The Federal Court has dismissed an appeal by the prosecution in Datuk Seri Najib Razak's judicial review application concerning a royal addendum that may allow him to serve his prison sentence under house arrest.

A three-judge panel chaired by Chief Judge of Malaya Justice Hasnah Mohammed Hashim unanimously made the dismissal on Wednesday (Aug 13).

00:22from pursuing access to a royal document that he says would allow him to serve his prison sentence
00:28at home. Najib, imprisoned since August 2022 for his role in the 1MDB scandal, has said
00:36that an addendum order was issued last year as part of a royal pardon by the then-king
00:41that halved the former premier's jail sentence from 12 years to six. Najib has since been
00:47seeking to confirm the existence of and execute the royal order. A three-judge panel chaired
00:53by Chief Judge of Malaya Justice Hasna Mohamed Hashim in a unanimous decision on Wednesday
00:59said it accepted the existence of the addendum order, but was not in a position to determine
01:04if it was authentic or truly issued as part of the royal pardon. The apex court ordered
01:10the case to be sent back to the High Court to be heard on its merits. In July, a lawyer
01:15for the Attorney General's chambers told the Federal Court he did not dispute the order's
01:22existence, saying that the government only sought to challenge the manner in which it was submitted
01:26for evidence.
