06:50it's good to see you again and no surprise that we'll be getting into some prediction market talk
06:55here let's start right there because we've got some news uh courtesy of the cftc issuing yet again
07:01it feels like new guidelines surrounding prediction markets and where this goes going forward there's
07:06always going to be pushback we know how this works but uh you tell us what's the latest here and
07:11what
07:11should we expect here in the coming weeks yeah it's pretty big news that just yesterday the cftc
07:18finally came out with two sets of guidance one was a a notice from the division of market oversight
07:26uh an advisory guidance which uh did a few things it basically said that exchanges prediction markets
07:34like calci polymarket etc uh now fanduel and draft kings have their own products it said they uh can't
07:40offer contracts that could be easily manipulated but that's kind of as far as it went it didn't
07:45specifically say what exactly uh those would be uh chairman michael selig did give some examples when
07:52pressed by cnbc on this matter he said potentially you know contracts on injuries betting on a player
07:57to get hurt uh officiating decisions things that can be easily manipulate manipulated uh by a bad actor
08:04someone trying to make money but it was very vague and didn't say exactly what those would be
08:09it didn't say it did it could potentially include player props if you think you know this contract is
08:15easily manipulated just from one player's performance but it didn't specifically say
08:19what it was it was kind of just a notice to calci and others that hey we want you to
08:24police yourselves
08:25we're still working on this we're trying to figure that out uh which i think is pretty pretty telling it
08:31kind of shows that uh the cftc which again has fought for the authority to regulate uh sports
08:36prediction contracts over states which say no we should do it it's sports betting the cftc has fought for
08:41this authority but at the same time time and again said it's up to calci and all these other uh
08:47platforms that we want to regulate to kind of regulate themselves and police themselves uh the cftc
08:52also issued a notice of advanced uh rule making which again sets out what it's going to do potentially
09:00with sports prediction markets which you know it's just a crazy topic right now um it it didn't go as
09:06far to say what exactly it's going to define and it's asking for comments but one interesting nugget
09:11is it said specifically again injuries officiating decisions uh likely would be off limits which is
09:19actually something that major league baseball and the nba last year wrote to the cftc saying hey we're
09:24concerned that these markets could be offered i think it's really interesting that you know these
09:29keep being brought up as examples of contracts off limits but if you look on cowshire poly market right
09:34now adam you can't find any of those contracts you can't find injury contracts you can't find
09:39officiating decisions so it seems to me like a bit of a red herring where they're talking about
09:44contracts that are easily manipulated it's like oh these would be terrible instances but what's the
09:48point in doing all this work to get rid of these contracts if they're not being offered in the first
09:53place so um it seems like they're kind of aligning with league interests there another you know important
09:58kind of wrinkle in that is they made a strong suggestion that cowshi and poly market and those folks
10:04should be working with sports leagues the same way that sports books do where they're
10:08using their official data to certify the market so if a guy finishes with 20 points they're ensuring
10:14that he actually did finish with 20 points because they have that the statistics as it comes from the
10:20league specifically uh it was something that was very important in sports betting when it was becoming
10:25legal but mainly just from the point that it allows the leagues to make more money off of this
10:30business the leagues obviously make a lot of money from sports betting right now and i think
10:34one of their concerns kind of quietly has been how do we make money off prediction markets so
10:38they're kind of suggesting that you know it might help market integrity if you do this but if you kind
10:43of read between the lines it might be better for the leagues as well and they've certainly lobbied to
10:47have rules and restrictions around prediction markets whether that's more about them making money
10:52from it or whether that's more about the validity and the safety and integrity of the game
10:56that's kind of open up to interpretation but we'll have about 45 days um from now where they'll have
11:02the the final comments will be submitted and we'll see what rules the cftc is actually going to make
11:07here besides you know just suggestions yeah sam i'm just not sure how you put the genie back in the
11:13bottle right i mean at a certain point in time you're just going to drive people i know prediction markets
11:18are quote unquote different than gambling but at a certain point you're just going to drive people back to
