00:00It was New Year's Eve, so there were still
00:28a lot of Christmas decorations up, and we were still in the holiday spirit.
00:34Everybody was celebrating.
00:36I had a two-month-old, and we were taking the opportunity to have a night out while my
00:42parents were watching my son.
00:45We went to the restaurant that I worked at.
00:48I remember having a good time.
00:51About 11 o'clock, somebody at the restaurant had said they heard over the scanner that there
00:56was a stabbing.
00:59We figured it was just some drunk idiot got in a fight and pulled out a knife, and we'll
01:05find out who it is later, because it's small town, Massachusetts.
01:09We're going to hear about it.
01:11But while we were heading home to my parents' house on Elm Street, we saw about five or six
01:19police cars on the road, which is not normal.
01:21I never thought that I would be sucked into this nightmare.
01:25we're going to hear?

02:18I was the on-call investigator, so I was just at home with the family.
02:27It was New Year's Eve, and we were waiting for the ball to drop when I got that phone call.
02:39I get a call from the Middleborough Police Department reporting an apparent homicide on Old Center Street in Middleborough, Massachusetts.
02:48The residence is located in a very rural part of Middleborough.
02:55It's across from a cranberry bog, and it's surrounded by woods.
02:58When I first arrived at the scene, it was cold outside.
03:07There had been a light snowfall.
03:11It was an inch or less.
03:13I was introduced to Mr. Gillen, who had discovered his oldest daughter, Tara, inside of the den with stab wounds.
03:20She was covered in blood.
03:32When I first saw Tara, you could immediately see the brutality that was involved in this crime.
03:39It was overkill.
03:42Tara was stabbed at least 21 times.
03:4514 times in the upper back.
03:57Three times in the neck.
04:03Leaving a gaping injury.
04:05Mr. Gillen was, needless to say, very upset.
04:16But he was able to provide the details we needed.
04:21Tara was 20 years old at the time.
04:23She was a sophomore from Indiana University.
04:28And was an English major.
04:29And she was home for the Christmas break between semesters.
04:38That evening, December 31st, was he and his wife's anniversary.
04:43So they had chosen to make plans to go out for dinner to celebrate.
04:48They had invited Tara to go with them, but she had declined and chose to stay home.
04:53They returned about 11 p.m., and as he pulled up the driveway, he saw an open door.
05:07He immediately ran into the house.
05:18Entered the den area, which is right off of the kitchen.
05:20And he saw his daughter, Tara, lying on her back, naked from the waist down, covered in blood,
05:35with a gaping wound to her neck.
05:40And she was unresponsive.
05:45He approaches Tara.
05:50He hears a noise out in this hot tub room that is adjacent to the den.
05:57He immediately yelled out,
05:59I'll kill you, you bastard.
06:09When he got out into that room, there was nobody there.
06:12But he felt a blast of cold air, and that oriented him to realize that the window had been opened.
06:25He also heard noises in the woods that were consistent with somebody fleeing.
06:33The breaking of branches, the squashing of snow.
06:35Mr. Gillen advised us that he located a blanket, and he placed it over his daughter.
06:56Mr. Gillen remained by his daughter's side until the police arrived.
07:00As a person, and as a parent, and as the father of a daughter,
07:06I just cannot imagine what that felt like to make that discovery.
07:13Neither then, or frankly, today, how you would even go on and deal with that.
07:18It's just tragic, tragic.
07:20In any homicide, you look at various factors.
07:28She could have been targeted by a spurred lover or boyfriend.
07:32Her pants and her underwear had been pulled down to the ankle area.
07:39So you would assume that you may have a sexual assault involved as well.
07:45Did she have an old acquaintance that knew she was in town?
07:48And maybe they knew that the parents went out and she was going to be alone?
07:54It was very difficult to make a determination whether Tara was targeted
07:58or if this was just a random crime.
08:03December 31st, 1996, Old Center Street, Middleborough.
08:10Crime Scene Services, Middleborough.
08:13Videotaping.
08:13As we entered the house, things were tipped over.
08:19It was just an absolute mess.
08:21Could have been part of a burglary or somebody looking for valuables.
08:26We noted a cigarette butt in the middle of the carpeted hallway
08:30or the upstairs portion of the house.
08:34That was strange to us.
