01:52And up through the ashes
01:54A mystery flared
01:56Like a stubborn ember
01:57Glowed and smoldered
01:59And demanded an answer

24:05Okay, stay away from me.
24:07I just got home.
24:08Paul.
24:09I'm staying away this time for good.
24:11What a way to end my birthday.
24:13For Jennifer to walk home alone at night with a broken heel and upset,
24:20she should have been.
24:22I don't even know if I've ever even seen her that mad.
24:26But that was the night before.
24:28Angry messages buzzing back and forth.
24:31Then, as the cell phone revealed, the pair made love during the night
24:35before Jennifer's morning text messages again turned red hot angry.
24:40The subject seemed to be a debt she claimed he owed her.
24:43Right around 10.30, 10.45 into 11, roughly 16 in the morning,
24:48she is now referring back to those text messages
24:50and telling him he better bring a check and don't come back
24:53or she's going to the San Jose Police Department
24:55to file charges by 3 o'clock that day.
24:57And that's the last text message that anyone gets from her.
24:59That's the last contact she has ever with anyone.
25:03That said, Gillingham, just before noon,
25:05is when Paul lost his temper and choked Jennifer to death,
25:08then drove to a gas station, bought a can of gasoline,
25:12later returned home, torched the house.
25:15And somewhere along the way, said the prosecutor,
25:18erased all those angry text messages she sent him.
25:22Every single one between the defendant and her.
25:24Every single one is gone.
25:26Months' worth.
25:28The vet said Gillingham,
25:29Paul used Jennifer's cell phone to send fake texts to her friends
25:32so they believed she was still alive.
25:36To support that claim,
25:37Gillingham introduced an expert witness
25:39who testified that texts from Paul's phone
25:41and texts from Jennifer's phone
25:43were hitting some of the same cell towers all afternoon.
25:46So her phone must have been right there with him in his car.
25:51Which is why, when she missed a meeting with her friend Roy Enderman,
25:54the texts he got from her didn't make sense.
25:57They weren't a sensible response to the message he'd sent her.
26:00In fact, he got the same texts twice.
26:03She didn't show up and her phone was off.
26:06And so as soon as I got that repeat text message,
26:08I was kind of worried
26:11because she wasn't responding to what I was saying.
26:13Jennifer was nowhere to be found.
26:15Jennifer was dead.
26:17Now, what Prosecutor Gillingham wanted the jury to think about
26:20was what happened or didn't happen
26:22much later after the fire.
26:25Here was the scene, house burning.
26:27Paul standing on the street outside watching the fire.
26:31At this point, he prominently didn't know
26:32if Jennifer was inside or outside,
26:34whether she was alive or dead.
26:36But...
26:37And at the time that he was there,
26:38he made 38 calls and text messages,
26:41two of which went to Jennifer.
26:43And on neither occasion did he leave Jennifer a message.
26:46He left messages for others.
26:48He spoke with others.
26:49He text messages, for instance, the same friend,
26:52multiple times.
26:53But in that two-hour period, at no time,
26:54does he leave that location to look for Jennifer, perhaps,
26:57to go to the other side of the blocked-off street.
27:00You know, if he called her and texted her once,
27:03Surely that's enough.
27:04I mean, she'll call him back.
27:05Cell phone records actually bear out.
27:08He's a person that would call or text her
27:09two to three hundred times a day when he wasn't around her,
27:11if he wasn't able to get a hold of her.
27:13His silence, especially, at the crime scene was deafening,
27:15because there's no text message.
27:16I would submit, and I did to the jury,
27:19that he stood at that location
27:20because he wanted people to see him there.
27:22But how could the jury be sure Paul was guilty?
27:25Prosecutor Gillingham offered her.
27:29Remember Rosie, the skillful police dog
27:32trained to alert to the faintest whiff of accelerant
27:34of the sort used in arson fire?
27:36She alerted when she smelled some of Paul Zumwalt's clothes.
27:41Suspicious, yes, though not exactly ironclad evidence.
