00:00The suspects detained during the November 28 Chow Kid raid still retain their rights to privacy
00:06and should not be publicly exposed before guilt is proven, say to lawyers.
00:13Lawyer Jason Ong took issue with the presence of media at the raid,
00:17saying this led to assumptions of guilt being formed and the suspects being publicly shamed.
00:24Ong, a former assemblyman for Kebun Bunga, Penang, said
00:28religious authorities should show compassion and sensitivity when handling such cases.
00:34On November 28, the Kuala Lumpur Strike Force Team, in collaboration with the Federal Territory's
00:40Islamic Religious Department and Kuala Lumpur City Hall, detained 208 people aged between 19 and 60,
00:48including 17 civil servants at a health club in Chow Kid, believed to have been used for sexual activities.
00:55Last week, Home Minister Saifuddin Nasution Ismail said,
01:00privacy did not apply in the context of enforcement action on business premises with hundreds of visitors.
01:07However, lawyer Gunamalar Jurindanjan said, although rights to privacy have limits within the law,
01:13Article 5 of the Federal Constitution guarantees personal liberty.
01:18She said, while police have the broad power to stop,
01:22search and arrest if there is a reasonable suspicion for them to act,
01:26publicising suspects' identities is not required under the law.
