00:14Being a homicide detective in the city of New Orleans, a stressful day at work, could
00:20mean having seen things that 99% of the population has never seen and will never see.

00:35There's a man shot by Chapitula.
00:38And like, I think that's Andrew.

00:44He landed on the ground.

00:50We have units on our way.

00:54All right, we're going to cut this traffic off and send it down that way.

00:58So, I get EMS to the intersection of Chapitula's in the area.
01:01We have one victim down.
01:04Person, gunshot.
01:06Couple to the body, one to the head.
01:09Hey, guys.
01:10There's lots of y'all stepping, all right?
01:11They got cases everywhere.
01:13They got a left man right here.
01:15They got a right homicide.
01:28The only information I have is a black man who was shot, about six caissons on the scene.
01:36And SUV apparently fled from the scene.
01:39A dark gray GFC Yukon just got information that the same SUV may have crashed somewhere in New Orleans East.
01:48This is the warehouse district.
01:51It's kind of mixed residential apartments and businesses.
01:55It's right outside of the Prince Quarter of New Orleans.
02:04As I'm walking into the crime scene, I notice immediately that there's just a large number of people in the
02:10area.
02:11It was the last night of Essence Festival, a three-day festival every year that we have around 4th of
02:16July.
02:17It brings in a lot of visitors to the city.
02:21In this case, the first responding officers were working in detail literally within probably 100 yards of where the homicide
02:27occurred.
02:29What's up?
02:32What do we have?
02:33We got one body?
02:34Yeah, one body.
02:35Okay.
02:38We had a deceased male on the scene.
02:42There's a lot of people there, but nobody wanted to come forward with what they possibly saw related to the
02:49actual homicide.
02:51So I knew that I was going to be relying on video surveillance evidence in the area.
02:56Ugly Dog has cameras.
02:58See, they have a camera right there on the side.
03:01All of the cases are over there by that Nissan, by the Ugly Dog.
03:06So I think he probably got shot over there and ran over this way.
03:09Yeah.

03:14It looks like the cameras were pointed in the direction where the murder took place.
03:18Unfortunately, the Ugly Dog is closed at this time, so I'll have to come back tomorrow.
03:23Any idea who the victim is yet?
03:25This is a guy named DeMond Foley.

03:33DeMond Foley is 36 years old.
03:35He's self-employed.
03:37He was out enjoying Essence Fest, but instead he was shot and killed.

04:01There were a number of shell casings.
04:04they all appear to be the same caliber those are definitely not a millimeter
04:11blood goes all the way over that in that direction yeah there's blood on the gun too
04:18there was a handgun that was in very close proximity to the victim
04:23at this point i'm not sure if that belonged to the victim or the perpetrator
04:49the magazine in that gun was at full capacity and there is a live round in the chamber the gun
04:57is a 40 caliber but the spin cases that are on the crime scene they're non-millimeter
05:04it's likely at this point that i'm looking for another gun
05:07the deputy that was black in the street right there he said he heard sick shot he waited a few
05:14minutes there was nobody around but he saw the door color and it should be the yukon coming from this
05:20way when it took the shot street right that's what was it okay did he see the shots coming from
05:25the
05:25yukon no no he just heard the shot he said there was nobody out here okay
05:31the gmc yukon denali was seen fleeing the crime scene by sheriff's deputies the tires were screeching
05:38that's a little suspicious so we want to know more about that vehicle
05:43yeah i contacted the rtcc and they gave me um video for the um denali
05:50and the vehicle was in this area at the time of the homicide okay
05:58so um they have people over there they want to know if the victim is somebody named penny penny yeah
06:04penny and i was asking them to describe penny and they showed me a picture of him i said what
06:10kind
06:10of car he's driving so he's driving on a denali um detective smith was approached by someone at the
06:19crime scene who is concerned with whether or not penny is the deceased victim i go over to speak to
06:28the
06:28gentleman how you doing man i'm detective ball who's me you okay what brought you out here like
06:36i will sleep i just got a phone call and they said that they saw him on instagram he was
06:41at the
06:41drug and they said that they thought that this was him okay what does he look like is that a
06:48recent
06:48picture yeah how recent uh about three weeks the gentleman shows me a photograph of penny
06:57it's not the deceased individual that's on the ground but i can't tell him that because i still
07:03want to get as much information as i can i then asked what penny's real name is um and he
07:10tells me
07:11it's alfred pennington alfred pennington yeah what kind of car does it drive oh you called an island
07:19what color is it oh you don't like i like really don't move hang tight i'm gonna come talk to

