00:12Constitution has been one issue that has found resonance, especially where elections, political campaign and politics is concerned.
00:22This Constitution Day, things were no different as political.
00:30It is Constitution Day, in a year where the Constitution of India has held center stage in political discourse.
00:43The next year, Narendra Modi, RSS and BJP started to finish this book.

01:15Constitution Day is observed every year on November 26th to mark the adoption of India's constitution.
01:27Officially declared in 2015, the day aims to promote awareness about constitutional values, duties and citizens' fundamental rights.
01:36President Draupadi Murmur, Prime Minister Narendra Modi, Lok Sabha Speaker Om Bhirla, Leader of Opposition Rahul Gandhi and Union Ministers attended the program.
01:53President Murmur addressed both houses of parliament, calling the Constitution the backbone of India's democracy.
01:59Prime Minister Narendra Modi appealed to citizens and lawmakers to strengthen the constitution and protect India's democratic framework.
02:29Leader of Opposition Rahul Gandhi pledged to shield the constitution and defend its core values, calling on citizens to defend constitutional values.
02:40Rahul said, and I quote,
02:41Let us pledge that we shall not allow any assault on the constitution in any manner whatsoever, unquote.
02:50Sharing a post on X, Banerjee paid tribute to the constitution with a sharp warning,

04:17Alright, so before we get into our debate number one, the question that we moot this evening,
04:23is Samvidhan Khathre mein hai still a hot and bottling issue?
04:27Well, let's take it to our panelists this evening.
04:30Joining me, Rajat Sethi, Political Analyst, Radhika Khera, National Spokesperson,
04:34Bharati Jamta Parti, Shahid Siddiqui, Author, Political Analyst,

