00:11the requirements of a listing agent is to provide a disclosure form to the seller what's the disclosure
00:17form well the seller has the obligation to disclose material facts of what's wrong with
00:24the house okay so what's a material fact well it could be a broken step that's loose in the front
00:32or broken railing that's an obvious fact it also can be an oil burner that doesn't work or it could
00:40be a hot water heater that only goes to a certain temperature and really doesn't provide enough hot
00:46water that's a material fact and that has to be brought out so that the buyer looking at it can
00:53observe it and make a decision well my one of my buyers was with me and we noticed some cracks
00:59in
00:59the foundation and we're kind of surprised so we went to the disclosure fact and sure enough the
01:05seller well they were having these cracks evaluated and one of the problems with the house is that the
01:12foundation was actually sinking and it was stated that over the next 10 years it can sink up to three
01:19or four inches so with that in mind my buyer decided didn't want to get involved uh could that sinking
01:27of a foundation be remedied yes it can so you have to take that into consideration as a buyer so
01:34don't
01:34jump to conclusions if you see something on the disclosure form that you feel that can't be remedied
01:41because many many times it can be remedied or the seller can address it with money and reducing the cost
01:49of the
01:49house to you look at the disclosure have your inspector or construction worker look at it then make a decision