07:25in a minute okay he tells me someone named alfred pennington drives a dark color gmc yukon
07:33that matched the description of the vehicle scene fleeing the homicide scene
07:39so uh the rtcc gave me a plate on the vehicle it is a texas plate oh that's who it's
07:46registered to
07:46yeah they call it's right they call him to pennington they call him penny so they sort of
07:50called register to detective smith confirmed with us that the registered owner of the gmc yukon
07:57was in fact alfred pennington so he became a person of interest i wanted to use all right
08:11we got information that dark colored suv a yukon fled the scene at a high rate of speed heading
08:18towards the interstate and in new orleans east right after this shooting there is a dark colored suv with
08:27the same plate on it that crashed so we're going to be heading out there right now
08:42what did they get i mean it looks like the tire just blew out but i mean they probably hit
08:46something at some point outside of it's all chewed up yeah was anybody here any witness or anything
08:52when y'all got here that license plate matched the license plate on the vehicle
09:03that was fleeing the scene it belongs to alfred pennington so at this point i do have enough
09:10probable cause for a search warrant for that vehicle let's have it toad okay you get it put

09:38in processing the vehicle my goal was to find any evidence that's related to the crime scene like a gun
09:46and any identifying evidence on who was inside the vehicle
10:00if you could take the phone for sure and let's do dna exterior and interior door handles dna
10:12what i need at this point is a gun that i can link to the shell casings found at the
10:17crime scene
10:25no gun
10:30so far i've got really no evidence that alfred was actually in here
10:36i don't know at this point i still need to determine who was in that vehicle at the time
10:43the homicide occurred whether they were the driver or passenger okay thank you much i appreciate it
10:50i need to find the murder weapon and i need to find video that captures the murder without any of

11:27at this point i still need to determine who was in that vehicle at the time the offense occurred
11:33so we're heading to the ugly dog saloon which is a business that's located just outside
11:38of where the homicide occurred they supposedly have video of the entire offense so i'm anxious to see
11:47that video i am born and raised in the city of new orleans back in 1985 my grandfather was unfortunately
12:00murdered it was an armed robbery and since i was a child i've grown up wanting to be a policeman
12:09specifically homicide i was motivated by his case and i have had as long as i can remember
12:16a sense of wanting to just do my part in solving crime

12:31yeah the video from the camera that's right there have you seen it yet uh-huh okay so i'm looking

