00:00Former Railways Minister Lalu Prasad Yadav, the Delhi High Court that has turned down the plea for quashing of CBI
00:08-FIR in the Land for Jobs scam case against Lalu Prasad Yadav.
00:14The High Court while turning down the plea has said that it is devoid of merit since the CBI had
00:19acquired the requisite sanction.
00:21This is a big setback for Lalu Prasad Yadav yet again by the High Court that has turned down the
00:27plea for quashing of CBI-FIR in the Land for Jobs scam case.
00:32Let me take this to my colleague Anisha Mathur joining us on the broadcast with the latest details of what
00:37the High Court has said on this matter.
00:40Well, say so, the Delhi High Court has given a setback really for Lalu Yadav because it has rejected his
00:47plea to quash the CBI-FIR.
00:50Now, let's take a look at what Lalu Yadav's argument was.
00:52He had argued that under the Preventative Corruption Act, the CBI could not have initiated prosecution, could not have initiated
00:59the investigation without prior sanctions being received from the government
01:05because this was a case initiated against him when he was in a government office.
01:14And the alleged offensive had been committed during 2004 to 2009.
01:18He had also said the FIR was lodged only in 2022 after the delay of more than 14 years.
01:24And therefore, he had also argued that this was a biased investigation.
01:28But the High Court has passed judgment.
01:30It has refused to interfere.
01:32It has refused to stay in the trial court proceedings.
01:34It basically means that the trial which has now started, remember, Lalu Yadav, the charge sheet in the case had
01:43been filed.
01:44The cognizance had been taken of the charge sheet.
01:47And streaming of charges is currently, has already been done.
01:51So, the trial is supposed to begin in this matter.
01:53Lalu Yadav had gone to High Court saying that this entire procedure was incorrect because the CBI's investigation from the
02:01beginning was without proper sanction and was a biased investigation.
02:06With the High Court now passing an order saying that it is not inclined to interfere, this is a big
02:11setback for Lalu Yadav as the case trial against him, the trial process against him can now begin.
02:18We will get more details on this once the detailed judgment comes out since Dr. Naveen Dudeja only pronounced just
02:25a short oral pronouncement of the judgment saying that we are not inclined to interfere.
02:30But the details will also come out.
02:32But for now, we can tell our viewers, this is a big setback for Lalu Yadav and his family members
02:37because remember, he's not the only accused in this Lantford job scam case.
02:40His wife, his son are also accused in this particular case.
02:47Now, the trial will begin.
02:49We will get more details with the detailed judgment.
02:53Oh, yes, absolutely, Anisha.
02:54But before we let you go, please help us understand the legal options that now Lalu Prasad Yadav's lawyers are
03:01mulling.
03:04Well, the most important would be for Lalu Yadav's lawyers who now oppose the Supreme Court.
03:09The appeal against the high court order will have to go through.
03:13The Supreme Court will see how, what decision they are going to take now with the high court single judge
03:20bench passing this decision.
03:22Since it is a petition to quash the FIR, to quash the charge sheet and the trial court orders, this
03:29will now, the next move will have to be before the Supreme Court.
03:33So, we are trying to get a response from Lalu Yadav's legal team.
03:37At the moment, what they've said is that they will look at the judgment in detail and then see what
03:43the next course of action is going to be.
