00:00Silicon Valley is a place where people's dreams can turn into reality and when you succeed in
00:15Silicon Valley it's awesome you make it big you're making a lot of money but it can also
00:21be a place where those dreams can turn into nightmares sergeant Sandra Brown Palo Alto
00:27police department Silicon Valley has advanced so much since I was a little girl it has become the
00:33epicenter of technology throughout the entire world it's amazing I spent my career investigating
00:40major crimes in Silicon Valley like Janine Harms Janine was working in Silicon Valley and she
00:49was doing really well there she was a woman who was handling millions of dollars of contracts
00:54you just had this sense that she was taking the world on and then everything changed
01:02she's never not shown up for work and that's when I was like oh god something is really wrong
01:09it was big news all over Silicon Valley police have received dozens of tips from the public
01:16but nothing that looks like a case breaker you know how can this get any worse
01:21I knew Janine since we were infants our parents were friends so that's how we were drawn together
01:47and as we got older we chose each other as good friends if you were to meet her on the surface you
01:55would like her because first of all she was beautiful and she had a really good sense of
02:01humor cake and Neapolitan ice cream is all I have to say a lot of the humor was very self-effacing so she
02:09came off very human as well as being beautiful people were naturally drawn to her she had two
02:21older brothers Craig was the oldest Wayne was second oldest then Janine was third can you say hi to the
02:27camera hi camera they were a pretty close family and their family had a very sort of sarcastic humor they
02:35were all really funny people I see myself a little bit in Janine Harms we both grew up in the Bay Area
02:48Janine Harms went to San Jose State and I went to San Jose State we're roughly the same age but she
02:56graduated with a degree in liberal arts and I graduated with a degree in criminal justice
03:02Janine was hired straight out of college for Amdal Corporation which was a major company in Silicon
03:11Valley for its time she had a job as a purchasing agent and she was doing really well there had been
03:20promoted like five times I think really loved what she was doing and loved her co-workers and was very
03:26happy with her job there Amdal was a great reputable company here in Silicon Valley they made mainframe
03:35computers and the founder had worked at IBM before and came up with a way to use its technology to build
03:42his own company I think it was a really good company for her to work for Amdal built and sold mainframe
03:48computers and they were one of IBM's main competitors in that market for many years during Janine Harms time
03:55in Silicon Valley I mean she was a woman who was handling millions of dollars in contracts and back
04:00during those days there were not a lot of women in Silicon Valley she was a hard worker she committed
04:07herself to her job she put in long hours staying late and going in early that's the woman she was she
04:14loved what she did and she loved working for that corporation and when we talk about the tech bros
04:20guess what Janine Harms was a tech bro Amdal which was making these mainframe computers
04:27couldn't keep up with IBM's technology so they started having a really hard time they started
04:34laying off people you know Silicon Valley companies go through layoffs and Janine had gone through a
04:40couple to where she was worried about her job but she always survived them her boss at Amdal I know that
04:47he thought a lot of her and probably helped her save her jobs during these layoff times for Janine
04:54even though things at work were getting a little bit more difficult in her personal life she just met
04:59a man named Randy Harms I didn't know a lot about Randy before she decided to marry him which was weird
05:07I was a little shocked by the whole thing when I found out she was getting married but you know I was
05:13supportive they seemed to get along it's too bad it didn't last I wanted her to be happy she was moving
05:23up in her career at Amdal and I don't think he was in a similar position in his career I think they just
05:31grew apart and he wasn't the person that she wanted to grow with in April 2001 the apartment next to my
05:44mom's apartment was vacant so I asked Janine if she wanted to move in and she did she was having a really
05:52good time living on her own she was living the life right then she was really really having a good time
05:58she made good money but she did like to spend money too she loved to go out and shop she bought her
06:09dream car which was a Ford Mustang black and she immediately ran out and got racing stripes for it
06:16and she loved driving it there's absolutely a work hard play hard mentality in Silicon Valley she really
06:27was disciplined at work was always on time and I think for her to blow off steam after work it's all part
