00:00Former FBI Director James Comey and New York Attorney General Letitia James are off the hook,
00:05legally speaking. Well, at least for the time being. The government's cases against them were
00:10tossed because U.S. District Judge Cameron Curry, a President Bill Clinton appointee,
00:15ruled that U.S. Attorney Lindsay Halligan wasn't properly appointed to her position.
00:19Now, I've talked a lot about Halligan and the issues regarding her handling of the grand jury
00:23in the Comey case. Now, that is being reviewed by a totally different judge, so different
00:28circumstance. As for the rules that govern appointing a U.S. Attorney, well, they're pretty
00:33clear. Halligan's predecessor was filling a vacancy as a 120-day interim appointment by Attorney General
00:40Pam Bondi. The thing is, the AG gets one shot until Congress approves a permanent replacement.
00:47Judge Curry's decision dismissed the cases without prejudice, and that means they could be brought up
00:53again if done so properly. But here's a big but. The five-year statute of limitations has run out
01:00on Comey's charges specifically, meaning that his case cannot be reopened. White House Press Secretary
01:07Caroline Levitt promised that the Justice Department would appeal to ruling. The Pentagon is looking into
01:13what it's calling, quote, serious allegations of misconduct against Arizona Democratic Senator
01:18Mark Kelly. The investigation revolves around the recent video I talked about here on the pod.
01:23Kelly and five of his Democratic colleagues in Congress shared it online, suggesting that members
01:28of the military should refuse orders from commanding officers if those orders were illegal.
01:33President Trump called the video seditious, which is a crime punishable by death. The Department of War
01:38has now launched an investigation. Secretary Pete Hegseth saying in a statement, quote,
01:42this matter will be handled in compliance with military law, ensuring due process in impartiality.
01:48All service members are reminded that they have a legal obligation under the Uniform Code of
01:52Military Justice to obey lawful orders, and that orders are presumed to be lawful. Hegseth explained
01:59on X that Kelly is the only one of the, as he called them, seditious six, who falls under the
02:04department's jurisdiction because he retired as a naval officer. Turning Point USA CEO Erica Kirk had a prayer
02:12following the news of her husband, Charlie's assassination back in September. She was
02:16praying that she was pregnant. It's something she revealed on Megyn Kelly's show.
02:20We wanted to have four. Yeah. And I was praying to God that I was pregnant when he got murdered.
02:30Oh, wow. I thought of that once. Just like whether it was meant to be or whether we'd get news like that.
02:39I was like, oh, goodness, that would be the ultimate blessing out of this catastrophe.
02:44Erica and Charlie Kirk were parents to a daughter and son before the conservative activist was gunned
02:49down. His widow went on to say that her husband's murder has prompted her to tell young couples that
02:53she meets not to wait to have kids, telling them, quote, you can always go back to work. You can never
02:58go back to having children.