27:45As you'll see, courtesy of Paul's high-profile defense attorney,
27:50the man famous for defending Scott Peterson,
27:53His name is Mark Garagos.
27:56I've had many a client who I have no doubt
27:58was capable of the acts that they were accused of,
28:01and this is just not one of them.
28:04In the last hours of Jennifer's life,
28:07something was caught on camera.
28:09Does it support Paul's innocence?
28:11Coming up...
28:13She had sex last night with her video.
28:15Yeah.
28:15Anyone who watches this
28:16is never going to have the impression
28:19that this was someone who was ready to kill her.

28:30During Paul Zumwalt's murder trial,
28:32the prosecution set out to prove
28:34through deleted text messages,
28:36which had later been recovered,
28:37that Paul and Jennifer
28:39had a very tumultuous relationship,
28:41and Paul may have owed Jennifer money.
28:44The prosecution also claimed
28:46in the hours after the fire,
28:47Paul had made almost no effort to find Jennifer.
28:51But the defense plans
28:52to describe a different Paul
28:54and shed new light on his relationship
28:57with Jennifer Skipsy.
28:58Here again is Keith Morrison.
29:01Defense attorney Mark Garagos
29:03has made a name for himself
29:05defending clients in difficulties
29:06and highly celebrated cases,
29:08not the least the Scott Peterson trial.
29:11But defending Paul Zumwalt
29:12would present its own set of challenges.
29:15Zumwalt was accused of killing
29:16his girlfriend Jennifer Skipsy
29:18and then trying to hide that fact
29:20by burning the house down.
29:21But as the trial began,
29:23he'd also been paid by the prosecution
29:25as an abuser,
29:26a violent man,
29:28an image Garagos set out to change.
29:31They were both passionate.
29:34romantic at times,
29:36hot at times,
29:37how would you characterize it?
29:38I don't think it was a one-way street
29:39by any means.
29:41For a start,
29:42Garagos tried his best.
29:43to weed out possible jury members
29:45who might have been unduly swayed
29:47by angry text messages
29:48or stories about Zumwalt's temper.
29:51What jurors do
29:52or what you want to get a jury to do
29:53I want to help your client
29:56and to kind of walk in the shoes
29:58of your client.
29:59And then when he presented his case,
30:01Garagos set out to reframe the events
30:04after that infamous party
30:05the night before the fire.
30:07The party was at a place
30:09and it was for Paul's birthday.
30:11And it was planned by Jennifer
30:15and maybe 14 to 18
30:19of their close friends that were there.
30:21And by all accounts at the party,
30:23Everything was great.
30:24And the argument later,
30:26the angry texts,
30:27that was just the way Paul and Jennifer
30:29"Always were," said Garagos.
30:31His proof,
30:33after those angry text message exchanges,
30:36Here's what happened.
30:37as Zumwalt described
30:38in his police interview.
30:40We talked, we smoked sugar,
30:42things were fine,
30:43We did what we did, you know.
30:46He slipped at the...
30:47I told him he gave me two x-axis.
30:49I think, probably,
30:50He took one or two before,
30:51but she took two more in front of me.
30:52And we just went to bed.
30:54And I got up at 11.
30:55So you guys slept at the same time?
30:56Yes, oh yeah, yeah.
30:57Okay, so you guys made up?
30:58I made it up, yeah.
30:59Yeah, I made up,
30:59And then I have a video.
31:00I mean, we video ourselves.
31:01I mean, honestly,
31:02you shouldn't be saying that,
31:03But that's to prove that.
31:04I was in the house.
31:05I had a video.
31:06Video yourself, what do you mean?
31:07We didn't have sex.
31:08We would video ourselves.
31:08So you had sex last night
31:10with her video?
31:10Yeah.
31:12And sure enough,
31:13when police looked at Jennifer's cell phone,
31:15There was a video.
31:16She and Paul having sex
31:18after their fight
31:19hours before she was murdered.