06:36of just getting through life in Silicon Valley there's a lot of stress she was very motivated to find
06:44somebody after her and Randy divorced and so that drove her to go out more she used to go out a lot
06:53on the weekends to a couple bars in Los Gatos and meet people that way things were looking pretty good
07:00for Janine Harms she had survived the layoffs she'd survived a divorce from her husband and then
07:08everything changed July 27 2001 I saw Janine at her house she was getting ready to go on this date she came
07:25out and said goodbye and I was the last time I ever saw her she had reluctantly made a date with this guy
07:36who was being real persistent with her they had made a date a couple of weeks earlier and she blew him
07:43off he just kept being persistent so she reluctantly agreed okay I'll just meet you for a drink she
07:52had asked me if I could go and I had already had a date and was going to the movies I wasn't really sure
08:00what was going to happen I just left when we went to the movies and that was it I was very curious to
08:11hear the next day like what ended up happening did you meet him I think I left a message on her home
08:17phone and her cell phone was going straight through to voicemail which I thought was odd
08:23odd so I called her at work Monday morning and she didn't answer and I thought that was odd too
08:32because she used to pick up her work phone so I called Chigi and said have you seen Janine since
08:40some Friday night and she said no I mean her car's here but I haven't talked to her and her windows are
08:48closed at that point I decided to call back to her work and ask for one of her co-workers she said you
08:57know we're really worried about Janine she didn't have a day off planned and this is not like her she's
09:02never not shown up for work and that's when I was like oh god something is really wrong
09:08Chigi ended up being the one to call the police when the officer got there I had a spare key when
09:19you open up the door you're looking right into the living room and what I saw was the couch with no
09:27cushions on it and there was no rug I knew right then something terribly was wrong why would the rug and
09:36couch cover and the cushions be missing when I looked in her bedroom I could still see the
09:42indentation where she had sat on the bed to put her shoes on so I knew the bed hadn't even been
09:47touched in addition to the Persian rug and the cushions from the couch being missing her car keys and her
09:55wallet were missing the odd thing about that was Janine's car was still parked in her driveway so if she
10:03went somewhere she didn't drive her car by the time I got there Chigi and the police officer were already
10:11there but at the time the police officer didn't seem all that concerned because it was clean there was no
10:18signs of a struggle there were no broken dishes or knocked over tables it was a very odd scene there
10:27was nothing was roughed up in the house but the items that were missing were extremely suspicious in
10:36other words these aren't things that people would steal they wouldn't just come into a house and take two
10:42cushions Chigi and I both knew there's something really wrong this is not like Janine at all so I
10:49think it took a lot of us explaining to the police no this is not normal where's her purse and her keys I
10:57was just a wreck all I could think of was the guy that Janine met that night something happened
11:04something bad happened when Los Gatos police arrived at the scene they're looking for the missing person
11:14simple as that is the missing person in the house well they don't find the missing person she's not
11:20there so obviously what they're going to do is check for signs of force entry they did that there were
11:26none the place was clean didn't have any signs of struggle there were no signs of blood the house was
11:36swept for fingerprints and her house appeared to have been wiped down because they didn't find
11:43fingerprints they didn't even find Janine's fingerprints so that's another clue that something's gone
11:51wrong Janine played the guitar she had a guitar over in the corner they picked it up they dusted it there
11:58were not even any prints of Janine's on the guitar there was just complete lack of evidence in the house
12:05but certainly there was evidence that Janine had not left on her own to go somewhere the police were
12:13pretty sure that this was foul play Janine was in the middle of a divorce with her husband Randy
12:21now typically if we have a homicide we would look at the husband is it possible that Randy Harms
12:31discovered that his wife was going out with other men could that be a motive of course it can be and so
12:38they did delve into Randy Harms they found out that Randy Harms was out of state the night that
12:47Janine went missing Janine's friends knew that she had a date with someone that Janine was not really
