00:00Trump Department of Justice called out for humiliating defeat.
00:04A federal judge has dismissed indictments against former FBI Director James Comey
00:09and New York Attorney General Letitia James,
00:11delivering what one former prosecutor called a humiliating defeat
00:15for President Donald Trump's Justice Department.
00:18The ruling came after Judge Cameron McGowan.
00:21Curry found that Trump's hand-picked prosecutor, Lindsay Halligan,
00:24was unlawfully appointed as interim U.S. attorney for the Eastern District of Virginia.
00:30On CNN's Inside Politics, former D.C. prosecutor Elise Adamson
00:34criticized the Trump DOJ for multiple procedural missteps.
00:39She called the case a choose-your-own-adventure of procedural errors.
00:43Adamson said the case was practically doomed from the start.
00:46This was a huge one.
00:48Halligan being appointed after the 120 days of the interim appointment
00:52had been exceeded was a huge problem, she explained.
00:55And so now, these indictments can't stand.
00:57Halligan indicted Comey on two charges,
01:01making false statements to Congress and obstructing a congressional proceeding.
01:05She also brought charges against James for bank fraud
01:08and false statements tied to her 2020 home purchase.
01:12Judge Curry ruled that
01:13all actions flowing from Ms. Halligan's defective appointment
01:16were unlawful exercises of executive power
01:19and are hereby set aside,
01:22resulting in the dismissal of both Comey's and James' indictments.
01:25Adamson noted similar procedural disputes
01:28in Trump's classified documents case
01:30where he pleaded not guilty to 40 counts.
01:33That lawsuit was ultimately dismissed.
01:36Usually, DOJ follows proper process and procedure, Adamson said.
01:40And now we see what happens
01:41when the DOJ attempts to do an end run around those procedures.
01:45The cases have now been dismissed
01:47and probably delivered a humiliating defeat
01:49to the Trump administration.