12:38a gray yukon denali that fled supposedly oh god this is a good video that's the denali huh
12:50yeah that's that's the yukon yeah
12:55it's like they're in between the two cars
13:09wow the video recording from ugly dog it is from a little bit of a distance
13:13in terms of being able to identify the shooter
13:18but i can hear the gunshot and the victim is seen running away and the shooter is
13:24seen chasing after the victim continuing to shoot as the victim eventually collapsed across the street
13:30i don't know at this point that the shooter is alfred pennington for sure
13:36but i do see the shooter get into the driver's side of the dark gray gmc yukon and flee
13:44having this video is great for the first time i'm able to see exactly what occurred
13:48what i need at this point is to be able to identify who that shooter is
13:52and who it was that was operating that gmc yukon
13:56that's the one angle okay and then i have the other one from behind looking down enunciation sweet
14:06so there's the suv right there that's the shooter come across the street then get in his suv okay
14:18here's the victim coming huh yeah right walking right there
14:24it goes around the front that is great video
14:34nice to know yep
14:38and then they're in between the two cars
14:50it looks like he had a distinct logo or emblem or something on his shirt front and back
14:57you see his shirt you're right he did hear something there
15:02so what i'm thinking i'm gonna go back here and try to video him walking and see if i can
15:06get him
15:08his face but yeah that's that's great
15:15the video is pretty cut and dry it definitely put everything into perspective there's still many
15:22unanswered questions at this point what occurred in front of the yukon was there a physical altercation
15:28was there a threat we collected a gun at the crime scene did the deceased victim pull the handgun out
15:35and pointed at him all i know about the gun is that it was stolen about a year ago that
15:40doesn't really
15:41tell us much the shooter he's got a pretty distinct shirt it's got some kind of logo on the front
15:47and back
15:47of it so i have a reference point on what to look for hopefully we get a good image of
15:53this face
16:13there is a man that just got shot and he is on the ground he's on the street on the
16:19side of his car
16:20the way is he's starting to look like he can't die oh my god

17:54I get a call from 5th District.
17:57They're saying that they're working a shooting.
18:00The two victims have been transported to the hospital.
18:02One of them was shot in the hip,
18:04but he's expected to survive his injuries.
18:07The other was shot in the chest area,
18:10and he passed away due to his injuries.
18:13His name is Stanley Williams.
18:16But to friends and family, he's known as Doody.
18:19He was in his 40s.
18:20He's from New Orleans.
18:22He grew up in this area.
18:31Once I walk through the tape,
18:33I'm able to see that there's our crime scene units.
18:36They're starting to cone certain things in the street,
18:39some casings that are on the sidewalk.
18:43I noticed that most of the scene seems to be around a Jeep
18:46that's parked in the middle of the block.
18:47It clearly has some kind of bullet damage to it
18:50on the driver's side, and its windows are shattered out
18:54on the passenger side.
18:56There was a witness who was on scene.
18:59Detective Walt Vedman is going to talk to the witness
19:01and see what we can find out about who did this.
19:06So what do we have on scene?
19:09We got the, this is like the surviving victim's clothes.
19:12We got six .40 caliber shell casings all over here.
19:16Oh, Walt said, the witness says the shooter is a guy named Dino.
19:21And he came over here and started arguing about some video the victim took of him
19:26on the victim's phone or something like that.
19:29And then Dino started shooting on him.
19:32Oh.
19:33Our witness was able to tell us that my decedent, Stanley,
19:36was sitting on the passenger side in the Jeep.
19:40There was some kind of argument happening between Stanley and the shooter standing on the passenger
19:46side of the car about some kind of video.
19:49The witness started hearing gunshots.
19:52He saw Stanley was shot, and the driver was also shot.
19:57And he said, Dino did it.
20:02He didn't know Dino's real name.
20:04But he knew Dino lives in the area.
20:07So this is Dino's address?
20:09Supposedly this.
20:12And that came from Walt?
20:14This came from Walt, who got it from the witness.
20:17So I'm raising S.O.D to get the house surrounded.
20:20And if we can get a warrant for the house, boom.
20:25Dino supposedly lives right around the corner,
20:27a couple of houses down from where we're all standing.
20:31Now that we know where Dino lives, we need to get a search warrant.
20:34And now we're calling the SWAT team.

20:58We're still, like, wrapping up the actual original crime scene, typing up a warrant very
21:04quickly on this house, and seeing if S.O.D. can assist with executing the warrant.

21:26Once the witness told us where Dino lived at, I began researching the address, trying to
21:32see if I could find out checking our databases, who lives there.

23:01actually picked out Devin Green in the lineup
23:04confirming that Dino is Devin Green.

23:12I get a search warrant for Devin's house.