12:55excited to see but they didn't know the name of the fellow she was meant to meet so her work was called
13:03we didn't know the guy's name she was with and we were certain that that guy must be the one that has
13:10her I called her co-worker and said did Janine tell you the name of the guy she was meeting and
13:18Marcia goes hold on I'm going to check the calendar and on Janine's calendar at work she had written
13:25Alex and a phone number on Friday night and so Marcia gave that to me and I gave that to the police and
13:31they found the person associated with that phone number I remember that the police having a funny
13:41look like yeah it's Alex Wilson he's the son of the former mayor of Santa Clara and we're like oh wow
13:53that's interesting it was almost like okay you've got to tread lightly I guess if his father was the
14:00mayor of Santa Clara Santa Clara sits just northwest of Los Gatos and it's full of tech bros Alex Wilson
14:12came from an old Santa Clara family everyone knew the Wilson name in Santa Clara and the fact that his
14:20father's a former mayor it raised a lot of intrigue even red flags could there be power and influence
14:29police that could influence the case police went to interview Alex Wilson once they had his name
14:38and he was very reluctant to talk to them but ultimately he gives the police a reader's digest
14:47about what happened Alex says he showed up about a half hour late for the date with Janine and Janine
14:57was already there talking with another group of people so he approaches and he too also joins their
15:04group and he notices that Janine is giving a lot of attention to a short stocky guy slightly balding
15:11and he's annoyed by this because she's supposed to be going out with him so after sitting with this
15:17group of folks at some point Alex Wilson claims she invites both of them to her home for a nightcap
15:25but he decided that he didn't want to go so Alex ultimately said he never went to Janine's home
15:34immediately we think we really have to look at this guy Alex Wilson is the person that Janine was
15:41meeting that night Janine didn't want to meet him she'd blown him off once she wanted a buffer when she
15:49was going to meet him the second time I heard he was pretty rude with the police he was annoyed with
15:56Janine and he actually used the term she's a psycho bitch now that's interesting right Alex had not
16:05been cooperative and there's two ways of looking at that he's not cooperative because he didn't have
16:11anything to do with it or he's not cooperative because he did the police didn't know whether or
16:17not he was a good suspect so they continued their investigation they impounded Alex Wilson's car
16:25they brought a canine dog to his car and a canine dog looking for the scent of Janine Harms hit on that
16:36car not only did the canines pick up something on the back seat of the car there was a shovel and a set
16:48of maps located in the trunk of that car that pointed to Alex Wilson's family's property located
16:55on Mount Hamilton in East San Jose what are the odds that you're going to find a shovel what are the
17:02odds that you're going to find a map and what are the odds that the canine is going to hit on the
17:06missing victims odor in the back seat of Alex Wilson's car all that leads to me thinking this this guy is my
17:15number one suspect they still haven't found Janine's body where's her body could it be somewhere on Alex
17:24Wilson's property in the days after Janine's disappearance investigators are looking at Alex
17:40Wilson Wilson as number one suspect who happens to be the son of a Silicon Valley well-known family
17:47this is a case with foul play a missing woman you think the worst has she been buried
17:58police got a search warrant and did a thorough search of that property owned by the Wilson family
18:07they send out cadaver dogs canines who go out and start searching this property
18:13they didn't get a hit they search the property they have nothing so they can't go forward with Alex
18:23Wilson there were really two reasonable explanations for the canine dog hitting either it was a scent that
18:31Alex Wilson had on him from Janine harms or it was more sinister than that she had been in the car
18:39but we can't prove he's involved
18:43he's one of the last people to see her
18:48he had a bad attitude toward police he had a shovel at his car but that isn't really enough
18:57to say that he was involved with her disappearance so they start looking at other possibilities in this case
19:05Janine had been missing for several days it was big news all over Silicon Valley it was on the news
19:15it was on the front page of the paper still no sign of Janine harms her disappearance made national
19:22television last weekend and police have received dozens of tips from the public but nothing investigators
19:28admit that looks like a case breaker the Janine harms case was a huge story but the DA's office and the
19:37Los Gatos Police Department use the media to hopefully get clues and hints from the public
