00:01The Johor Bahru High Court has ordered China-owned developer
00:04R&F development Sindirian Berhad to pay 84 Princess Cove condominium owners
00:10a total sum of RM10.57 million for late delivery of their homes.
00:15High Court Judge Wong Miling ruled that R&F's amendments to the sale
00:19and purchase agreement without buyer's consent were invalid and breached the agreement.
00:25The amendments split the project from one phase into two.
00:28While Wong rejected the developer's argument that amended building plans justified the delay.
00:33The owners, who sued in 2018, were each awarded RM35,000 to RM196,000 for late delivery
00:41and another RM6,900 to RM39,000 for delayed common facilities.
00:47Wong dismissed claims by another 39 plaintiffs who signed their agreements after the building plans were amended
00:53and ordered each to pay R&F RM10,000 in costs.
00:57The court also ordered refunds of maintenance charges paid by the 84 owners before the November 2018 completion date
01:04stated in their agreements.
01:06However, Wong rejected claims for exemplary and special damages
01:10after finding no evidence that the plaintiffs had suffered those losses.
01:14The owners had obtained summary judgment in 2021, but the case later went to a 10-day trial in 2024
01:22after the Court of Appeal allowed R&F's appeal.
