00:00Five Perikatan national MPs are pressing ahead with their legal challenge against the Malaysia-U.S. Agreement on Reciprocal Trade,
00:08a lawyer confirmed, despite the U.S. Supreme Court striking down Donald Trump's tariffs as unlawful.
00:15S. Cartagessen, who appeared for the five MPs, said this was conveyed to Kuala Lumpur High Court Deputy Registrar Fredaw
00:21Sidki Sharel Azli during a case management last week.
00:25He told FMT that their suit is not academic as they want the court to determine the constitutional process.
00:33Fredaw sought clarification on the stance taken by the plaintiffs, Russell Wahid, Fatul Huzer Ayub, Awang Hashim, Mas Ermiyati Samsudin,
00:42and Abdul Kalib Abdullah, in light of last month's U.S. Supreme Court ruling nullifying the agreement.
00:49Cartagessen said the core issue, whether the cabinet has the power to enter into international agreements without parliamentary authorization, remains
00:57a novel and independent constitutional question that requires a binding president.
01:02He said clarification is needed on Article 69 of the federal constitution as it concerns the federation's legal capacity regarding
01:10property, contracts, and legal proceedings.
01:13The next case management is before Justice Amarjeet Singh on May 4th.