19:44because when a person goes missing you need information once Janine disappeared there was a huge
19:56effort to find her her friends started websites we had a anonymous tip form posted on her website in case
20:07anybody had information they could submit anonymously that was pretty impressive during that time
20:13considering internet technology was relatively new her company amdahl they contributed money as well
20:20in the search effort
20:26at this point alex wilson knows wow i'm a suspect he's not talking to police anymore
20:33but police obviously now have Janine's car
20:37the technician dusting janine's car lifts a single print
20:45after lifting that print they put it into the system
20:48when they run the print they actually get a hit
20:52everyone expects it to be alex wilson but they're way off
20:56it comes back to 37 year old maurice nazmi
21:04maurice was a berkeley educated architect who had a job with a local firm
21:13with startups popping up left and right
21:15being an architect was a good job to have in silicon valley during the tech boom
21:24and just like the tech bros maurice was very active in the local nightlife scene
21:31the reason the police were able to link the fingerprint to maurice nazmi was because of a drunk driving arrest
21:39maurice
21:42maurice nazmi is a match for the description provided by alex wilson of the short stocky almost balding man
21:52so now the police have his contact information and they proceed to his home
21:58when they first made contact with him he is very cooperative he starts talking to them and he's going along with the program
22:06he admitted that he had been with janine harms and admitted that he had drinks with her
22:19maurice's version of what happened on that friday night
22:23is that he was hanging out with some colleagues
22:27janine was sitting at the bar
22:30one of his colleagues invited her to join their group
22:32but at some point another man alex wilson approached janine and he joined the group
22:41and then janine invites both of them to her home for a nightcap
22:46he said alex wilson was going to come with us but then he decided not to
22:51we picked up a six pack of beer then we went to her place
22:57they go in she starts playing her guitar
23:07and they just kind of hang out for a while he's saying that they came back to her house
23:13they drank a couple of beers then she fell asleep on the couch
23:17and he left but the weird thing was maurice claims that when he was leaving her house he saw somebody
23:28else kind of walking up towards her house
23:32the way he described that person it sounded like he was describing alex wilson
23:37there are pieces of maurice nazmay's story that's not adding up for investigators
23:46and specifically there's one piece that's really not adding up
23:51maurice said that janine played the guitar
23:56so why doesn't janine's guitar have her fingerprints on the guitar
24:00and i also find it strange that he said they brought the beer they drank the beer but they
24:06didn't find any beer bottles you drank beer you had a six pack of beer you guys were drinking
24:11what happened to the beer and the empty bottles so maurice tells them well i took the beer and i also
24:17took the empty bottles i just didn't want to be rude or i just took them with me let me tell you
24:23something that's suspicious okay who takes two empty beer cans with them talk about a red flag
24:32the things that he said it just didn't add up to me like she fell asleep on the couch
24:36that's just not janine she just doesn't do that it just seemed weird to me the whole
24:41story seemed weird and completely out of character for her i remember thinking to myself
24:47that maurice this just sounds like the guy that did it
24:53that's what i was going to tell you about to tell you about to tell you about to tell you about
24:59maurice nazmay now is a suspect in the janine harms disappearance
25:05he claims when he was at her home that she fell asleep and that's how he left her
25:12the investigators find this to be very suspicious
25:16police get a search warrant for his car
25:20and the car is impounded and searched for evidence
25:27nazmay says he has not cleaned the car but it looks pretty darn clean
25:32they sweep the car for dna they sweep it for fingerprints
25:39during the search they locate 27 unknown fibers in the back of maurice nazmay's jeep
25:46they know that the persian rug is missing fibers lifted from the green jeep may well match the persian
25:58rug but they don't actually have the persian rug so everything is held in evidence maurice nazmay
26:05ultimately hires a very well respected attorney in the valley and after that he invokes his right not to talk to us
26:17and he refuses to take a polygraph
26:19at that point it just became just very frustrating like okay these answers that
26:30we wanted to get so quickly it's just taking forever it was frustrating just sitting and waiting
26:37and you know time is ticking whatever the police were working on they weren't always forthcoming with