04:40Beginning with the Congress Spokesperson, Saral Patel.
04:43Saral Patel, the fact is, the proof would be in the eating of the pudding
04:48and what the Congress has been harping on since 2024 is Samvidhan Khathre mein hai.
04:55Ever since 2024, election after election, I would reckon the people of this country
05:00has answered that question, ke Samvidhan Khathre mein nahi hai.
05:03By giving in election after election, full mandate to the NDA.
05:10Is that debate now over?
05:13Preeti, I want to begin with absolute clarity that no political party has attacked the Constitution
05:19Constitution more consistently, more systematically, and more shamelessly than BJP RSS.
05:27Today, they are pretending to salute the Constitution, but their history is a chart sheet.
05:32And let me read out a few points from that chart sheet.
05:35On 30th November 1949, RSS mouthpiece organizer wrote that Indian Constitution was non-Indian.
05:45BJP pretends to worship Baba Sahib Ambedkar on Constitution Day today.
05:50But on 12th December 1949, RSS and Hindu Mahasabha leaders burned the effigy of Dr. Bheem Rao Ambedkar
05:57and the copies of Constitution.
06:00BJP has toppled people's mandate again and again by weaponizing central agencies.
06:06Is that not subversion of the constitutional morality?
06:09And BJP leaders have publicly called for changing of the Constitution
06:13should they get more than 400 seats in 2024.
06:17The people of India stopped that juggernaut.
06:20The Constitution gives us Article 326, which talks about universal adult franchise,
06:26but the government gives us vote-shori, SIR-based mass deletions,
06:32and election commission that behaves like the political extension of the ruling party.
06:39So, again and again, people of India have stopped this attack on the Constitution
06:45by limiting the BJP and by the sheer number, the sheer majority that they were asking for in 2024.
06:54You have 20 more seconds, Saral, because we gave you a two-minute window.
06:58You can use that.
06:59Oh, so I think, you know, in 2023, 143 opposition MPs were suspended.
07:08Parliament passed bills without zero debates.
07:11ED cases have jumped to more than 500% against the opposition.
07:16Conviction rate is less than 1%.
07:19All right, now time is up.
07:20So these are all the systematic attacks.
07:20I'll circle back to you for your two minutes.
07:22I'll cut across to Rajat Sethi while we mic up Radhika Kera.
07:25He's in the studio with us.
07:26But, Saral, you know, you forgot two points.
07:28And, you know, when you hark back to history,
07:31then I would reckon it would be a tad unfair
07:33when you're talking about the Constitution
07:35and where possibly the BJP devalued it
07:38and not touch upon the emergency period on your own.
07:42You also talk about, Saral, on, you know,
07:44how 2024 the BJP juggernaut was stopped
07:48in the name of Constitution Khatre Hai.
07:50That juggernaut now has been rolling over the Congress
07:52across four states.
07:53So by that benchmark, you know, it doesn't quite hold.
07:56But I'll circle back to you on that conversation.
07:58Rajat Sethi, I want to pull you in.
08:00The opposition seems to suggest as well today
08:03that ab toh sabse zada constitution khatre mein hai
08:07because you've had institution after institution,
08:11constitutional posts like that of the EC
08:13that stand compromised today.
08:16You know, vote chori ho rehi hai.
08:18All of that put together.
08:20This is actually, the debate is not settled.
08:22The debate is only just starting.
08:26Sir, thank you, Priti ji.
08:27Well, the point, the core point is,
08:31according to the Congress Party,
08:32constitution will be alive and thriving
08:34only when they are in power.
08:36Every other instance of time,
08:38constitution will be under threat.
08:39You know, this entire troop has been going on
08:42for the past decade or so with zero impact.
08:44Had they been, you know, looking within,
08:46they would have resolved the issue
08:47and figured out the real issues of the masses and the public.
08:50If I were to go into history,
08:52then the history will scream and screech
08:54on the top of the voice saying that the Congress is the one
08:56and the only party which is responsible
08:58for killing and destroying the spirit
09:00and shedding it for multiple times.
09:02I mean, you pick up anything.
09:03Just pick up how many times has the president's rule,
09:06the Article 356 invoked by the Congress Party
09:09when they were in central government.
09:11It's more than 90 times.
09:12I mean, I can go after sequence after sequence
09:15of what has happened.
09:16The very first amendment,
09:18when the freedom of speech was curtailed,
09:19who did it?
09:20It was their iconic leader, Pandit Jawahal al-Nehru.
09:23He did that.
09:24Look at the number of people who were put into jail
09:26during his era.
09:29Fast forward to Indira Gandhi.
09:30Look at the 39th amendment,
09:32when the prime minister's office
09:33was the very first time put beyond judicial review.
09:36So these are some of the things that they have done.
09:38An emergency is going to be the hallmark of Congress Party.
09:42And there cannot be any example in the past,
09:44in the future, any time,
09:46that this country is going to see,
09:47because the public has seen what all
09:49can an uncontrolled political party,
09:52driven by one family's command and control system,
09:55can unleash.
09:56Look at the internal democracy of the Congress Party itself.
09:59Our constitution providers,
10:01when they formulated certain laws
10:03for how political parties should be organized,
10:06internal elections was the first and foremost thing.
10:09Look at what has happened to the Congress Party.
10:11There is zero democracy internally.
10:13How can they boast about the country's democracy
10:15in the very first place?
10:16So constitution and Congress are oxymoronic.
10:19They don't go together.
10:20And that should rest the debate.
10:22So there is no point, Congress,
10:23for delving time into history.
10:26Because the history will throw up...
10:28Okay.

10:34who's seen many seasons of Indian politics
10:36and also in the last couple of years
10:38where constitution and the debate around it
10:41has held center stage.
10:42Shahid Siddiqui,
10:43do you see the debate being settled now?
10:45Something that at least politically
10:48had become a rallying force
10:49for the opposition in 2024?
10:52Priti,
10:53Indian constitution is a living document
10:55and it has stood the test of time.
10:57And we must understand that it's not...
11:00You know,
11:01it depends on who is running the state,
11:04the systems,
11:04the political system.
11:06And it has always...
11:07Every political party in power
11:09has tried to manipulate it,
11:12to pressurize it,
11:14to change it in a way
11:15that it suits them.
11:16But despite everything,
11:19it has been one of the finest pieces
11:21of, you know,
11:22written law.
11:23And it has been an instrument of change,
11:25a huge change.
11:26It has just not been a letter of law
11:29or of political systems.
11:30It has brought about social,
11:32economic, political change.
11:33And what is most intrinsic
11:35to our constitution
11:36is the equality before law,
11:39the gender equality
11:40and cultural equality.
11:44But above that,
11:45secularism is intrinsic
11:47to our constitution.
11:49Every single act
11:51of our constitution
11:52is based on the idea
11:54of secularism.
11:55That is,
11:55everyone is equal,
11:57rising above religious differences
12:00and religion
12:01does not come into play
12:03in deciding
12:04any of our
12:06political institutions.
12:08And therefore,
12:08the only threat
12:09I find today
12:10to our constitution
12:12is from
12:13those who are talking
12:14of a Hindu rashtra
12:16or a Muslim rashtra
12:18or a Sikh rashtra
12:19or any kind of rashtra
12:20based on religion.
12:21So that is a threat
12:23and all the parties
12:24should stand up
12:25and see to it
12:25that that does not happen
12:27because if that happens
12:28then the constitution,
12:30very fundamental
12:30of the constitution
12:31is tarpated,
12:32it is destroyed.
12:34And secondly,
12:35is the idea
12:36of equality
12:37before law
12:37and the institutions
12:38because the constitution
12:39has established
12:40some of the finest
12:41independent institutions
12:42especially the institution
12:43of judiciary,
12:45our federal system,
12:46all these have to be protected
12:47and ultimately
12:49it's the people
12:49of this country,
12:50the citizens
12:50who have to stand up
12:51and protect the constitution.
12:53The parties are not
12:53going to do that.
12:54People have to do that.
12:55All right,
12:56the people have to do it.
12:57I want to bring in

