In a significant legal development, a Delhi court has refused to take cognizance of the Enforcement Directorate's (ED) chargesheet against Sonia Gandhi and Rahul Gandhi in the National Herald case. The court noted that the probe was based on a private complaint by Subramanian Swamy and not an FIR. Following the order, Congress MPs staged a protest at the Makar Dwar in Parliament, claiming that the 'politically motivated prosecution' has been exposed. An Unidentified speaker stated, 'Gandhi family contributed their entire property from the days of Motilal level... Today, a justice has been prevailed.' The BJP, however, termed it a 'temporary relief'. India Today reporters Piyush Mishra and Rahul Gautam provide details on the political face-off.

00:00After relief for the Gandhis in the National Herald case,
00:03now the Congress has upped the ante against centre
00:07and hurled vendetta charges against Modi government.
00:10Congress MPs staged a protest at Makar Dwar in the parliament
00:14after the Delhi court order.
00:16Not just in the national capital,
00:18Karnataka Congress leaders also staged a protest
00:20near the Gandhi statue at Suvarna Sauda in Belgavi
00:24against the central government over the National Herald case.
00:28Now, Congress hailed the order, saying truth has prevailed.
00:32The party added that the politically motivated prosecution
00:35over the past decade was fully exposed
00:37and that all allegations of money laundering,
00:41proceeds of crime and property transfer were baseless.
00:44The BJP, however, calls this a temporary relief for the Gandhis
00:48and claimed that the final verdict will be against the Gandhis.
00:52This is a basic common sense.
00:59Gandhi family contributed their entire property
01:03from the days of Motilal Nehru.
01:08All the property to the government.
01:10They don't have any assets.
01:13This National Herald was a Congress property asset.
01:17They were the president of the Congress party
01:19at the national level.
01:22So today, I think BJP, they wanted to keep us busy.
01:27They wanted to file fall cases.
01:30Money laundering case.
01:31What money laundering?
01:32Whether they have found cash?
01:34Whether they have found anything?
01:36What was there?
01:37There is no money laundering.
01:39So they have filed a money laundering case
01:40with some political opponent taking the complaint.
01:44Mr. Subramanis Swami.
01:47So ultimately, the court had a deliberated discussion.
01:49They said, who is Subramanis Swami to file a case?
01:53He doesn't have the local standing.
01:56So ultimately, they have squashed it.
01:59Today, a justice has been prevailed.
02:01He said, who is a private person who has filed a case?

02:50In 2021, E.D. in 2021 and 2025, Rahul Ghandi Ji has been given 50 hours for 50 hours.
03:0350 hours for 50 hours?
03:055-6 hours for 5 hours.
03:08Sonia Ji has been 7-8 hours for a different time.
03:13After 30 June 2021, E.D. in 2021, there will be a national protection.
03:36Our workers are totally agitated on this issue
03:42for the last so many years.
03:44Now, truth has come out.
03:47Certainly, we will take it up to the streets.
03:49After the Delhi court refused to take the cognizance of E.D. Tarsity National Herald case,
03:55today, the Congress MPs along with a few other MPs of India Bloc are right now protesting
04:00right in front of Makar Dwar.
04:02Right behind me, you can see as to how the MPs are now protesting.
04:07A.C. Venugopal is reading that entire protest, the posters which the Congress MPs are holding,
04:13reads,
04:14Satme Vijayate, truth prevails.
04:16And interestingly, Shashi Tharoor, Congress MP, who so far was maintaining distance from
04:21the Congress Party's meetings and political affairs, has also joined this protest.
04:26So, on the issue of National Herald, today the Congress MPs along with a few other India Bloc MPs
04:33are protesting at Makar Dwar and they are demanding that the Modi government should resign,
04:40the leaders of BJP should resign for propagating lies as far as this entire case of National Herald is concerned.
04:47Remember that today, our press conference was also done by Malik Arjun Khadig and following which we are now seeing
04:52how the Congress Party leaders are protesting right in front of Makar Dwar on this entire matter.
04:57Yush Mishwa in Delhi for New York.
04:59And joining us on this entire issue is India Today's Rahul Gautam.
05:04Rahul, how is Congress tom-tomming the verdict of yesterday and how is BJP pushing back?
05:10You know, National Herald, Anjali, is a very emotive issue for many Congress workers given the fact that it
05:17indicts or puts the top leadership of the Congress Party in dock.
05:22And therefore, now Congress is describing the recent, you know, the order or the move of Rouse Revenue Court as a victory.
05:30They are saying that they have been vindicated, you know, for the fact that BJP has been misusing agencies.
05:37They have unleashed, you know, CBI, ED, income tax, all these agencies against a Gandhi family only to harass and depail them.
05:45And in fact, you know, as we were hearing those sound bites of Abhishek Malu Singhvi, who actually represented, you know, Gandhi's Congress Party in the court.
05:55In fact, he said that, you know, this case does not hold any merit from the date, you know, one, given the fact that there was no, not a single penny actually exchanged hands.
06:04There was no property that was, you know, that was sold or was bought.
06:08So this clearly shows that, in fact, the company, you know, which has editors like Sonia Gandhi and Rahul Gandhi, it's a non-profit company.
06:19And therefore, you cannot have any money derived from that particular company.
06:23So, therefore, Congress is saying that this was the political wind data, political witch hunting, which has been exposed now.
06:28And therefore, you know, although there is another FIR which is still pending with Delhi police, but they are saying that they're pretty confident and pretty convinced that the other FIR will also be either quashed or will also be, you know, biting dust in the legal arena.
06:44Because whatever the BGP has been claiming for past, you know, so many years.
06:49Remember, in 2021, the FIR was registered, you know, at the Directorate of Enforcement Directorate.
06:57And now in October month, last October month, the Delhi police also came into action and they also filed an FIR.
07:03So they are pretty convinced that in the coming days, they will get a relief from that particular FIR also.
07:08And they will take this issue to the very streets of the country and will also take to the public that the BGP is only misusing agencies against Gandhi family and the political opponents in the country.
07:19All right. Thank you, Rahul, for all those details.