08:36When I inspected the area that Mr. Gillen described
08:42from which he chased the assailant out of the house,
08:45the room contained a hot tub.
08:49There was a window that had opened up.
08:51Observations of that window indicated a forced exit.
08:56When processing the scene,
08:57they also found a partial footwear impression on the hot tub cover.
09:01It was pointed in the direction away from the home.
09:08So that gave investigators the indication
09:11that that was a point of exit.
09:14And then we had a second set of matching shoe prints
09:18that went around the side of the house.
09:20The footwear impression had this wavy tread
09:24and it had a circle in the ball of the foot area.
09:29We take photographs of the impression
09:31to give to investigating officers.
09:34It was a tread pattern that was, to me,
09:37easily recognizable as a casual sneaker.
09:40It's virgin snow,
09:42so this likely was from the assailant leaving the scene.
09:46That's why that one shoe imprint impression is so important,
09:49because it's just absolutely pristine.
09:52So based on that information,
09:54we began an initial tracking of the suspect.
09:59There was no murder weapon discovered at the scene,
10:02so one would have to believe that the suspect was still armed.
10:06Officers were looking for footprints in the snow,
10:10broken branches,
10:12property that he might have stolen and discarded,
10:15things that didn't belong there.
10:17Additionally, a safe police helicopter was put in the air.
10:23All patrols were on the lookout in this area.
10:25And we had canines to find the assailant.
10:30Investigators had followed the trail,
10:32starting where he exited through the broken window.
10:39Ultimately, where they lost the trail in the Cranberry Block.
10:42After seeing what he did to the victim,
10:52I would say that there was a good possibility
10:54if he encountered someone,
10:56he would repeat his actions.
11:00Was this killing personally,
11:03given the brutality that was involved in this crime?
11:06Or was it just a total random act of violence?
11:11Someone who was out for blood?
11:12We didn't know what we were up against with this killer
11:29who had fled the scene.
11:31If he was bold enough to kill Tara Gillen on New Year's Eve,
11:34he could do it again.
11:35There was a heavy police presence,
11:38cruisers going up and down the streets.
11:41There were helicopters up and canines.
11:44Living in a small town, word travels very fast.
11:48Everywhere we went,
11:49that's all everybody was talking about.
11:51I didn't think that something like that would be possible
11:57just because of the atmosphere in our town
12:00being so peaceful.
12:05A lot of time was spent with families and friends
12:07and cookouts and backyard parties
12:09and, of course, rooting for all the Boston sports teams
12:12that might have been playing at the time.
12:15It's a small town, a lot of working people,
12:19Cranberry Bogs.
12:19Middelboro would not be the type of town
12:22where you'd find a vicious murder.
12:25One of the things that investigators will look at
12:28is the neighbors within the immediate area.
12:33So when detectives were advised
12:35that there was a registered sex offender
12:37living in that home
12:38immediately behind the victim's house,
12:42we raced to the house
12:44hoping that this could be the break we needed.
12:49There's the belief that this person
12:51could have been watching her
12:53while she was home for the holidays.
12:59Stalking her, watching her every move.
13:05This was a slam dunk.
13:07A sex offender living directly behind the victim.
13:17But the resident advised them
13:39that the sexual offender was no longer there
13:41because he was currently incarcerated.
13:43Whenever you have an investigation or homicide,
13:53your chances of solving it
13:54within the first 48 hours are 80%.
13:57From there, it begins to go down quickly
13:59with each ensuing day.
14:02So you flood the neighborhood with investigators,
14:06you're talking to neighbors,
14:07you're talking to friends,
14:08you're trying to get as much information as you can.
14:14We were working down the street,
14:17knocking on doors,
14:18trying to get information.
14:20When we were approached by a neighbor,
14:22this neighbor advised detectives.
14:24He found that door was open to his hayloft.
14:27Once detectives were told
14:39that the door to this hayloft
14:41was always kept shut,
14:46they figured it would be a good thing
14:50to check it out
14:51to see if someone was possibly hiding up there.
14:53One of the detectives was shown the open door
14:58by the owner of the property.
15:01The detective went up into the loft
15:03to check it out.
15:23The detective went up into the hotel
15:27at the hospital
15:28and then they forgot to check it out.
15:30Once but not,
15:30it has been a matter of suspect
15:31of the people to find himself
15:32at the middle of the building.
