Datuk Seri Najib Razak will file an appeal on Dec 29 against the High Court’s decision, according to the former prime minister's lead counsel Tan Sri Muhammad Shafee Abdullah, signalling the legal team’s intention to challenge the ruling at the Court of Appeal.

On Friday (Dec 26), the High Court in Putrajaya found Najib guilty on all 25 abuse of power and money laundering charges involving RM2.3bil from 1MDB funds.

00:00While we are disappointed, we are more agitated, not in a bad way, but agitated to do better in the appeal
00:17because by Monday, we will file the appeal. This is probably the first case in my almost 50 years
00:27career in the law where I lost every single point. There's not a point, even a small point that I want.
00:37Nothing, it's zero. If it is in terms of football, they scored 100 goals and we scored zero.
00:44It's a perfect result for the prosecution. But having said that, I'm looking forward for this case
00:51to go to the court of appeal because every single point, the judge has been dealt with
00:58in a manner where our cross-examination of the witnesses, where our defence have not been
01:06examined by the judge. I can say this with all the clarity. I'm not saying this immediately
01:14after a battle and we come out not thinking straight, no. Throughout the reading of the
01:19judgment, we kept on being disappointed with every point that was handed down by the Leonard
01:28judge. I call it blunders because I think that's what it is. Because you cannot have that many
01:34mistakes in a judgment of this importance. Now, what is most shocking is every single objection
01:45of ours pertaining to hearsay, hearsay is inadmissible unless it comes under an exception which is called
01:55the section 32 exception. He said all those, what Jolo told, for instance, Shahrul, what Jolo said
02:09to Amhari, and then Amhari told the court.
02:13All these, not only one layer of hearsay, but many a time they are double hearsay, sometimes
02:28triple hearsay. But the Leonard judge said, not only these hearsay are admissible because
02:35he said they are in the course of business. To me, how could it be in the course of business?
02:43When Jolo gave instruction to say, Shahrul, and Shahrul said it in court. We cannot test
02:53what Shahrul testified because that's not Shahrul's word. You know, Jolo said this, Azlin said that,
03:03all these were admitted and we find this very shocking. But he also said, double hearsay iso can be
03:12accepted because he said the law does not prohibit it.