23:21So earlier today around 2 p.m.,
23:24two victims were shot, one fatal, one non-fatal.
23:28We were able to identify the perpetrator as Devin Green.
23:31We actually knew where the perp lived.
23:34We don't know if he's inside.

23:40We want to get into this house as soon as possible
23:42because the last thing that we want
23:45is for my possible suspect
23:47to go back to the house
23:48and start cleaning things up,

25:51We have Devin Green's house surrounded,
25:54and somebody just started shooting from inside.
25:57I don't know if any of our guys are hit.

26:03get a perimeter around the location.
26:06Right now, it's a standoff.
26:09This is a tense moment,
26:11waiting to see what's going to happen next,
26:14but our SWAT guys are going to do everything they can
26:16to make sure that we come to a peaceful resolution.
26:29Good morning, everyone.
26:31This is an update involving an officer-involved shooting
26:34that occurred on October 5th,
26:36around 7 o'clock at night.
26:38This incident took place during the service
26:41of a high-risk warrant related to a homicide
26:45that had occurred earlier in the day.
26:48That homicide suspect was a 36-year-old man
26:52by the name of Devin Green.
26:55Mr. Green fired at the officer
26:58from inside the residence.
27:01This resulted in our officer's returning fire.
27:04After a nine-hour standoff,
27:10Mr. Green finally surrendered
27:12and was taken into custody.
27:14In the exchange of fire,
27:17no one was struck,
27:20and therefore there were no injuries.
27:31The smoke is practically still settling.
27:34It's surreal.
27:36I can't believe the number of rounds
27:39that were being fired,
27:40that nobody got hurt.
27:42I'm grateful.
27:44Nobody wants to see anybody get hurt.
27:46We want the criminal justice system
27:48to hold people accountable.
27:49I can finally breathe some relief
27:52now that Devin is in custody
27:54and our guys are okay.
27:57We did the search warrant inside the house,
28:00and there was two guns,
28:02a rifle.
28:04And a pistol.
28:06The pistol matches the caliber of casings
28:09that we had on the scene of the homicide.
28:13Now, I want to see
28:14if I can get a statement from Devin.
28:17I still need to be able to prove
28:18that Devin's the one
28:19who killed Stanley Williams.

30:25i'm able to pretty much identify this shooter from the ugly dog saloon video as alfred pennington
30:31using those identifying features from the t-shirt as a reference

31:11no but what this does it gives me his face

31:17it is a very aha moment for me
31:20this place is alfred pennington at the crime scene at the time the offense took place
31:25so at this point i do have enough probable cause for an arrest warrant
31:29and i'm confident that a judge will sign it
31:32but i still have a lot of unanswered questions
31:34what occurred in front of that gmc yukon
31:38why did alfred pennington allegedly shoot demond
31:43hopefully i am able to find alfred pennington
31:46and get answers to all these questions that we have