15:33If you should find myself
15:33or you should have a low matter
15:34or you should have a good thing
15:34to be able to walk through the house
15:35or if you have a good thing
15:36or you should be a good thing
15:36to go out there.
15:37Back to the building
15:38and then you should be a good thing
15:39and you should have decided
15:39here to go out there.
15:40To be honest,
15:41I bet I've been a good thing
15:42to be honest
15:42and I think
15:43to be honest
15:43and I've been a good thing
15:44for my advice
15:45and that our neighbor
15:46to be honest
15:46and I've been a good
15:46and I do
15:47to be honest
15:53There was nothing.
16:01It was just full of cobwebs up in the haylot.
16:15While detectives went to a house a few doors down from the scene of the crime,
16:19the resident stated that something odd did happen earlier in the week.
16:36She stated that when she was sleeping, she heard a noise.
16:49She pulled back the curtain, didn't see anything, and went back to sleep.
17:02But it did make her feel uncomfortable, as she felt that someone could be watching her.
17:07This is a lead that had to be considered because the neighbor lived so close to the victim
17:14that it was a possibility that she could have been watched by the perpetrator.
17:19And he was just hunting for his perfect victim.
17:25The local detective was asked who in this neighborhood could be involved in something like this.
17:30The detective talked about one individual who, in the past, had committed some vandalism.
17:38It was a rumor, although never confirmed, that he actually pulled a knife out on his parents
17:44at some particular point in time.
17:48That individual lived approximately a mile away from the Gillens.
17:54And to our amazement, shoe prints hit the crime scene.
18:00It matched a different set of shoe prints found close to this kid's house.
18:08One of the things that I do is footwear comparisons between shoes and impressions left behind of the scene.
18:15My goal is to identify the shoe, not only the manufacturer, but the actual model of the shoe.
18:22In this particular case, it was made by Puma, which is an athletic shoe company.
18:27I contacted the factory, and ironically, it was located here in Massachusetts.
18:36So right away, they were able to get back to me and said,
18:39hey, listen, this was a very unique shoe.
18:43This is a prototype. This didn't even make production.
18:46There's one shoe, there's one killer.
18:48Find the shoe, find the killer.
18:50During those initial hours of that search for Tara's killer,
19:05we learned about a young man, Jonas Fell.
19:09This is a kid that, according to the police, had had repeated interactions with.
19:14He was well known to them, and he lived less than a mile from Tara Gill.
19:21We had shoe prints at the crime scene that matched shoe prints that brought us nearly to the Fell House,
19:28in that direction, and very close to it.
19:31When detectives hear that type of information, right away, they perk up.
19:37Here we have a troubled kid.
19:39The vandalism, potentially, rumor that he's pulled a knife.
19:42And here we have a stabbing that's occurred to Tara.
19:46We decided to immediately go over to this individual's house and conduct an interview.
19:57As we arrived at that house, it was early morning.
20:01It was obvious that a party had taken place the evening before,
20:05evidence of bottles and cans from a get-together.
20:07During an interview with Mr. Fell, Jonas' father,
20:15we learned that his son had hosted a New Year's Eve party at the house in the basement the night before.
20:22As far as he knew, it was just a regular party with the kids.
20:28He had said that he, the father, had gone out the night before with his wife.
20:32They ultimately come home around 9 o'clock or so,
20:36and they found Jonas at the house,
20:39and there was nothing out of sorts or caused any reason for concern by him.
20:45Jonas had stayed there the entire time.
20:51But one of the things investigators still had questions about
20:54was did Jonas pull a knife out on them at any particular time at all?
21:02He told them that that was just a rumor that was going around the town.
21:05It had never happened.
21:10So in following the footprints from the Gillen house to Jonas' house,
21:15we had to be concerned with the fact that the killer could be one of the partygoers.
21:22Could the assailant be somewhere in the neighborhood, perhaps even watching us?
21:27We just didn't know.
21:32What we were told is this group of individuals met up at the local McDonald's.
21:40They got together around the 7 o'clock hour
21:42and then returned to Jonas' house for a planned New Year's Eve party.
21:51We know from our interviews that these partygoers drank beer,
21:55they had Goldschlager,
21:57that they played the games that these youngsters would play in terms of drinking games,
22:01but nothing ever got out of hand.
