00:00The Court of Appeal has significantly reduced the damages awarded to the family of murdered
00:08Mongolian interpreter Altantuya Sharibu, slashing the amount from 5 million ringgit to 1.4 million
00:15ringgit. A three-judge panel, led by Chief Judge of Malaya, Justice Hashim Hamza, delivered the
00:22decision on Tuesday, more than 18 years after Altantuya's murder in 2006. The new award
00:29totals 1.384 million ringgit and includes 1 million ringgit in aggravated damages and 384,000
00:38ringgit in dependency claims. This amount is to be paid by political analyst Abdul Razak Baginda
00:44and two former Special Actions Unit officers, Chief Inspector Azila Hadri and Corporal Sirul
00:51Ajhar Umar. The Court also awarded 10,000 ringgit for bereavement expenses and 15,000 ringgit
00:58for funeral costs. In a significant finding, the Appellate Court ruled that the government
01:04was not liable for the death, stating that the actions of the two police officers were
01:09committed outside the scope of their official duties.
01:13Justice K. Munyandi, who delivered the broad grounds of judgment via Zoom on Tuesday, explained
01:19that the High Court had erred in holding the government liable. The Court rejected Abdul Razak's
01:24appeal to be absolved of liability. He had argued he merely sought police assistance to handle
01:30harassment. However, Justice Munyandi said this argument was untenable, noting that the two
01:36police officers had no prior knowledge of Altantuya, and all information about her was provided
01:43by Abdul Razak. The Court found that Abdul Razak was in constant contact with Azila throughout the
01:49night of the murder, demonstrating a shared intent to ensure the victim disappeared.
01:55Altantuya's parents and son filed a civil suit over her death in October 2006, seeking
02:01100 million ringgit in damages. The original 5 million ringgit award was handed down by the
02:07Shah Alam High Court in December 2022.
