00:00First of all, I believe you have said that the weaponization fund is a moot issue.
00:05Is that your position?
00:07Yes, it is a moot issue, meaning there is no weaponization fund.
00:12The weaponization fund is dead.
00:13It's not moving forward.
00:15Well, I would refer you to the settlement agreement.
00:19Do you happen to have a copy of that in front of you?
00:21I do not.
00:23Okay, well, you probably know what's in it.
00:25I'm familiar with it, yes.
00:26I'm sure you are.
00:27On page four, this settlement agreement may be modified only upon the written agreement of the parties.
00:34Has there been a written agreement of the parties to modify the settlement fund?
00:38No, the settlement fund is just not moving forward.
00:41There's no modification.
00:42It's just it never started.
00:44No money went from the Treasury to any other account.
00:46There's no commissioners.
00:48It's not moving forward.
00:55I've talked extensively with you and other colleagues about potentially codifying so there's no weaponization fund, which is certainly something
01:06that could be done.
01:07And I wasn't meaning to insult this body, but just in response to questions from senators about whether that could
01:13be done.
01:13We very much are okay with that.
01:16But just to be clear, the President of the United States, who is a plaintiff in this lawsuit, has not
01:22agreed in writing to delete the weaponization fund.
01:26And there's no guarantee that he or one of the other plaintiffs might raise that issue by way of a
01:32lawsuit, a breach of contract lawsuit in the future.
01:36Well, Senator, the plaintiffs have no power over the fund.
01:40The fund was administered solely by the five commissioners and through the Department of Justice.
01:46So, no, they don't have any power with respect to the fund at all.
01:48I suppose they could bring a lawsuit and then we would litigate it.
01:53But even if we were litigating it, there's no fund.
01:55So the results of such litigation, whatever it would be, wouldn't be a revival of the fund.
