00:06failed in her application to have the Federal Court review a decision on the recusal of a judge
00:11who convicted her in 1.25 billion ringgit solar hybrid project case.
00:15The three-judge panel made the dismissal on Wednesday after finding that Rosma's application did not satisfy the threshold
00:22under Rule 137 of the Rules of the Federal Court 1995.
00:26They said the power to review a decision must be exercised very cautiously
00:31and that it would only be invoked where there was likely a serious injustice and non-effective remedy.
00:36They said the Federal Court must strictly control such application and cannot use this rule freely or as a general
00:42right of appeal.
00:43In March, Rosma failed in her final appeal in the earlier panel of the Apex Court
00:48to recuse Justice Mohamed Zaini Mazlan from presiding over her graph case and to obtain a retrial.
00:54The judge had convicted Rosma in her corruption trial involving the solar hybrid project in Serawak.
00:59The court found that the judge did not violate the judge's code of ethics following controversy over a leaked draft

01:30Rosma was sentenced to 10 years imprisonment on each charge and fined 970 million ringgit,
01:36in default 10 years imprisonment, in the solar hybrid case.
01:39The hearing for her main appeal to set aside her conviction and sentence has been fixed for a 16-day
01:44hearing beginning September 1st.