22:05We stopped by the party around 9.
22:16It was pretty early on in the night
22:18because we had plans to go out afterwards.
22:20There was about 20 or so kids there when we stopped there.
22:27Jonas was a friend of my brother's.
22:29It was more so my brother's group of friends.
22:33It seemed like they were having fun.
22:34Everybody was in good spirits.
22:37But it was just a crowded group of younger kids.
22:41So we left.
22:41I absolutely did not think anything that was going on was unusual at all.
22:54During the course of talking with these partygoers,
22:57a common theme started to develop.
22:59Several individuals indicated one particular individual
23:04got into an argument and ended up leaving the party early.
23:11This individual was intimately involved with his girlfriend at the party.
23:15And at some point in time before he finished,
23:22she went to use the restroom and then never returned.
23:25So he became upset at that.
23:36This is around the time that that altercation or that verbal confrontation occurred.
23:41So whether he was upset and got into it with his girlfriend
23:46or just was being an ass because he was upset,
23:49it was not clear to us,
23:50but he was asked to leave the party by Jonas.
23:57So he left the house upset.
23:59His girlfriend went with him,
24:01trying to talk him into coming back to the party,
24:03but was unsuccessful.
24:05It was a cold evening.
24:06She got cold and she returned to the party
24:08and actually remained there the rest of the night.
24:11We didn't know if this was just some angry kid
24:18who ended up going home
24:19or if this was our actual killer.
24:28Less than 24 hours after Tara's murder,
24:35the name Ryan Burgess was given to us
24:37as an individual who had attended the party partially.
24:43In between the 9 and 10 p.m. hour,
24:46he'd gotten into the fight with a host
24:47and had left the party
24:50in the direction of the Gillen home.
24:52On his way home,
24:57the short amount of time
24:58before Tara Gillen was brutally murdered,
25:02and frankly, it had been the biggest break
25:03outside of that initial shoe impression
25:05that we had gotten.
25:08As investigators talked to various individuals
25:11who had attended the party,
25:13they described Mr. Burgess as an 18-year-old,
25:15was a quiet individual,
25:17kept to himself,
25:18had been bullied in the past.
25:21He wasn't an individual
25:22that had really gotten into trouble,
25:24wasn't an individual to start trouble.
25:27Investigators were able to get in contact
25:29with Ryan's girlfriend.
25:31She certainly did admit
25:32that they were together that night.
25:34She went back to the party
25:35and he went off on his own,
25:36but she just didn't think
25:38that he was the type of guy
25:40that could have committed that type of crime.
25:41The investigators started to check
25:47into Mr. Burgess's background.
25:50They found out that he didn't live
25:51that far down the road
25:52from the Gillen residence.
25:55So right away again,
25:56another indicator that
25:57certainly they needed to talk to Mr. Burgess.
26:02Detectives found out that
26:03Ryan Burgess was living
26:05with the Shelley family on Elm Street.
26:07My mom was a big heart
26:12and she had no problem
26:16opening her home
26:17to anybody that needed it.
26:19And when my brother said,
26:21Ryan needs a bed to sleep in,
26:23she said, absolutely.
26:27Ryan actually grew really close
26:29with my family.
26:30He would do anything for anybody.
26:33There were some kids in town
26:39that kind of felt like
26:41Ryan was a target.
26:43My brother would fight
26:45some of his battles for him
26:46when he needed to.
26:48Ryan was just more of a passive
26:49kind of kid.
26:51Ryan came from a tough background,
26:53but he was just the kind of kid
26:55that needed a break
26:56and needed someone to love him.
26:57The night of the party,
27:02I'd only seen him
27:03for an instant.
27:05When we were leaving,
27:07Ryan seemed like
27:08he had been feeling pretty good.
27:14That night,
27:15we had got back
27:16to my parents' house.
27:18It was just before midnight.
27:21And my son was already sleeping.
27:22And we were just sitting
27:30in the living room
27:30waiting for the ball to drop.
27:49Ryan had walked in the door.
27:52He was soaking wet
28:01from his waist down.
28:05And I remember looking at him like,
28:08for lack of better words,
28:10what are you doing?
28:11You know,
28:11and he looked at me
28:12and he's like,
28:13oh, I just, you know,
28:14I walked home
28:16and this and that.
