:56will take a decision
06:57based on this entire case
06:58as to in how many days
06:59they feel
06:59that if at all
07:00Abhiji Dipke
07:01is not on these streets
07:02then probably
07:02the law and order situation
07:04and the protests
07:04could subside
07:05in the New Delhi area.
07:06So, that is their decision.
07:08Now, the second question
07:09if at all
07:09he will be sent to Tihar
07:10it is likely
07:11he would be sent
07:12to a jail
07:13but since the admission
07:16into these jails
07:17happen according
07:17to the alphabetical order
07:19so generally
07:20the person
07:21whose name starts with A
07:22actually goes to
07:23the other jail
07:23of New Delhi
07:24that is Mondoley jail
07:25however the jurisdiction
07:26remains within
07:26the Tihar jail itself.
07:28So, technically speaking
07:29he would be shifted
07:30to Mondoley jail
07:31but yes,
07:32it is likely
07:33that he would be sent
07:34to judicial custody
07:34even in the next few minutes itself.