31:21So enthusiastically
31:22that anybody who watches this
31:23is never going to have the impression
31:26or take away from that
31:27that this was somebody
31:28who was ready to kill her.
31:30And as for that cell tower evidence
31:31that Prosecutor Gillingham presented,
31:33which seemed to show Paul
31:34Jennifer had his phone with him.
31:36and was sending out fake messages
31:38in her name,
31:39That was nonsense.
31:40said Garagos.
31:41That was one of the pieces
31:43of information
31:43That was absolutely imploded.
31:45We went and got the engineer,
31:47the actual engineer,
31:48from the carrier
31:50to come in
31:51and say he looked at the evidence
31:53And what did this guy say?
31:54was the phone
31:56pinging off the same towers
31:57was not.
31:58It was just merged data
31:59from the cell phone.
32:01Why is that important?
32:02Because,
32:03says Garagos,
32:04the prosecution's own timeline
32:06should have released Paul Zouan.
32:08That is,
32:09investigators said
32:10Jennifer was strangled
32:10several hours
32:11before the fire started
32:13and it was lit
32:14no earlier
32:14than about 6:30 p.m.
32:16But early in the afternoon,
32:17After Paul had left the area,
32:19Garagos says,
32:20Jennifer was still alive.
32:22sending real,
32:23not fake,
32:24text messages
32:25herself
32:26from her phone.
32:27By all accounts,
32:28She was alive.
32:29at 1.17.
32:31Okay.
32:32Okay?
32:32And at 1.17,
32:34Paul was not at the house.
32:35Only,
32:36Where was Paul?
32:37Trying to pick up paperwork
32:39at the Palo Alto police station
32:40and then at the hookah lounge
32:42where he appears
32:43security cam footage
32:44around 1:37 p.m.
32:46And from there,
32:47says the defense attorney,
32:48he headed to his
32:49anger management class
32:50about 18 miles away.
32:52On the way,
32:53he stopped at the restaurant depot
32:54seen here on camera
32:55around 3.30.
32:57So there simply wasn't time
32:59in between,
33:00said Garagos,
33:01for Paul to go to the cottage,
33:03strangle his girlfriend,
33:04and use her body
33:05with gasoline.
33:07A solid alibi,
33:08said Garagos.
33:09His client simply
33:11couldn't have killed Jennifer
33:12and he couldn't have
33:13started the fire.
33:14How could he have been
33:15In two places at once?
33:17And as for Rosie,
33:18the yellow lab
33:19who alerted
33:19to a gasoline smell
33:20on Zumont's clothes,
33:22Garagos simply pointed out
33:23that those very clothes
33:24were submitted to a test
33:25on state-of-the-art equipment
33:26of the Bureau of Alcohol,
33:27Tobacco and Firearms.
33:29and they showed
33:29no evidence of gasoline
33:31at all.
33:32The ATF chemist
33:33has a protocol
33:34and specifically
33:35one of the things
33:36the prosecution
33:36also didn't tell this jury
33:37which we brought out
33:38was that the ATF
33:39also put out
33:41a protocol
33:42that said
33:43you never
33:44take a dog alert,
33:45a single dog alert,
33:46and draw a conclusion.
33:48And in fact,
33:48if the ATF
33:49says negative,
33:50then you should not
33:51allow in
33:52The dog alert.
33:53So why would people
33:54believe the dog
33:54over the ATF?
33:55Well, I think
33:56once again
33:57you get into this idea
33:57that people have dogs
33:58that could have
34:00ascribed
34:01supernatural powers
34:02to dogs.
34:03I mean, you know,
34:03I've got two large dogs
34:05and having been through
34:08a couple of cases
34:09with dog evidence
34:10as much as
34:11I love my dogs.
34:12I'm certainly
34:13not going to want
34:13to convince somebody
34:14and put their liberty
34:15at stake
34:16Based on dog evidence.
34:17Still, as he presented
34:19his case,
34:20Aragos had a problem
34:21And he knew it.