28:18I made a comment
28:19about him being an idiot
28:20because he walked
28:21all the way home
28:22and we would have went
28:23and picked him up
28:24if he needed a ride.
28:35Ryan went into the bedroom
28:37that he was sharing
28:38with my brother,
28:39changed,
28:40got some sweatpants on
28:41and came out
28:42and sat on the couch
28:43and just talked to us.
28:49And I said,
28:51you know,
28:51we heard somebody
28:52got stabbed up
28:53on Old Center Street.
28:55You know,
28:55you were up that way.
28:56You stabbed anybody tonight?
28:59No, no, no.
29:00You know,
29:00I just,
29:00in his normal way,
29:02he was a fairly quiet kid.
29:05He didn't talk to you,
29:06like, face to face
29:07because he was always,
29:08like, down,
29:09like, you know,
29:10like,
29:10no, no, I wasn't.
29:25He just laughed it off
29:27and said,
29:28no, I have no idea.
29:34We left.
29:35He went to bed.
29:36And the night kind of
29:37just ended.
29:49When we had woken up,
29:51my dad called.
29:52I need you guys
29:53to come over here.
29:55He just said
29:56the state police
29:57were there
29:57on Elm Street.
30:00Obviously,
30:01it was a frantic drive
30:02over there
30:02because we had to know
30:04what was going on.
30:06We were going through
30:07every scenario
30:08in our head,
30:09you know,
30:10what we thought
30:10had happened.
30:15When we got there,
30:16there were reporters
30:17wanting to speak with us
30:19and it seemed
30:21a little bit chaotic.
30:23With all of the chaos
30:25going on,
30:26detectives in the house
30:27getting various
30:29bits of information,
30:30it was pretty confusing
30:33and emotional
30:34at that time.
30:36And my dad said,
30:38Ryan has been talked
30:39to about
30:40a break-in
30:41and a murder.
30:46He's going through hell
30:47because he's getting
30:48accused of something
30:49he didn't do.
30:50How do you know
30:51he didn't do it?
30:52Because I know
30:53he didn't do it.
30:54I can just tell.
30:55I was thinking
30:57they must have
30:57had the wrong person.
31:02Oh,
31:02I didn't want to cry.
31:06There was no way
31:07he had the capability
31:09of doing that.
31:10He's harmless.
31:11He's a good soul.
31:13He's got such a big heart.
31:14How could he possibly
31:16kill somebody?
31:17And I remember
31:18talking to the state troopers
31:19and saying,
31:20there's no way
31:21he did this.
31:22He got the wrong person.
31:23When we announced
31:32ourselves
31:33at the Elm Street residence,
31:36Mrs. Shelley was surprised
31:37that we were there.
31:39We indicated to her
31:40that we had interest
31:41in speaking
31:42with Ryan Burgess.
31:44She indicated
31:44that Ryan was currently
31:46taking a shower.
31:53When Ryan came out
31:57of the shower,
31:58we introduced ourselves
32:00to him.
32:02We immediately observed
32:04that he had a cut
32:05to his left upper lip.
32:12In addition,
32:13he had several
32:14random scratches
32:16on both of his forearms.
32:17When they asked him
32:19how he got these marks,
32:21he stated he was
32:22at a fight with somebody
32:23but he couldn't remember
32:24who it was.
32:27And we asked him
32:28if we might be able
32:29to see the clothing
32:30that he was wearing
32:30the night before.
32:33He consented to that
32:34and actually led us
32:35into his bedroom.
32:39As investigators
32:40are going through
32:41his room
32:42and they asked
32:43Mr. Burgess
32:44for the shoes
32:45he had been wearing
32:45the night before,
32:46he reached under the bed,
32:55pulled out a pair
32:56of pumas,
32:57blue pumas.
33:03They looked
33:04at the shoes
33:04but immediately
33:05their attention
33:06was drawn
33:06to the outsole.
33:09What they noted
33:10was the same
33:11wavy pattern
33:12with the circle
33:13that they had seen
33:14the night before.
33:16That was the golden ticket.
33:18Those shoes matched
33:20exactly what we saw
33:21at the Gilling crime scene.
33:24This is when I knew
33:26we had our suspect.