11:23all right well if they're not going to cooperate the legal way we're going to go back to our
11:26our prehistoric you know non-legal ways or offshore ways of getting this done
11:35yeah it certainly seems like prediction markets are here to stay i kind of liken it to analogy of you
11:39know the toothpaste is out of the tube and not only can you not put it back in but it's
11:43coagulated
11:44and taken different forms where now you have cnn is partnered with prediction markets nbc is
11:49partnered with prediction markets uh donald trump jr is an advisor to calci and an investor in poly
11:54market and uh sports make up 90 of their volume they've just absolutely ballooned over the past
12:00year i think there used to be around 130 markets a year listed on calci and this past year it
12:06was over
12:061500 and they certainly keep ramping up as we go into uh march madness so it seems like the cftc
12:13is kind
12:13of playing uh reactive game here where okay how do we kind of make sure it's kind of the wild
12:19west right
12:19now how do we make sure we have rules that maybe rein this in a little bit and of course
12:22we haven't
12:23even talked about all the lawsuits from the states saying no this is sports betting but it definitely
12:27seems like it's here to stay so uh whether or not sports eventually are allowed to keep being offered
12:31or not you know that's kind of the big question here uh which many think the supreme court will end
12:36up deciding though there's obviously a vested interest in keeping sports on them because again
12:40they make up 90 of their business so that's really how they've taken off we can talk about you know
12:44them being better than the polls but it's kind of hard to argue that you know just because the
12:49timberwolves have a 30 chance of winning the western conference on calci whether that actually means
12:56they have that chance or it's just you know people are betting that way so the sports is a really
13:01interesting wrinkle here so sports betting you know prediction markets aside going to the sports betting
13:07obviously different states they have different markets here sam washington lawmakers passed a bill
13:12called the sports wagering integrity act that allows betting on in-state college teams and adds
13:18protections for athletes from betting related harassment as well i don't know how you go about doing that
13:24necessarily you know take away social media from everybody good luck to you but obviously not every
13:30state most in fact do not allow you to bet in state on college teams that participate in those same
13:35states massachusetts where i am for instance so good idea bad idea for the state of washington
13:42i would have to say it's kind of a no-brainer idea at this point because we just talked about
13:47prediction markets they're doing college sports betting in washington right now uh completely
13:53legally completely fine meanwhile the the sports books in the states are not allowed to do it because
13:58the state has sports betting laws so i kind of think it's one of those examples where we talk about
14:02the spread of prediction markets uh catalyzing more states to you know create fairer sports betting rules or
14:10more lax sports betting rules where they're looking at if you know this activity is being done on
14:13another platform we're not taxing we might as well create rules around it for the people who follow
14:17the rules in the state so i think that's what you're seeing in washington this bill is headed to
14:22the governor this week which would allow you know betting on the in-state teams unfortunately it wouldn't
14:27take effect till about 90 days after the legislature adjourns so you know gonzaga who's expected to make
14:33march madness as they do every year i think even eastern washington is supposed to make it for the first
14:38time in like a decade you couldn't bet on them this year unfortunately you know washington obviously
14:42a big college sports state but next year you could so hopefully you know eastern washington repeats and
14:47uh making the tournament and hopefully gonzaga's there again uh and then on the harassment piece
14:52uh before we head out adam uh yeah there it's kind of one of those measures you're seeing where states
14:58are trying to at least show that they have a concern about this it would be a misdemeanor under state
15:03law
15:04to harass uh somebody and you know an athlete or a coach and threaten bodily harm but again it's hard
15:09to prove so a random angry tweet wouldn't qualify but a message uh sent to them that says hey i'm
15:15going to carry out direct violence with belief from the state that that violence could be carried out
15:20that would qualify so we're still trying to figure out how that will all work but you know at least
15:25seems like a step in the right direction if nothing else you got a lot of people out there begging
15:30get in line please where do i sign as far as getting all these harassers out of my direct
15:35messages and taking legal action upon them if in fact that actually comes to fruition we'll see but
15:40there are a lot of people that would happily uh get involved there again sam aquil and legal sports