34:23What it came down to
34:24was the character
34:25assassination block
34:26of the case.
34:27I mean, the first two
34:28blocks of this case
34:29revolved around
34:31what's so-called
34:32scientific evidence
34:33and that was
34:35absolutely destroyed
34:36and then you ended up
34:37with the character
34:38assassination block.
34:39The solution?
34:40Paul Zumot himself
34:42appears to have
34:42demanded it.
34:43The chance to defend
34:44himself to the jury
34:45by testifying.
34:47Some courtroom observers
34:48believe the defense
34:49had already created
34:50a reasonable doubt
34:51that testifying was
34:52in fact risky,
34:54especially for Paul,
34:55said his friend,
34:56Akisa.
34:57Knowing Paul the way
34:58I know Paul
34:59and the way that he
35:00could be interpreted
35:01incorrectly,
35:02I was very nervous
35:03about Paul taking the stand.
35:05Risky or not,
35:06Paul was determined
35:07to tell the jury
35:08his side of the story.
35:12On trial for his life,
35:13Paul takes the stand
35:15in his own defense.
35:16Will it help his call?
35:17I thought, you know,
35:20if there was any way
35:21this jury thought
35:22this man was responsible
35:23for this,
35:24now they know
35:24to make sure that he's not.

35:48Here's a conclusion.

35:55had done what he could
35:56to poke holes

36:00arguing that the prosecution
36:01had no solid
36:02scientific proof
36:03or clear evidence
36:05Zumot was anywhere
36:05near Jennifer
36:06when she was strangled
36:08and the house
36:08was set on fire.
36:09Anyway, he asked,
36:11If Paul attacked Jennifer,
36:14wouldn't she have put up
36:14Some kind of fight?
36:16Why were there no
36:17defensive marks
36:18or scratches
36:18on Paul Zumot's body?
36:20Did the prosecution
36:21Do you even have a case?
36:24Paul Zumot
36:25wasn't going to take
36:26any chances.
36:27In fact,
36:27he was determined
36:28to tell the jury
36:29his side of the story.
36:31So Karagos assigned
36:32a female colleague
36:33to question Paul.
36:35It must have been a strategy.
36:37whispered courtroom observers.
36:38A way to show the jury
36:40that Paul could,
36:41in fact,
36:41interact well
36:42with a woman.
36:43But those observers
36:44were mistaken,
36:46said Karagos.
36:47Well, I generally,
36:48I don't think
36:49direct examination
36:50is my strong suit
36:51and I was concentrating
36:52on cross-examination
36:54of the witnesses.
36:55So Paul Zumot
36:57looked the jurors
36:57in the eye
36:58and told them,
36:59I did not kill
37:00Jennifer Skipsy.
37:01The house did not burn down.
37:03And then he told them,
37:04emotions building
37:05to a fever pitch,
37:06how despite their
37:07rollercoaster relationship,
37:09He truly loved Jennifer.
37:11His lawyer presented
37:13a love letter,
37:13in fact,
37:14that she'd written to him
37:15And then he broke down.
37:17Flood of tears.
37:19I was so relieved
37:21and I thought,
37:22you know,
37:22if there was any way
37:23this jury thought
37:24this man was responsible
37:25for this,
37:26now they know
37:26make sure that he's not
37:28because it's so obvious
37:30to me that he's
37:31telling the truth.
37:32But listening to all
37:34of this with his
37:36experienced ear
37:37was Prosecutor Gillingham.
37:40You must have been
37:40rather pleased
37:41when you heard
37:41He was going to testify.
37:42I think that's
37:43an understatement.
37:44I was very,
37:45Very pleased.
37:46More than that,
37:47It was a gift.
37:48said Gillingham,
37:49an unexpected opportunity.
37:51Why?
37:53Well,
37:53the prosecutor
37:54had Paul right
37:55where he wanted him
37:56for as long
37:56as he wanted him.
