00:02Shamsul Iskandar Akin, a former senior political secretary to the Prime Minister,
00:07today failed in his application to transfer his five corruption charges from the Sessions Court
00:12to the High Court. High Court Judge Noor-Ruena Noordin dismissed the application, saying he fell
00:19short of the threshold under Section 417 of the Criminal Procedure Code. The provision allows the
00:25transfer of a criminal case from a subordinate court to the High Court only on limited grounds,
00:32including when it raises complex legal issues or when the interests of justice warrant the transfer.
00:38She said that as the law on the issue was settled, she saw no reason to depart from established
00:44judicial precedent, some of which was binding. Accordingly, she dismissed the application.
00:49In the application filed in February, Shamsul's lawyer, Amir Hamzah Arshad, cited novel legal
00:56questions and complex issues which she argued warranted determination by the High Court
01:01and ultimately the federal court.
