00:00Trump, DOJ called out for humiliating defeat.
00:05A federal judge has dismissed indictments against former FBI Director James Comey
00:09and New York Attorney General Letitia James,
00:12delivering what one former prosecutor called a humiliating defeat
00:16for President Donald Trump's Justice Department.
00:19Choose your own adventure of procedural errors.
00:23This ruling comes after Judge Cameron McGowan-Curry
00:25found that Trump's hand-picked prosecutor,
00:28Lindsay Halligan, was unlawfully appointed as interim U.S. attorney
00:32for the Eastern District of Virginia.
00:34She called the case a choose-your-own-adventure of procedural errors.
00:39Doomed from the start.
00:41Former D.C. prosecutor Elise Adamson said the case was practically doomed from the start.
00:46And indeed, the court agreed that she wasn't lawfully appointed.
00:49And the problem here is that Halligan did everything on her own.
00:52And so now these indictments can't stand.
00:55The charges.
00:55Halligan indicted Comey on two charges,
00:59making false statements to Congress
01:00and obstructing a congressional proceeding.
01:03Judge Curry ruled that
01:04all actions flowing from Ms. Halligan's defective appointment
01:07were unlawful exercises of executive power
01:10and are hereby set aside,
01:12resulting in the dismissal of both Comey's and James' indictments.

01:18Similar procedural issues have occurred before,
01:21such as in Trump's classified documents case.
01:23Usually, DOJ follows proper process and procedure,
01:26Adamson said.