13:04a list on how
13:05over time
13:06in the last
13:07decade or so
13:09the BJP
13:11has duly
13:12point by point
13:12compromised
13:13the constitution
13:14of this country.

13:19While the nation today
13:20bore down
13:21to the constitution
13:22as the
13:23essence
13:24of our country,
13:26the Congress
13:26is doing
13:26what it has been doing
13:27for the past 75 years,
13:29lecturing
13:29and dismantling
13:31the actual
13:32essence of the constitution.
13:33Whether it was
13:34disrespecting
13:35Baba Sahib Ambedkar Ji,
13:37Congress
13:37not only went on
13:38to defeat him
13:39in an election,
13:40they even ensured
13:41that his portrait
13:41was not there
13:42in the central hall.
13:44Having said that,
13:45let's just
13:45instead of going back
13:46to history
13:47where everybody
13:47before me
13:48has already spoken
13:49about how they got
13:50an emergency,
13:50how 90 governments
13:51were toppled,
13:52going against
13:53the constitution.
13:55But what we saw
13:55today in parliament
13:56was something
13:57which was very shameful.
13:59Yes, we know
14:00Rahul Gandhi's fight
14:01is against the Indian state
14:02but today
14:03while everyone
14:03was standing
14:05and singing
14:06the national anthem
14:07and everyone
14:08bowed down after that,
14:09what was Rahul Gandhi
14:10doing while this
14:11national anthem
14:11was being sung?
14:12He was looking here,
14:13there and everywhere.
14:15And you know,
14:16Preeti,
14:17when the national anthem
14:17is being sung,
14:18we stand straight
14:19in attention.
14:20You're not supposed
14:20to be looking here
14:21and there
14:21that you're disrespecting
14:23the actual essence
14:24of the,
14:24and you can

14:27but you don't respect
14:28the country,

14:40Sri Narendra Modi Ji
14:42that the constitution day
14:44is being institutionalized
14:45today.
14:46And also,
14:47we are the ones
14:47who have removed
14:48Article 370,
14:49insured reservation
14:49for EWS,
14:50in short,
14:51triple 3 lakh is removed,
14:52you went to court
14:53to remove it.
14:54We are also ensured
14:55that women are getting
14:56equal representation.
14:58That is the essence
14:59of the constitution
15:00and what Baba Ambedkar Ji
15:01actually wanted,
15:03not what the congress
15:04is doing,
15:04getting emergency
15:06into the country,
15:06toppling governments.
15:08When have they even
15:08once in the entire tenure
15:10respected the constitution?
15:11They are the ones
15:12who have even changed
15:13the constitution
15:14time and again.

15:15the constitution
15:16that we have
15:16has also previously
15:17been changed
15:18by the congress.

16:23voted us back
16:24in the government
16:25with a thumping majority.

16:33emergency was wrong
16:34was proved wrong
16:35by the mandate
16:37that people of India
16:38gave to the
16:38Indira Gandhiji
16:39in the election
16:40that was held
16:41two years later.

16:44kept claiming
16:46that they are
16:46the protectors
16:47of the constitution.
16:49Let me believe her.