26:44us so we weren't really up to speed on what was going on in the investigation this started out a
26:50difficult case and it continued that way for a while because it was the lack of clues that had
26:58investigators and prosecutors scratching our head it was basically a cold case for a couple of years
27:05janine's family was just heartbroken by this situation
27:09i had many many phone calls with her mother promising her that we're not going to give up on
27:15this case we have to do something we can't just sit back and wait and wait and wait gosh it was tough
27:23on the whole family especially wayne wayne loved janine but wayne i think had some moments where he was a
27:34little too antagonistic with her and i think his past relationship with janine kind of ate away at him
27:47i know myself i was trying to stay hopeful that janine was going to come back
27:56because without her body it can let your mind wander into thinking
28:01things that maybe there is a different explanation for it even though i know there's probably not
28:09you can think of all sorts of weird things when you don't have a real answer or proof of what happened
28:19as we're all scratching our heads on how to make this case a stronger one we decided why don't we get
28:26the picture of the rug and run it in the newspaper we didn't even know at that point if we had a
28:31photograph of the rug it was something chiggy came across and was like oh this is you know i have a
28:37picture of the rug my mom had a camera when she died and on the camera was a roll of film and so i had
28:47it developed and it just so happened that on that roll of film the last picture on the roll was a picture
28:54of the rug with my son standing on it if they could find the rug that would carry this case forward
29:04but the rug's been missing for two years this is a total long shot but the police decide to put
29:11a picture of the rug that was missing in the newspaper it was crazy it was a long shot
29:18but we took it and that's when we hit the jackpot unbelievably the police get a phone call from a
29:26woman who says about two years ago i found a rug similar to that and i took it and brought it home
29:35it was found near a large dumpster a couple of miles from janine's house
29:41janine's landlord and one of her best friends had given her that rug and she told us that there was
29:50a distinct mark on that rug a few of the tassels were singed police immediately went out to look at
29:58the rug and sure enough it had little singed tassels
30:04they confiscate the rug take it in for evidence
30:07when the wool fibers removed from the back of the green jeep are compared to fibers coming from
30:18the persian rug they match
30:24police on december 16 2004 arrested maurice nesmay for the murder of janine harms
30:32it's a weird feeling when you find that out because i i was happy that they arrested him
30:40i was really happy but it still doesn't bring her back you know but yeah it was a it was a good
30:46feeling knowing he was finally in custody i remember thinking and hoping that maybe now that he's under
30:54arrest he would confess to what he did with janine and we would be able to find her and bring her home
31:02in the back of his jeep
31:09this case is layered with tragedies and i think it centers on the amount of time that the family has
31:15had to wait for an answer
31:19evidence was presented that showed that these fibers from the persian rug were found in the back of his
31:27his jeep and maurice nesmay was arrested because of that evidence
31:35the case all came tumbling apart when the criminalist who worked in the santa clara county
31:44criminal lab was determined that he did not have proper certification to come to that conclusion
31:49they now have to resubmit that fiber evidence to another technician it's going to take about a year
31:59as they send it out other cases are coming in and the fibers have to go through probably 10 different
32:05processes so unfortunately it does take a lot of time at this point maurice nesmay has been held in
32:13custody for two years awaiting trial in 2007 maurice nesmay says i have a right to a speedy trial
32:26and i'm going to invoke that right now and at that point the judge dismissed the case because the people
32:34were not prepared to try the case so after he was in jail for two and a half years they had to release
32:42him we were just you know understandably devastated and frustrated like oh my gosh you know how can this
32:52get any worse there's a lot of evidence that he murdered janine harms but he's out people are not
33:01comfortable with that some people are worried that something else is going to happen channel the
33:08emergency what are you reporting holy what is the address he has a gun or a knife stay on the phone
33:15what's the address oh my god oh my god oh my god oh my god
33:18on june 28 2007 maurice nesmay is released from jail
33:35we were told that they fully planned to rearrest him after they have a new fiber technician analyze the
