00:40The Supreme Court has delivered a significant ruling on the VAKF Act
00:44Though it declined to stay the entire law
00:46But put on hold three key provisions
00:51Including one, requiring potential donors to be practicing Muslims for five years
00:56While both the sides are claiming victory after the interim order
01:00The question remains, what does this order really mean
01:04And who truly benefits from it
01:06We'll try and decode that on Newstrak with our top guests joining me shortly

01:23But first up, here's what happened today
01:25In a significant development, the Supreme Court has refused to stay the VAKF Amendment Act 2025 in its entirety
01:37But stepped in to freeze key provisions seen as controversial and constitutionally sensitive
01:43The court put on hold the provision that a person should be practicing Islam for five years
01:50As per Section 3R to create a VAKF
01:53It said that the provision will be stayed till rules are framed on determining whether a person is a practitioner of Islam
02:01The Apex Court further stayed a provision which empowered a collector to determine whether a property declared as VAKF is government property and pass orders
02:11The CJI-led branch also said that permitting an executive officer or collector to adjudicate property rights violates the separation of powers
02:22And it has put a bar on changing revenue records
02:25The court held that the Central VAKF Council shall not consist of more than four non-Muslim members and a state VAKF board not more than three
02:36The court directed that ex-officio officers in VAKF boards must be from the Muslim community
02:42While the opposition welcomed the Supreme Court's interim order on the VAKF Amendment Act 2025
02:49The BGP claimed it a positive development
02:52We hope that the Supreme Court will make a final decision to make a final decision
03:00Which is necessary to make the Supreme Court
03:05In a way, the Parliament of India's decision will keep the Parlement of India

03:51Dr. Singhvi, I appreciate your time
03:53The Supreme Court in today's judgment has expressed
03:56And I'm quoting sir
03:58In the totality of the circumstances
04:00We do not find that any case is made out to stay the provisions of the entire statute
04:06Given that the petitioners were seeking a total stay on this Act
04:12Is this a setback?
04:16I'm glad, Maria, that you started with this question
04:19It's been running across the news cycle since afternoon and in the evening in several of the channels
04:26I am frankly quite astonished
04:29It betrays a delightful, happy, blissful ignorance of law, principle and of what happened in court
04:38First and foremost, a full act being stayed
04:43To the best of my knowledge, either never happens or happens extremely rarely
04:48Under our constitutional articles also
04:52For example, article 13
04:54You only in the interim or finally
04:57Stay or stop or nullify
05:02That part or that degree which is offensive
05:05It is not a blanket
05:07Bullion at China shop approach by any court
05:10But that's legalistic
05:11The funny part
05:12Of some very eminent greases

05:45So this is absolutely a, almost a, were it not a great tragedy of miscommunication
05:51It would be comic
05:52Why should you want to stay of the whole Act?
05:56There are various offensive provisions of the Act
05:59According to the petitioners
06:02According to them, they are the major irritants on the ground in reality
06:05You were considering, as the apex court, an interim arrangement
06:10You were not deciding it finally
06:12So as an interim arrangement, you will only touch upon those things
06:16Which are more of an irritant
06:19Till such time as you can hear the matter finally
06:22In the interim, indeed, even finally
06:25Either the Act is quashed
06:27But in the interim, nobody stays the whole Act
06:30So therefore, we only asked for those major irritants
06:33And as I will go down the program with you
06:35I believe we got 70-80% of the major irritants stayed
06:39There were one or two setbacks, very candidly
06:42An interim order, on the whole, balanced in the favor of protecting the petitioners' rights
06:49And I will go one by one and tell you how
06:51Okay
06:52Dr. Singhvi, vakf by user
06:55Let's look at that
06:57Because it was one of the major contentious parts of this amendment
07:01You in court had argued that this concept
07:04Has been judicially recognized even by the Supreme Court
07:07In the Ramjanam Bhumi Temple case
07:10However, the Supreme Court accepted the fears of misuse
07:14And declared that the deletion is not arbitrary
07:16Given that the Solicitor General
07:17Had assured that the deletion shall only be prospective in nature
07:22Are you then satisfied with this observation?
07:26No, no
07:26You are absolutely right
07:29In the 70% to 80% positive bag of the interim order
07:34The balanced 20%, I would say the biggest part
07:39Which I am disappointed with
07:41Is the vakf by user part
07:42There are other peripheral issues
07:45Which are not really serious on the ground
07:47What was serious on the ground
07:50Which we have not succeeded in in the interim
07:52As you rightly put it
07:54Is vakf by user
07:55Now the reason I am disappointed is
07:57Because in the case of vakf by user
07:59Which I specifically argued at great length
08:01There is very respectable lineage
08:05Of case authority prior
08:07Not only the Ayodhya Rama Janam Bhumi
08:09But Ayodhya Rama Janam Bhumi itself cites 100 year old cases
08:12Which say that this is a concept in Islam
08:15Recognized as a customary situation
08:18For decades and for many, many half centuries
08:23Now that having got a court ratification in earlier judgments
08:29Could well have been a basis for giving an interim order of stay
08:33Now the court in his wisdom has not done it
08:35It still falls in the 20 to 25% bag of disappointments
08:39You win some, you lose some
08:41You have to respect the court in the 80% which you've won in
08:44This would have been very important for me
08:46But of course it has not been done
08:48I think it will lead to some chaos on the ground
08:50A large number
08:52The numbers were given in the preceding
08:53Hundreds and thousands
08:54In fact sometimes they say even the majority of works

09:16Would you say that an important part of the judgment
09:20In which the court is, you know, in its direction has said
09:24Will not prevent the parties from making submissions
09:27With regard to the validity of the provisions
09:29Contained in the amended work act
09:32Or any of the provisions therein
09:35Do you see this as a win for you
09:37And this will be part of those 70-80 safeguards
09:40That you're looking at?
09:40Well, let me just itemize them very briefly
09:43Without being technical
09:44For your audience
09:45One of the major ones
09:48Very major ones was
09:49Which I had specifically pressed and argued
09:51This thing about disqualifying somebody
09:55On the basis that he's not a five-year practicing Muslim
09:57We had pointed out several scare scenarios
10:01An impossibility of determination
10:02An impossibility of criteria fairly applied to decide
10:06How do I come into your bedroom or drawing room
10:09And prove that you are or you're not a Muslim
10:10You go by rumor, by innuendo, by insinuation
10:14By arbitrariness, etc.
10:15All that has been accepted by basically saying
10:19That five years will not be acted upon
10:24And remember this is an interim order
10:26Unless and until requisite rules and details are given
10:29Of course when the rules come and the details come
10:32If they are themselves arbitrary
10:33Or nonsensical or whimsical
10:35They can again be challenged
10:37But as of now there are no ways, criteria to determine it
10:40And the court has therefore rightfully stated
10:42That's a major victory
10:43The second major victory is
10:45That
10:46You had
10:49An entire set of
10:51I don't want to bore you with details
10:52In fact three provisions
10:54Which said that
10:55You will cease to recognize you as a vuck
10:58While I
11:00A government officer
11:02Undergoes the process of determining
