Here's what Indian law actually says about who inherits what after divorce and remarriage.

00:11Can a father remarry and cut off the children from the first marriage?
00:15Can a second wife claim everything?
00:17And does removing a child's name from nominations mean the child loses their share?
00:23Here is what the Indian law actually says.
00:29Recently, the Delhi High Court dealt with a dispute involving maintenance proceedings under Section 125 of the CRPC.
00:35The second wife wanted to be added as a party to the maintenance case which was filed by the first
00:41wife and her children.
00:42The court refused because maintenance proceedings are meant to deal only with the legal obligations between the husband, wife and
00:50children.
00:50The court said bringing a third party into these proceedings would unnecessarily complicate matters.
00:56More importantly, the court made one thing very clear.
00:59A husband's second marriage does not erase the legal rights of the first wife or the children.
01:05Under Hindu law, maintenance and inheritance are two completely different things.
01:10Maintenance or alimony is linked to the marital relationship between the spouses.
01:14Inheritance rights, on the other hand, belong independently to the child.
01:18Under Section 8 of the Hindu Succession Act, a child is a Class 1 legal heir.
01:23That means, if a parent dies without leaving a will, the child has an inherent right to inherit that property,
01:30regardless of whether the parents are married or divorced years ago.
01:35In simple terms, divorce ends the marriage, but it does not end the parent-child relationship in law.
01:41But what about the second wife?
01:43If the father legally divorces the first wife before remarrying, or the first wife is dead,
01:48the second wife is also a legally recognized Class 1 heir.
01:53That means, after the father's death, the property would be shared equally.
01:57The widow, the children from the first marriage, the children from the second marriage, and the deceased person's mother.
02:03Another major area of confusion involves nominations.
02:07Suppose a father removes the child's name from LIC policies, PF accounts, bank accounts or investments,
02:13and names the second wife instead.
02:16Does that mean that the child loses everything?
02:18Not necessarily.
02:20Indian courts have repeatedly said that a nominee is usually only a trustee or custodian, not the final owner.
02:26So, unless there is a valid will exclusively giving those assets to somebody specific,
02:32legal heirs will still claim their lawful share.
02:36The larger legal principle is the same.
02:38Children cannot be punished because the parents fell apart.
02:42Whether the parents are married, divorced or remarried,
02:45the child continues to remain a legal heir under the Indian succession law.