33:42evidence and they were going to hire the best in the country and they felt this was going to take about
33:47a year and then it didn't take a year we'd constantly be calling the da and they'd constantly
33:54tell us oh it'll be another six months it'll be another six months it'll be another six months and
33:58it just went on and on the wait was so long and i believe that wayne poor wayne after she went missing
34:12i think he really had demons from that point on he felt like he should have been more of a protector for her
34:22and i think it just ate away at him
34:28on january 15 2011
34:33wayne sanchez is sitting in a popular restaurant watching a hockey game at the bar
34:37when maurice nesby walks into the restaurant with a date they settled next to him and they
34:46struck up a conversation and somewhere during that conversation wayne realized who he was
34:52they got into a little bit of a confrontation
34:56wayne probably confronted him and said hey i know who you are and then wayne left
35:02and went home and came back
35:10by this time maurice has moved to a coffee shop wayne walks in and there's pandemonium in the coffee shop
35:20the emergency what are you reporting hi i need somebody escorted out of my store right away he's
35:27causing problems is he fighting with people yeah he's fighting with somebody right now what is the
35:33address we need to come out to oh holy what is the address or a gun he has a gun or a knife
35:40wayne tells the date to get out of the way and with one shot he murders maurice nesme
35:52oh my god he shot somebody oh my god oh my god oh my god oh my god holy holy
36:00the employees had called the cops so wayne walked out and i think he heard the sirens coming
36:11and at that point he turned the gun on himself
36:22i think wayne probably felt that the universe just handed him his sister's killer and that he felt
36:30that he had no other choice but to take justice into his own hands
36:34i think he probably felt that he was doing his family a favor by taking care of the person who killed their daughter
36:45but part of me was like now we're never going to know what happened to janine there goes
36:53the answers i guess because he's the only one who can tell us that was it it was gone
36:58this poor sanchez family has suffered an unimaginable second tragedy it tore my heart out
37:10six months after the death of the brother and the suspect
37:14the report comes back from the lab it's the same same results
37:21the private lab confirms everything that the criminalist from santa clara had said
37:26if the fibers had come back faster maurice would still be in jail the brother would not have seen
37:33him in public the brother would not have killed him and the brother would not have committed suicide
37:38that's the tragedy of it the evidence was there all along
37:42and it just came too late several months after the murder suicide the district attorney jeff rosen held
37:53a press conference there is no innocent explanation for those 27 fibers being in the back of maurice
38:01nazme's jeep cherokee and the district attorney said he considered the cases closed
38:12law enforcement believe they have a pretty good idea of what happened that night
38:21they theorize that maurice came back to janine's home with certain expectations
38:25and when janine rebuffed him that's when things turned violent there are a lot of theories about how
38:32janine was murdered but there was no blood so one that makes sense to me is that one of the couch
38:41pillows was actually used perhaps to smother her
38:52then he wrapped her body up in the rug took her body to his trunk and drove away
39:01and disposes of her body
39:02the only lingering question left is where is janine harms
39:14it still lingers in silicon valley because her body has never been found and i think for that reason
39:23there's something very unfinished and especially tragic about it
39:30even now it's a huge story you say the name janine harms to anyone in the valley
39:38and they know at least part of the story
39:40the sanchez family just went through the ringer it's just heartbreaking
39:50they died not knowing where janine was it's just unspeakably tragic
40:00i would love to find somebody with knowledge of where she is i mean even though maurice is gone
40:08i think he probably told somebody it would be really great if we could
40:14find that person and find that information
40:20the family has a niche in the los gatos memorial cemetery and her mom her dad
40:28her grandmother wayne they all have urns with their ashes and there's an engraved urn for janine in
40:36the this glass niche there's a spot for her waiting to be with her family and
40:43that would be the ultimate and the best we could hope for let's bring her home and put her with her
40:48family the world is not a better place with her gone it's really not it would have been a much
40:56better place with her still in it she was a wonderful human being