32:17I just talked to Dino, a.k.a. Devin Green.
32:21After Devin surrendered, he started saying,
32:25I had an old groin injury and it's aggravated right now,
32:29so I want to get checked out of the hospital.
32:31And so it was there that I interviewed him.
32:36Devin ends up telling me that Devin owed Stanley money,
32:40and Stanley had told Devin he was going to get back at him
32:43for this money owed.
32:45And Stanley was sharing a video that depicted Devin
32:50in a light that Devin didn't want other people to see him in.
32:54And so Devin felt his manhood had been disrespected,
32:59and Devin said, that's why he did it.
33:02He even went as far to say that the second person
33:05who was in the driver's seat was nothing more than collateral damage.
33:12So right now we're pulling back up in the area
33:16where the homicide happened.
33:19I still want to get as much evidence as possible.
33:23Got to walk up the block and just see if there's any other cameras,
33:27ring doorbells, or anything that might give us an actual look
33:30at what happened.
33:53I secured an arrest warrant for Alfred Pennington
33:57for the murder of Devin Foley.
33:59I received a phone call from Alfred Pennington's attorney
34:02who expressed that Alfred wanted to turn himself in.
34:05He was aware that he did have an arrest warrant out for him,
34:08and he came in with two attorneys.
34:12Now, I have a lot of questions.
34:15The obvious question of what occurred in front of that GMC Yukon
34:20that he needed to possibly shoot Devin Foley.
34:24Okay, you do have a warrant for your arrest.
34:27The warrant is for a second of your murder.
34:30It's an incident that happened July 8 in the evening.
34:34Why don't you tell me what happened?
34:37I came down on Friday to go to the Exeter Festival.
34:44I don't live here.
34:46I live in Houston.
34:48I just was out trying to have a good time.
34:52So I went in the club.
34:55As I walked in, somebody pulled my shirt.
34:58I turned around, and I saw who it was.
35:01And it's just God that I no longer even associated with.
35:07It's just like, what's up?
35:09And I'm like, I'm chilling, man.
35:11I live in Texas now.
35:13You know, I'm not into none of that footage just no more.
35:16And as I walked off, he pushed me and said,
35:21you're a bitch.
35:22You're going to die tonight.
35:23And I immediately tried to exit.
35:27In Alfred's statement, he tells us
35:29that he felt threatened by Daman.
35:32And Daman told him that he was going to die tonight
35:35and decided to leave the club, which
35:38is consistent with what we see so far in the video,
35:41that Alfred leaves.
35:43And then Daman follows behind him towards his vehicle.
35:50When I sat down in my car, as I took a breath,
35:58and he was grabbing at my door.
36:01Like, grabbing at my door, like, yeah, let me in this bitch.
36:06Let me in this bitch.
36:07Yeah, , he started clicking around.
36:10And he just was like, yeah, told him you're going to die tonight,
36:14bitch.
36:20And I got out when he was ramming up, when he was ramming on the door,
36:25like, instinctively.
36:26Because I was thinking about to start shooting in the door.
36:29I don't know what he's about to do.
36:30I don't know.
36:31I'm just scared.
36:33I'm scared.

36:39And he just came and got up on me.
36:44And he was reaching for the guy.
36:47I just hurt him off for a second.
36:49But I didn't even get to grab him.
36:52It just was so quick.
36:53And I just, I just shot.
37:03I just started shooting.
37:05And when I started shooting, he was running.
37:08But he was like, I was just scared, man.
37:12I was just scared.
37:14In his statement, Alfred Pennington admitted that he did shoot DeMond fully.
37:19He said DeMond pulled a gun.
37:22And Alfred felt threatened.
37:25Eventually, DeMond started running away.
37:27And he continued to fire his handgun at him.
37:31I was just scared.
37:33And I just got back in my car.
37:36And I just dunked down and just put the gun on like,
37:41I got a few blocks out.
37:43And I just, I just drove.
37:46Like, I just drove, like.
37:49That's what happened.
37:54He's obviously emotional, right?
37:56About everything.
37:59I don't want him answering a lot of questions with him in this case.
38:03But I want, we know the Warrens Army out there.
38:05And we want you to know the truth.
38:07Because obviously, the investigation keeps going.
38:10I want you to hear your side of the story.
38:12That's effectively everything.
38:15You know he's under arrest, then, right?
38:16Of course.
38:18I was hoping to clear this up.
38:20I have questions for you.

38:22Because your attorney doesn't want me to ask them for you.

38:53The fact that I'm able to make an arrest for Alfred Pennington related to the homicide of DeMond Foley is
38:59great.
39:01DeMond, his family are victims as well.
39:05Because they're the ones that are left suffering from the loss of their loved one.
39:11So, it gives me satisfaction that I'm giving closure to DeMond Foley's family.

40:10I'm the detective who's handling Stanley's case.

40:19Oh, as well as to be expected.
40:21We did arrest an individual.
40:24I don't know if you're familiar with the name, but his name is Devin.
40:29No, I'm not familiar with him.