19:04be invoked
19:05by future generations
19:06of this country.
19:07This constitution
19:08is a living
19:09and breathing document
19:10and thriving document
19:11not courtesy Congress
19:13but because of
19:14the people
19:14of this country
19:15and if any party
19:16we BJP
19:17or Congress
19:17attempt
19:18any kind of
19:19onslaught
19:21on the constitution
19:21will face
19:22the wrath
19:22of this public
19:23and this public
19:24you cannot discount
19:25if they are showing you
19:26that you
19:26are only worthy
19:28of sitting in the opposition
19:29that is a time
19:30for you to reflect.
19:31Reflect that
19:32what have you
19:32fundamentally done
19:33over decades
19:34and decades
19:35that you have now
19:35reached to a point
19:36of no return
19:37and a point of extinction.
19:38This is something
19:39as a sober moment
19:40for the Congress party
19:41to think that
19:42where have you brought in?
19:43Opposition
19:43is a sacred space
19:45in the democracy
19:46where you can
19:47keep the government
19:48in checks and balances
19:49but what have you done
19:50with your own actions?
19:52You have completely
19:53eroded the space
19:53of opposition now
19:54you find it hard
19:55to even claim
19:56an opposition
19:56you know
19:58the leader of opposition
19:59in several states
20:00of this country.
20:01That is the level
20:02on which you have
20:03stooped down to.
20:04So it is time
20:05for introspection
20:05and I think
20:06the public here
20:07is smart
20:09is aware
20:10and is the biggest
20:10custodian of the constitution
20:12none of the political parties is.

20:15all sides of the argument
20:16are being heard
20:17by the people
20:17so who has truly eroded
20:18the essence
20:20of the constitution
20:21the jury is out there

20:23the people will decide

20:32has disregarded it more

20:37where it all started
20:38was 2024 election

20:41the congress bolstered
20:42on the fact
20:43where certain leaders
20:43of the BJP
20:44at that point of time
20:45hinted
20:45that they could change
20:46the constitution
20:47if they come into power
20:48and that snowballed
20:49into a massive pull
20:51for the congress
20:52and that is what
20:53they tried to ride
20:53that election on
20:55in 2024
20:55some suggest
20:56it worked for them
20:57but now Shahid Siddiqui
20:59as a political analyst
21:00we have seen election
21:01after election
21:01the mandate going
21:03in the favor of NDA
21:04is that debate settled
21:06is constitutional
21:07khatre mein hai
21:08still a relevant
21:09talking point
21:10for the opposition
21:11it may be a relevant
21:13talking point
21:14for the opposition
21:14but the fact remains
21:15that the constitution
21:16is always to be guarded
21:18it is always in danger
21:20but it has to be guarded
21:22by everyone
21:23in this country
21:24and we must also understand
21:26one point
21:26that emergency
21:27was declared
21:28in this country
21:28according to the procedures
21:29of the constitution
21:30it was not against
21:31the constitution
21:32and it was also
21:34very soon
21:36the congress party
21:37realized
21:38that it was counterproductive
21:40and within 27 months
21:41they did away
21:43with the idea
21:44of emergency
21:44and the second point
21:46that only
21:47one party
21:49was all parties
21:50came together
21:50all political
21:51you know
21:52ideas came together
21:53to make this constitution
21:54and therefore
21:55to just give credit
21:57to any one party
21:58or any one
21:59ideology
22:00is not correct
22:01but the fact
22:03remains that
22:04BJP
22:04as an ideology
22:06when it was
22:06Jansang
22:07and later on
22:08BJP avtar
22:09has never been
22:11happy with the constitution
22:12they have not been
22:14happy with
22:14various ideas
22:15especially
22:16the idea of
22:17secular
22:17basis of the constitution
22:19and many of their
22:21leaders have
22:21always been claiming
22:22that if they come
22:23back to power
22:24with a two-third
22:25majority
22:26or a very clear
22:27majority
22:28they will
22:29change the constitution
22:31do away with
22:31the constitution
22:32I don't mind
22:34if they remove
22:34secular and socialist
22:36from the preamble
22:37because that doesn't
22:39matter
22:39the very
22:40as I said
22:41earlier
22:42the very basis
22:43of the constitution
22:44is secular
22:45so if you
22:46you cannot do
22:47away with the idea
22:48of secularism
22:49without doing away
22:50with the constitution
22:50lock, stock and barrel
22:52and therefore
22:52the constitution
22:53is to be protected
22:55by the judiciary
22:56has to stand up
22:58and all those
