02:44It's rich in Hispanic and Vietnamese culture.
02:47They have their own businesses.
02:49It's on the edges of New Orleans, really.
02:52Everything past this area is like swampland.
02:54It's a very tight-knit community where they all seem to know each other and try to help each other

03:02When I arrive on the crime scene, there are certain things I'm looking for right away.
03:08Shell casings, blood on the scene, video surveillance cameras.
03:14Because in this particular case, there's businesses that have video surveillance cameras pointing
03:19towards the parking lot where all this happened.
03:22So this video, these cameras is what caught it, I'm assuming?

03:35So, from what I'm told from witnesses, they speak Spanish.

05:19He's a citizen from Honduras, and he's here just trying to make money for his family to send it
05:25back home to help support the people he loves.
05:29So, I picked up four shell cases from in between those two vehicles right here.
05:35So, it looked like they were possibly standing over there, the decedent was standing over here.
05:40He had a pilot loading that we picked up, and that's it, no casing.
05:44There's a revolver that's unaccounted for.

13:03So, the guy that got shot, he's always there.

13:13So, for the time he shot, it was up in the sky.

13:17Because the guy was still not letting go of his face.

13:22But the other guy is still shooting at him.
13:24So, if he's still shot up in the sky, we're shot him straight.
13:27I was looking at the teenager.
13:29Those lights definitely hurt.

13:31And when they got behind the red car that's all damaged, that's when they start shooting.

13:41The witness let us know that basically the teenagers
13:45were loitering in the area and kind of making everyone feel uncomfortable.
13:49He could see the firearm in their waistband.
13:51And they thought that there was a possibility that the teenagers were trying to rob them.
13:56David Cano shot a round into the air to scare the teenagers away.
14:00And the teenagers started to run away.
14:03And then David Cano fired another round.
14:06Then the teenagers who were running away started to return fire.
14:10So, why do you believe the guy shot in the air?
14:14He's always the threat.
14:16We have experiences like this before, like four more times that we have brought.

15:44This is where all the witnesses were and kind of where everything happens.
15:50We see the two teenagers, one in the red hoodie, one in the tan hoodie.
15:55And you see the victim, David, gets out of the driver's seat.
16:03And then a few minutes later, you can hear that first shot.
16:11And then you see the two guys running away, basically, being scared off.
16:17And then you see the decedent follow them.
16:23And it looks like the decedent shoots in their direction and actually hits this car window.

16:37And then the guy in the red shoots back.
16:43One of those strikes, David, he kind of grabs himself.
16:48And then he walks over to the white truck.
16:51And later, falls down next to the white truck.
16:57The two teenagers who are being shot at run this way.
17:02So, we're trying to get a better angle to just see what kind of, like, maybe where they went.

17:10There's an RTCC camera down there, so we might go there and just see what video we can get.
17:15Obviously, we need to find them to get their statements and everything and see what they were thinking.

17:29Looking at the video, I mean, it's pretty clear the decedent did more than just shoot in the air.
17:35But, like, you can clearly see he shoots at them, and you see that glass break.

17:42And the guy that shot back at them almost got hit.

17:46Well, you have a unique case, because in Louisiana, it's a stay-in-your-ground state.
17:52So, when you're being fired upon, you can shoot back in self-defense.
17:58In Louisiana, we have a stay-in-your-ground law, which is basically you don't have a duty to retreat.
18:05In a lethal force situation, I'm going to investigate this incident the same, regardless if it's a self-defense case
18:12or if it's a homicide.
18:14Someone lost their life, so I'm going to get to the bottom of it.

20:27to check the cameras there.
20:30I get the video surveillance from the camera on the street
20:34that my witness said the teenagers ran back to
20:38after the homicide occurred.
20:43I see the two teenagers still wearing the same clothing
20:47right after the shooting, and you see them running away
20:50and turn the corner towards Peltier Drive.

20:56Now we know the direction where they went after the homicide.