37:57There were hours
37:58of questions,
37:59tough questions,
37:59baiting questions,
38:00questions designed
38:01to make Paul crack
38:02and reveal what
38:03Gillingham believed
38:04to be a controlling
38:05personality
38:06and a red-hot temperature.
38:07My plan was
38:08to go through
38:10how he acted
38:11when he was angry
38:12and then ask him
38:13questions that he
38:14couldn't have
38:14no good answers for.
38:16For instance,
38:17why all those
38:17text messages
38:18are deleted
38:18and those were
38:19questions he could
38:20do not answer
38:20because he had
38:21not considered
38:21those questions.
38:23After three long
38:24days in the hot seat,
38:26Paul Zumot's
38:27testimony was finally
38:28over.
38:29Had he persuaded
38:30the jurors
38:31That he was innocent?
38:33Do you feel
38:33he got a little bit
38:34Chippy or arrogant?
38:35I don't understand.
38:36I don't think
38:36that he got arrogant,
38:37but I think
38:37clearly he was
38:38tired and he
38:39was exasperated.
38:40He wanted to
38:41Tell his story.
38:42He was being
38:42Cut off.
38:43But the jurors,
38:44once they got
38:45the case,
38:45said they were
38:46determined to
38:47look at the
38:47evidence,
38:48not just courtroom
38:49theater.
38:50Everyone was
38:51very committed
38:51going over
38:52the evidence
38:53and discussing
38:54each of the
38:55witnesses and
38:55each of the
38:56crucial pieces
38:56of evidence.
38:57It was really
38:57encouraging.
38:59And it was
39:00crucial they
39:00decided to
39:01compare very
39:02carefully the
39:03different timelines
39:04claimed by the
39:05prosecution and
39:06the defense.
39:07So we analyzed
39:08the timeline for
39:09the entire day
39:09from his
39:10testimony where
39:11he said he
39:11was and then
39:12other pieces of
39:13testimony and
39:14evidence to
39:15either validate
39:16or contradict.
39:17The jury took
39:18less than 14
39:19hours and came
39:21back with a
39:21verdict.
39:22Guilty.
39:24all I remember
39:25I heard that
39:25guilty man
39:26and it was just
39:27like this
39:27just this relief
39:29this release of
39:30tension.
39:31I was very
39:32shocked by the
39:32verdict.
39:33I think a lot
39:34of people were
39:35shocked by the
39:35verdict because I
39:36it means if you sat
39:37through the weeks
39:38and weeks of
39:38Try it just
39:40It's inconceivable.
39:41how they could get
39:43to the result that
39:44They got you.
39:44But to the jurors
39:46the issues about
39:47text messages and
39:48whether Paul had
39:49Jennifer's phone all
39:50afternoon wasn't as
39:51important as zoom on
39:53on the stand.
39:54That's what made the
39:56difference.
39:57Are tears, for example?
39:58Sometimes I feel like
40:00I'm too cynical, but it
40:01was universally held
40:02My opinion.
40:04The entire jury
40:04believed that it was a
40:06manufactured moment.
40:07What was the problem
40:08with his testimony?
40:09There were two things
40:10That struck me.
40:12One was when he
40:13broke down on the
40:14stand and to me it
40:17It didn't seem genuine.
40:19And the other
40:20portion of his
40:21testimony was when
40:22he had the
40:23opportunity to tell
40:25us where he was
40:26and what he was
40:27doing he chose to
40:28They basically lie to us.
40:30three times and we
40:31were able to prove
40:32that he lied to us
40:33by the hard evidence
40:34that we had with the
40:36Phone records.
40:37and with the video
40:38surveillance and those
40:39items and I just
40:40to me that hurt him
40:43very badly.
40:43If he hadn't
40:44I can't say, as witnessed.
40:47for sure but I don't
40:48I don't think I could
40:49They have convinced him.
40:50At his sentencing an
40:51Angry Paul Zumod again
40:53protested his innocence
40:54that he was sent away
40:56for 25 to life for
40:57murder plus eight years
40:58for arson.