33:30We left the residence
33:32and began driving
33:33to the state police barracks
33:35which was actually
33:36very close
33:36to the Elm Street location.
33:38when we said to him,
33:41Ryan,
33:41we know what happened
33:42last night.
33:43And he said to us,
33:44I don't know
33:45what you're talking about.
33:47It's Ryan.
33:48Did you enter
33:49a house
33:50on Old Center Street?
33:52Maybe to get warm?
33:54He denied that.
33:56And we said,
33:57Ryan,
33:58maybe the person
33:58even let you in.
34:01Maybe they even
34:02came on to you.
34:03And to our amazement,
34:05he said,
34:05yeah,
34:06she came on to me.
34:07She led me on.
34:12That was the first
34:13indication from him,
34:14almost a soft admission,
34:15this putting him
34:16at the residence
34:17with Tara.
34:18This was big.
34:24But we pressed it
34:25a little bit more.
34:27We said,
34:28Ryan,
34:29we think something
34:29bad happened
34:30in that house.
34:33And that's when
34:34Mr. Burgess
34:35started to come around
34:36and talk about
34:38what had actually happened.
34:41He said after a fight
34:43with his girlfriend,
34:44he left the fell house
34:45at around 9 p.m.
34:48He actually sees a car
35:02back out of a driveway
35:03at the Gillen residence.
35:11He went around
35:12the side of the house.
35:18He entered a screened
35:26porch area
35:26through a storm door
35:27that was unlocked.
35:31He could see
35:32a young female
35:33watching TV.
35:35He was surprised
35:48that all of a sudden
35:49she showed up
35:49right at the door
35:50face to face
35:53with him
35:53just through the glass.
35:58She asked him
35:59who he was
36:00and what he wanted
36:01and his response was,
36:02I'm friends
36:03with your sister.
36:19Somehow,
36:20the door ends up opening
36:21and she tried
36:22to run away from him.
36:24and he caught up
36:38with her.
36:42Tara screamed.
36:46And when she screamed,
36:48he reached up
36:48with both hands
36:49and began strangling her.
36:51He continued
36:56to squeeze
36:58and strangle her.
37:03She fell to the floor.
37:11And while she laid there
37:13gasping for breath,
37:14trying to breathe,
37:15caught him to him,
37:16he went out
37:17into the kitchen.
37:18He retrieved
37:21a steak knife
37:22and as Tara
37:23continued
37:23to try to breathe,
37:26she saw him coming
37:31and tried
37:33to run away from him.
37:36But she fell down
37:38on the ground.
37:38And that's when
37:54he began
37:55to stab her.
37:58At least
37:5921 times.
38:00He had removed
38:08her pants
38:09and he stated
38:11to us
38:11that he
38:12had intercourse
38:13with her.
38:16Ryan stated
38:17after ransacking
38:18the house
38:19and had his cigarette,
38:21he heard
38:21a car approaching
38:22and at this time
38:24he knew
38:24he had to get
38:25out of the house.
38:25That's when
38:28Wister Gillen
38:29had come home
38:30and found her.
38:34Horribly horrific.
38:37It's just
38:38the total randomness
38:39of that evening
38:41to put all these pieces
38:42in place
38:43with the ultimate loss
38:45of Tara's life
38:46is just
38:46incomprehensible.
38:48When I found out
38:52what had transpired
38:54and how brutal
38:55everything was,
38:57that was a tough moment.
39:04Several days later,
39:05with Ryan's help,
39:06he was able
39:07to guide us
39:08to the location
39:09of the murder weapon.
39:12Ryan stated
39:12that while he was running,
39:14he threw
39:14the knife
39:15in the darkness
39:16into what he believed
39:19was a cranberry bug
39:20and we started
39:22walking along
39:23the edge
39:23of the cranberry bug
39:24and somebody
39:27found it.
39:31We found out
39:32that Ryan
39:33dropped out of school
39:33in the ninth grade,
39:36got involved
39:36with drugs
39:37and had a history
39:39of breaking
39:40and entering.
39:41By 1996,
39:42his parents
39:43had actually
39:43put him out
39:44of the house
39:44and that's when
39:45he met the Shelleys
39:46and the Shelleys
39:47took him in
39:48and gave him
39:49a place
39:50to stay
39:50at their home.
39:55Ryan Burgess
39:56was ultimately
