00:05Out Front tonight, we begin with the breaking news.
00:07Biden has a jury.
00:09The 12 jurors who will decide Hunter Biden's fate
00:11have all been sworn in.
00:13They have been given their instructions.
00:15And we are now just hours away from opening statements
00:17in Biden's federal gun case,
00:19where he's accused of lying about being on drugs
00:21when he bought a gun.
00:23The judge wasting no time,
00:25saying her courtroom operates five days a week.
00:27Opening statements are scheduled for tomorrow morning.
00:30And tonight, we do have new details.
00:31Leaning forward, looking at the jurors and the judge.
00:34First Lady Jill Biden sat one row behind her stepson
00:37and was there all day.
00:39The significance of this moment actually can't be understated.
00:42Think about last week, right?
00:43Days after a jury ruled that the first former president
00:45in American history is a convicted felon on 34 counts,
00:49a jury is now hearing the case
00:50of the child of a sitting president.
00:52And that is the first time
00:53that any president's child has been on trial.
00:56These, of course, are precedents nobody wants to see set,
00:58but yet here we are.
01:00And this case could have major implications
01:01for the election.
01:02Biden's family personal laundry
01:04is about to be thrust into the spotlight.
01:06Prosecutors are expected to go into detail
01:09into the salacious side of Hunter Biden's past.
01:12Potential witnesses will include
01:14a number of Hunter Biden's exes,
01:16we are told.
01:17Among them, Beau Biden, his brother,
01:20his widow, Hallie, whom Hunter dated,
01:22Hunter Biden's own ex-wife,
01:24and multiple ex-girlfriends
01:25who will testify to his drug use.
01:27It is important to emphasize
01:28that this case is being brought
01:29by President Biden's Department of Justice,
01:31which chose not to charge Trump
01:33in his Stormy Daniels hush money case.
01:35But as for President Biden himself,
01:37he was silent today.
01:38Obviously, he was not there.
01:39He released a statement that reads in part,
01:42as a president, I don't.
01:43And we have history being made
01:45in both of the cases
01:46that we've been following in these recent weeks
01:48and not history that anybody really wants to see.
01:50But yet here we are.
01:51Evan, thank you very much.

01:54Let me start with Mark Amara tonight.
01:55So, Mark, the jury that Evan's going through, right?
01:57This is crucial.
01:58This jury, at the face of it,
02:00we know six men, six women.
02:01The majority of them are African-American,
02:03as Evan just laid out.
02:05You've got a woman who said
02:06she's lost many friends
02:07to drug addiction on the jury,
02:09gun owners on the jury,
02:11one who believes people who smoke pot
02:12should be allowed to own firearms.
02:14And obviously, Hunter Biden purchasing a gun
02:17while under the influence of drugs
02:20is at the center of this case.
02:21So, when you look at this jury, Mark,
02:23what do you see?
02:24And Ryan, that is true.
02:26I mean, I lived in Delaware for years
02:28and it is Biden country.
02:30I mean, there's no one there
02:30who doesn't have some sort of a link or a tie.
02:32It's an incredibly small state as well.
02:34So, does that just mean any jury here
02:36is by nature going to be,
02:38in some sense, pro-Biden?
02:41I think that's right.
02:42It has to tilt pro-Biden.
02:43So, that's what looms over this.
02:46And I do think that that means
02:47it's very difficult for the prosecutors.
02:48But if, in fact...
02:50The case itself,
02:51where it seems it should go.
02:53Terry, first of all, though,
02:54you know, there's this issue of Delaware.
02:55One woman said,
02:56and I think this jury did not get put on,
02:58but I'm not sure,
02:59but I live in Delaware.
03:00You can't swing a cat
03:01without hearing something.
03:03The colloquialism of the area.
03:05But just, you know, think about it.
03:06Texas is 134 times bigger.
03:09Manhattan,
03:09which is where Trump's jury was selected from,
03:12is 1.6 times bigger
03:13than the entire state of Delaware.
03:16You know,
03:17how does this jury compare
03:18to the jury we just saw last week
03:21give a verdict in the Trump trial?
03:22Well, you know,
03:23there is a conviction.
03:24It means they followed the facts of the case,
03:26the evidence that was put in,
03:27and they followed the law.
03:29And they all said they could do that.
03:30And the evidence that we have thus far, though,
03:32the way it's been presented,
03:33and maybe there's more complexity that I'm missing,
03:35but that he bought a gun
03:37while under the influence
03:38while he was addicted to drugs.
03:39And the reason that this is sort of a fact
03:41is because he said it so in his book.
03:43He wrote about it.
03:44So it sort of seems in that sense
03:47that basic part here
03:48is already established?
03:49Very much so.
03:51And that's not what happened here.
03:52So I think that's a mountain of evidence
03:53he's stacked up against him.
03:55And so, Mark,
03:56that you're also going to hear
03:58from his ex-wife,
04:00his brother's ex-wife,
04:01who Hunter Biden also dated
04:02after his brother passed away,
04:05other ex-girlfriends.
04:07What does all of this add?
04:09I mean, what Ryan's laying out here
04:10is pretty simple.
04:11Great.
04:12And so this case, Terry,
04:13could move very quickly.
04:15And, you know,
04:15I wasn't being snarky at the top
04:17when I said the judge says
04:18this is going to be five-day court,
04:19but there was a message in that, right?
04:21In other words,
04:21there's no Wednesdays off,
04:22there's no we're giving off every Friday
04:24because a juror has a flight.
04:25This is going to be beginning,
04:27middle, end,
04:28possibly very quickly.
04:29It will go quickly.
04:30She does indicate it.
04:31And we know that the judge
04:32did a lot of pretrial rulings
04:34as to what's going to come in
04:35and what.
04:35There was a lot of family around him,
04:37right?
04:38His wife, right?
04:40The day Eric Trump came in,
04:41the first day,
04:41Terry and I were both in the courtroom.
04:43That was the eighth day of testimony
04:45when Keith Davidson was there
04:46and after days before that
04:48of jury selection, right?
04:49So it took a long time
04:50for family to come in for Trump
04:51and for anyone really to come in.
04:52It was a lonely place for him.
04:55What's the significance
04:56of the family presence
04:57for the jury?
04:58I think it sends a strong signal
05:00to the jury of sympathy
05:02for the defendant
05:02and especially a defendant
05:04that went through drug addiction.
05:05You've also got other cases, though.
05:07September, Los Angeles,
05:08another case for Hunter Biden, right?
05:10That's tax evasion,
05:12false tax returns,
05:13and that gets you even closer
05:14to the election
05:15on the potential impact
05:16if there is one
05:17of Hunter Biden verdicts
05:18on his father's case.
05:20Which trial do you think
05:21is a bigger threat
05:22to Hunter Biden, though?
05:23The tax evasion one,
05:25false tax forms in California
05:26or this gun charge
05:28in Delaware.
05:29Definitely going to jail
05:30on the other one
05:30if convicted, Ryan?
05:32I think so.
05:34Yeah, I think he's
05:34in a very tough situation
05:35that most people think
05:36he should have pleaded.
05:37And it's going to be

05:39the timing of that's
05:40going to put it right up
