00:00In Guatemala, former leaders of the ancestral Aboriginal organization 48 Cantones del Toto
00:06Nicapan have been in prison since 2023 when they were arrested during protests in defense
00:12of the vote that finally brought Fernando Arevalo to the presidency. Indigenous and
00:16peasant leaders denounced that the judicial authorities and institutions are intentionally
00:21delaying their trials. Our colleague Rolanda Garcia has the details.
00:30Social organizations, together with Luis Pacheco and Hector Chuklin, former indigenous authorities
00:35from the 48 Cantons of Tatanacapan, denounced that there are delays and intentional irregularities
00:39in the judicial process being carried out for their participation in the mobilizations in
00:43defense of the vote in 2023. They assert that their cases are just one example of the judicial
00:48persecution by the public ministry against social movements and leaders in the country.
00:56It has been known for persecuting students and criminalizing indigenous leaders. As we
01:00are now seeing with Luis Pacheco and Hector Chuklin, he has sinister ruling in favor of impunity,
01:04which is led and protected by the public prosecutor's office.
01:11Indigenous leaders have been in pre-trial detention for more than eight months, accused of terrorism,
01:16sedition, and legal association for leading a series of protests in different parts of the country in
01:22defense of the 2023 election results. We once again confirmed that lack of objectivity in the
01:29application of Guatemalan justice. We hope to God that objectivity will finally prevail.
01:38Indigenous organizations allege that Judge Freddy Orellana was recently appointed to hear the case
01:43involving both indigenous authorities, but they accuse him of promoting impunity.
01:50Then we will analyze whether there are any doubts about Judge Freddy Orellana's impartiality in
01:55continuing to hear the case. Of course, this complicates the legal situation of Mr. Luis Pacheco
02:00and Hector Chuklin. We do not trust a judge who has been accused on multiple locations.
02:10The criminalization of indigenous leaders in Guatemala is denounced as arbitrary and racist,
02:16argues this presidential commissioner against discrimination and racism.
