00:0263-year-old Darryl Valroy-Young has pleaded not guilty to three charges of murder and
00:08one of attempted murder.
00:10Mervyn Schwartz, Marie Schwartz and Graham Tye were killed at a cattle station west
00:15of Bowen in 2022.
00:17Ross Tye was also shot but survived.
00:20In closing statements, the defence told the jury the wounded son and brother, Ross Tye,
00:25was not truthful or reliable.
00:27It's alleged the shooting took place over a cattle dispute between the two families,
00:32with Mr Young arranging the meeting.
00:35Defence lawyer Anthony Kimmons said Mr Young had an alibi and was not at the gate at the
00:40time the family was shot.
00:42He suggested Ross Tye could be the shooter.
00:46Why would the murderer let Ross Tye go, he said?
00:48It seems to remain one of life's great mysteries, unless the murderer was, in fact, Ross.
00:54However, Crown Prosecutor David Nardone told the court Ross Tye was a credible witness and
01:01was supported by circumstantial and direct evidence.
01:05He said .30-30 calibre bullets found at Mr Young's home were used in the same gun which
01:10killed the family.
01:11He said Mr Young creates accounts in what I would suggest is a desperate and untruthful
01:17attempt to explain the weight of the evidence against him.
01:21Simply, he lies.
01:22He told the court the suggestion that Ross Tye murdered his family defies the totality
01:28of three weeks of evidence.
01:30The prosecutor told the jury that the absence of forensic evidence linking the accused to
01:35the crimes did not exonerate him, but rather other evidence made up for it and pointed to
01:41his guilt.
01:42The jury is expected to begin deliberations tomorrow.
