All party representatives in the Parliamentary Select Committee have been asked to submit their respective parties' written positions on the proposed constitutional amendments to separate the powers of the Attorney General and the Public Prosecutor at the committee's fourth meeting on April 27.

Minister in the Prime Minister's Department (Law and Institutional Reform) Datuk Seri Azalina Othman Said said the move was crucial in identifying common ground on the proposed amendments, given that the structure of Parliament cannot be separated from the influence of political parties and leaders.

02:05I mean, there is no denial that in our country there is a great awareness and a lot of public
02:10wants to see the appointment of this personality, the public prosecutor, is an independent appointment.
02:15So, I mean, everybody says that.
02:17But as you know, in a democratic setting, like in Malaysia, when you talk about independent or the personality is
02:24appointed independently without fear or favor, what is the concept of independence?
02:29Because in our system that we have, every appointment is by virtue of the existence of a commission.
02:35But today, I think with the NGOs and the CSOs, they are raising the most important element now is the
02:43role of the parliament.
02:43They want the parliament to play a more important role, a more relevant role on the process of appointment, which
02:51is quite reasonable and quite fair because as NGOs and CSOs, they believe that the parliament is the voice of
02:58the people.
02:59But at the same time, I mean, there are also other comparative jurisdiction that we have to look into.
03:04In some countries, although the parliament is involved in the appointment process, but the names are all being brought by
03:10the executive.
03:11But in this particular case, there are many variations we have to look at.
03:15So, it's still in the process of studying.
03:17So, we're trying to fight for a compromise.
03:19But I'm not going to say that the NGOs and the CSOs' point of view is wrong.
03:24I mean, that's their prerogative.
03:25They have every right to have that opinion and they want the best of the country.
03:27So, what we need to do now is to find a middle ground.
03:30I mean, NGOs is one thing with certain priority to their mission statement as compared to political parties.
03:38And you know whether you like it or not, when you speak about parliament, you cannot run away from political
03:43party influence.
03:44Because parliament is political parties.
03:46So, indirectly, you don't want political parties to have influence.
03:49Through parliament, there will still be a political party influence.

03:57So, the question here is that you want politician involved or you don't want politician involved?

04:31When you're not in power, a political party may be a different view.
04:35Because the beauty thing about our country and our democracy is that many political parties have become government.
04:40Opposition become government, government become opposition.
04:43So, everybody's got a different view.
04:44So, things are very, very still premature to comment lah.