21:10So after the shooting, the two suspects take a right on Peltier,
21:15and they keep going.
21:16Which is the first street after the bridge.

21:20you hit a large apartment complex back there.

21:25they're really good.
21:26I've used them in the past.

24:54the police and never gave any kind of statement to us.

25:03Justifiable homicides, they do happen, but they're not super common.
25:08Like, out of 40 cases, maybe two or three have been justifiable.

25:15And if anyone needs to be held responsible for David's death, we're going to find out the

25:42This is a camera located on a building closest to Alcy Foucher, the street where the shooting
25:48happened down there to the left.
25:50This is before the shooting.
25:53Basically, this camera turns like every 10, 15 seconds, and it tracks motion as well.

26:12Looking at the footage, we know it's them based on their clothing.
26:16From the store and from witness statements, they're wearing the exact same clothing.
26:23Okay, so they go into this driveway, see them get off the bike, put it right in this driveway
26:29by this fourplex.
26:31This is before they go to the store.
26:33So now they're walking on foot and the shooting and the stores and all that are over there
26:37to the left.
26:37So one of them probably lives in that fourplex.
26:42So I think the approach today is to go find that location, knock on all four doors and
26:48see what we can find.
26:49Hopefully get lucky and it's our suspects.
27:06So this article came out, woman asked for help after two shootings in three days in her neighborhood.

27:22And she held a vigil for David Cano on Friday night.
27:29At this point we haven't been able to find David's family members to inform them of what happened.

27:47It says she's working to raise money for Cano's family to send his body back to his mother in Honduras
27:54for a proper burial.

36:31He said he was scared, and he didn't believe he did anything wrong, because he just ran away.

38:43I ultimately get an arrest warrant for the 15-year-old.
38:46I charge him with obstruction of justice and juvenile possession of a handgun.
38:50I know he had a firearm.
38:53And after he shot David, he left the crime scene with the pistol that he used to shoot him,
38:58which is obstruction of justice for removing evidence from a crime scene.
39:26The juvenile suspect is found outside of our parish.
39:30I attempt to speak with him, with his family member present.
39:35But he and his mother refused to give me a statement.
39:40He was then booked and eventually brought into juvenile custody.
39:47Ultimately, even though this appears to be a case of self-defense,
39:51it was a juvenile in possession of an illegal firearm.
39:55So he's arrested in connection with David's death.

40:34Christina, the person who organized the vigil for David Cano,
40:39she acts as a community liaison for the Hispanic community out in this area of town.
40:45I talked to his mother.
40:47I think she's being very strong.
40:49Yeah.
40:50Because it's the only son she had here in the U.S.
40:52So it's the only hope that she had for any, like, support or anything that she had back there was
40:57him.
40:58I think for a lot of her prayers, the miracle happened that we were able to raise so quickly the
41:02money to be able to send him back home, you know.
41:07David was a friend of mine.
41:09He was a very good guy.
41:11He was very, very humble.
41:13He doesn't have family here.
41:15He doesn't have a wife.
41:16He was a baker.
41:17Like, he worked in a Dong Phong Baker for over 10 years.
41:21At the Vietnamese store, he'll be the one taking out their trash from him.
41:24He really loved the people that sold food out there.
41:27Like, that was his spot.
41:28You know, and it was just like, pretty much, I really think he just felt like he was the protector.
41:33There's a lot of community members right now that feel unsafe.
41:38And they're getting guns that are not registering, things like that.
41:42What I explained to them is that that gun will not always be what saves your lives.
41:47Yeah.
41:47Because even if you shoot one of them, they could come back and retaliate.
41:52Then they're going to retaliate.
41:52It might do more harm than good.
41:54I'm going to be always to protect my community.
41:57And the best way that I can is to make sure that y'all have every information that y'all
42:01need.

42:04As a detective, we don't always get lucky with video surveillance evidence and other things.
42:10We are at the mercy, a lot of times, of the community and the people involved to tell us what
42:17it is that they know and what's going on.
